    Only $50 dollars? Must be small and minor boo-boo. If you make a real mistake of thousands or more, and depending on severity of the mistake, jail time is a real possibility.

    This year, I had to pay taxes and so mailed in a hard copy of my taxes. They made a mistake on entering in my taxes. They sent me a nasty letter informing that if I did not pay I would be in all kinds of trouble.

    As it turns out, they admitted the mistake, it was obvious of the problem. However, I had several days of anxiety. All since they made a small mistake. Where is their correction and error? None.

    The police should not be held liable. The clerk and the court who made the boo-boo should be held liable. After all they deprived the man of his liberty.

    And my answer would not change if there was a dead body in the trunk.

    The government should never be rewarded for bad behaviors or a mistake. And yes, people can live without boo-boos. Look at the banks.

    Hey AC. I am not a fan of the ACLU in any way shape or form. When I agree with them, I have to make sure of the facts, since I had to have made a mistake.

    Even a broken clock has its use.

    And I agree with the ACLU just often enough. Though I would agree with a stopped clock much more often. In this case they are correct.

    Your friend should be compensated for harm caused upon him from the court office. If it was a weekend in jail, I would suggest at least 50K compensation.

    The court that issued should be held liable for the mistake of taking away a person's liberty.

    If course he is justified. I think that the dispatcher should receive the jail time equal to the person arrested. Or at least fired.

    Actually, I think that is far to much to ask for. What if you are in California or Texas. And you are in San Diego and the warrant is issued 10 hours away? I think there should be a verification that the warrant is valid PRIOR to arresting the person.

    Or worse yet, what if the court is closed for a three day weekend? OR as we have in SD, the court is opened once a week.

    Just as in the OJ murder trial, the government should never be rewarded for bad behavior. For the record OJ was clearly guilty but there was planted evideance. Hence the correct (if wrong reason, per interviews afterward) verdict. Please no OJ flame war.

    In this case, while the person is clearly guilty of said crimes. The government was rewarded from a mistake (bad behavior). The government should never be rewarded for a mistake, or bad faith, or an 'accident', or any kind of bad behavior.

    I truly belive in letting 100 guilty free to save one innocent person from spending a day in jail.

    Disclosure: I work in the correctional system and am a solid political conservative.

    The choice comes when it comes to 7th grade Pre-Algebra.

    or 8th grade Alegbra. If you pass on 8th Grade Algebra, you are officially behind the curve. The odds of catching up are small.

    I will not even mention the issues of languages.

    I live way out there. Most kids live in cities. Something like 97% of the population live wihtin a few miles of the school.

    Can we deal with 97% or so of American kids and let the 3% be helped.

    The problem is that we give awards for to many things. When there are 30 kids in a class and there are 60 awards, two for each student is stupid

    I have been teaching for several years.

    Actually, the high-minded stuff goes off really well. As I said in an above post: I am in school most people will not teach at. We lose about 1/3 of our teachers every year, most not making it a year.

    But guess what, these kids learn. They want to learn. Now I have no more then 12 in class. Most classes are about 8 students.

    And yes that does make it easier.

    1. Gays are protected under the same civil rights as every other American. The other basic problem is that I have never met a former black man, on the other hand, I have met many former gays.

    2. I make the distinction of marriage and civil unions, as I do for all other people. Marriage is not sanctioned by the state. For years we fought against the having to have a piece of paper to define love or my commitment to another. I have been married for over 20 years, and if something happened and I was to be married again I would never ever pay the tax. A piece of paper is worthless.

    3. There may or not be a lot of other stuff going on. All I see is the state overstepped their authority.

    4. The you was not you specific but the general you. Dissent is not unpatriotic. Dissent is inherently patriotic.

    I know people belive this stuff.

    I have argued, in the past, that:
    1. Gays do not need special protections under the law.
    2. Gays should be allowed to have civil unions. I make a distinction here between marriage (a religious event) and the civil union (at the court house). IF a church wants to marry gays . . . fine.
    3. Likewise if someone wants to have a religious marriage and marry several spouses . . . fine. Read the Fundie Mormons in TX. If 10 women want to marry the same person . . . I want the government out of my bedroom.

    Of course how can you 'support the troops' and degrade them at every turn?

    The difference is that she only asked for $175K. At the time he was making over 400K and today is part of the ultra rich.

    I think the Clinton lawsuit and SCOTUS ruling was good, just as impeachment of Bush would be good.

    The real question about Clinton is not that he did it while in office. After all it is a powerful position. Men do not ascend to positions of power and be choir boys.

    The only problem with his sex is that he got caught. You should be more worried about a man who ascends to high office and has tons of power and does not get some nookie on the side.

    IANAL.

    However, if I sue you for $10,000.00 because I think you wronged me. You may go down to the court house and submit a cashiers check for $10,000.00 thereby settling the lawsuit.

    At that point there will never be one word of deposition ever given. Clinton (a lawyer) could have done this.

    I do not find myself agreeing with Mr. Dershowitz politically very often. However, he is very smart and is usually quite logical and sometimes reasonable. See his audio lectures at Trials of the Century
