Basically, it's up the publishers how to handle it. There are minimum and maximum numbers you can work with whether the game is on disc or on Live Arcade, but there's not a whole lot else that they restrict.
Do they have a chance of being rehired? Is there not enough work for them so that they had to be let go? If not, these people were fired. Laid off implies some hope of return.
