    This is just silly. An illegal wiretap is intercepting a communication between two computer/people/objects without either 1.) the permission of one party, 2.) a court order. If you are a party to the communication (i.e. the honeypot) you are intercepting communications to and from your own machine. Seems like there are bigger things to be worried about.

    This is just silly. One of the reasons we have the denominations we do is b/c it makes math easy. Could you imagine the high school drop out behind the 7-11 counter trying to figure out how many 18 cent pieces they had to give out.

    And the coin to make transactions with canada and the EU is silly as well. The exchanges rates fluctuate....should we coin a new coin each time they change?

    Read the case...EF Cultural Travel BV v. Explorica hinges on the fact that the defendant company hired an ex-programer from the plaintif company. The programmer had special knowledge of codes used in the pricing (which he had signed a confidentiality agreement not to disclose). When he made the scrapper program he violated the confidentiality agreement.

    It was the violation of the confidentiality agreement that the court held was illegal.

    As for whether you should tell your employer, it depends on your employment agreement! :) Depending on how the contract is written you could be jointly liable.

    While this is a 1st Circuit case, it has been followed by the 5th Circuit (Ingenix, Inc. v. Lagalante) and cited in cases in the 7th and 9th Circuit.

    A few resouces on the web to look at for the laws are:

    Your local Attorney General's Office. The New Hampshire AG's office has some info about telemarketers here.

    I can't put my finger on it right now, but it is illegal for a telemarketer to call a cell phone. The problem lies in tracking down who it is to sue if you want to pursue that route.

    The benefit for number one is usually a liabilty shield. You will have to observe all the corporate formalities (ie have board meetings or at least minutes from them), keep the books straight and not treat it like your personal account, etc. Otherwise the corporation will be invalid. Starting it up is realatively easy. Go file a registration with the Sec. of State in your state.

    Option number 2 or 3 would probably be the easist. Do you really want to have to worry about filing all the IRS stuff your self?

    Jurisdiction on the internet has yet to be truely solidified. How do you think jurisdiction will eventually be settled? Does an e-commerce sale occur at the computer it was bough using, at the server hosting the web page it was bought from, where the company is headquartered? Can e-commerce survive without answering this question?
