    I think the issue is a bit more politically complex than people are giving it credit for.

    In order to understand the reasoning behind his shift in position, you should watch This Keith Olbermann Special Comment about the issue.

    To greatly simplify it -
    An army of lawyers have been going over the wording of the "Retroactive Immunity Clauses", and came to the conclusion that it ONLY APPLIES TO CIVIL CASES.

    What does that mean?
    It means even with the "Retroactive Immunity", they can still be brought up on criminal charges.

    I think criminal prosecution in a criminal courty is more important than some petty monetary settlement from a civil one.

    Also, the video mentions how the president couldn't pardon the telephone companies if they are convicted, because that would be an admission of wrongdoing.

    I work in a datacenter in the building where MySpace keeps their servers, near downtown LA.

    I can confirm that they/we had a power outage @ saturday after 6pm , and another one sunday. Needless to say there were a shit-ton of engineers here, some of them bringing in their children, wives, pets(redundant?), etc. I was here for nearly 13 hours after the power outage.

    The building provides 'UPS' to all of the tenants, and has *massive* diesel generators as well. Only problem - the failover system failed. This is the second time that this building's "UPS/Generator" system failed at a critical time - the last time was Sept 12th last year during the big ol' blackout ( http://www.cnn.com/2005/US/09/12/la.power.outage/ ).

    Nonworking generators *suck*.

    I suppose establishing a properly redundant infrastructure is made more difficult with such an exponential rise in popularity. But then again, excuses *suck*.

    Obviously there are problems with this. The exact prices set are probably going to be extremely low, but I think the more important point is that AOL/Yahoo gets to establish 'accounts' with senders.

    These senders who pay for their privilege will do a few things:
    - step up their spam filters
    - monitor outgoing emails more
    - respond to AOL SCOMPS with the quickness

    Especially since accidentally letting a burst of 20,000 emails escape from your server/network might cost you muchos $$. Also, depending on how many 'accidents' have happened in the past, AOL/Yahoo might raise the price per email.

    Sucks for some people, rocks for other people.

    Now, I would think it a LOT MORE useful for AOL/Yahoo to use this as an 'incentive plan' to promote other anti-spam technologies such as 'DomainKeys' and SPF.

    Those sending proper DomainKeys and/or SPF validated messages don't get charged, and their emails make it through the filters as well. They might even be noted as the driving force behind the widespread adaptation of those technologies.
