First of all, you take down an ISP in addition to the spammer, but in addition the ISP may now have to help the spammer to defend itself in order to keep other innocent customers online.
Its important to keep the rules simple. Otherwise you will lose cooperation among ISPs. DDOS is bad. Spam is bad. Lets cooperated and stop both.
