Arcanum used tile based graphics, TOEE used pre-rendered graphics, maybe they had more in common elsewhere, but the graphic engine is different.
PST and BG2 uses exactly the same area formats and only very small differences in item and creature formats. By all rights, they are of the same family.
The price Monsoon asked for their version of the software is a good base for the damages estimation. It needs to be determined, how much percentage they lifted from the GPL code and how much is their genuine code.

Between 63 and 68, the US was different, they were very motivated to get to the Moon. Just because the Chinese use existing technology, it doesn't mean they can't beat the US, apparently this Russian technology is better (safer and cheaper) than the US technology which built (partly) the 1,000,000lb ISS.

Copyright infringement is theft.
The problem with RIAA is that they try to sue people who didn't infringe their copyright.
They admitted they are using GPL code (they mentioned the original FOSS code they lifted).
They simply didn't make the modified sources available.
And linux people don't do illegal stuff, so it is out of question.
