    "I believe that when evidence has been tampered with or destroyed it is legal for courts to assume that the evidence was prejudicial. While there may be no smoking gun, the deletion is circumstantial evidence against you. Get enough circumstantial evidence and you still end up in jail." Ok.. I can understand what your saying there.. but what this court decision is now saying is that he should have returned the laptop and leave information on it that would in all sense of being a violation of his rights under the 5th Ammendment and incriminate himself? That to me is the most boneheaded thing I ever heard of. The company received their property.. They are using the lack of information against a former employee..Its a interesting thing.. kind of like McDonalds being sued for spilled hot coffee and pickles.. Oh thats right.. those people won their cases too.. LOL

    If a smart lawyer would take the case.. it could be overturned on appeal.. How can you be charged when there is no evidence to hold you to that charge? The Judges are declaring a clean up of files as damage? Damage to what? the laptop was returned without the normal file associations that usually taints a origional install of the operating system. I tell you.. the more I see the law work.. the more i wonder....

    I can see what your saying with that.. but I have a young cousin that contacted me through MySpace knock-off called Bebo. She posts picture out there and then invites her older relative to view them.. No problem there. But I noticed under the "friends" list a photo that I had to see because it caught my eye.. But it was nothing but a photo of a young 15 year old.. No problem there.. but the comment she put under there.. Well lets just say I wish I knew girls who talked like that when I was 15 years old! But I immediattely wondered if her parents knew she was tempting her male peers.. and posting porn commics on her personal website. Teens always rebel from their parents.. but some take it too far.. and the Internet allows them to do it.

    I receievd training my military career and part of it was in a Medical Unit... I never forgot the lecture about the Red Cross on Helmet comment from the Instructor. "That Red Cross on your Helmet.. Just remember.. we call that the Target, They are not supposed to shoot you.. but they use that symbol to sight in. Just thought your ought to know".

    Earch to all those who took this discussion "to heart" IT WAS A FREAKING MOVIE!!!! Why the Mythbusters would choose this subject is beyond me. But now my geekeness comes out and I have to make the comment.. "A Long Time Ago.. in a Galaxy Far Away........."

    I use GTK in windows to use the PAN newsreader for newsgroups... the Windows version. much more depnedable than most of the other programs in windows for me. YMMV

    Oh PLease!!!! "Let's pull out of the countries we are occupying as quickly as we can without being foolish about it. Let's remove our military bases from the Middle East. Let's divert some of our military budget (say 10% for starters) to helping provide basic necessities to the poorer parts of the world. While we're at it, let's stop torturing people and stop jailing people indefinitely without charge or recourse to the court system" I agree with the stop torturing people, I even might have a leaning towards freeing the gitmo club members because of the administrations statements. But the trivel of diverting 10% of the US military budget to the poorer parts of the world is STUPIDTY!!!!. The United States proved to the world that you can not Spend people out of proverty!! You ever hear of the Johnsons (The president) War on Proverty? Well guess what.. that was the basis of the US welfare state. It Helped a few but there are still folks in the same economic situation that the program was designed to fix. America can not be used to bring the rest of the world out of proverty like many people think..otherwise it too will sink into a economic chaos.
