Maine Dairy Company Settles Lawsuit Over Oxford Comma (bostonmagazine.com)
Daniel Victor reports via The New York Times: Ending a case that electrified punctuation pedants, grammar goons and comma connoisseurs, Oakhurst Dairy settled an overtime dispute with its drivers that hinged entirely on the lack of an Oxford comma in state law. The dairy company in Portland, Me., agreed to pay $5 million to the drivers (Warning: source may be paywalled; alternative source), according to court documents filed on Thursday. The relatively small-scale dispute gained international notoriety last year when the United States Court of Appeals for the First Circuit ruled that the missing comma created enough uncertainty to side with the drivers, granting those who love the Oxford comma a chance to run a victory lap across the internet. But the resolution means there will be no ruling from the land's highest courts on whether the Oxford comma -- the often-skipped second comma in a series like "A, B, and C" -- is an unnecessary nuisance or a sacred defender of clarity, as its fans and detractors endlessly debate.
The case began in 2014, when three truck drivers sued the dairy for what they said was four years' worth of overtime pay they had been denied. Maine law requires time-and-a-half pay for each hour worked after 40 hours, but it carved out exemptions for: The canning, processing, preserving, freezing, drying, marketing, storing, packing for shipment or distribution of: agricultural produce; meat and fish products; and perishable foods. What followed the last comma in the first sentence was the crux of the matter: "packing for shipment or distribution of." The court ruled that it was not clear whether the law exempted the distribution of the three categories that followed, or if it exempted packing for the shipment or distribution of them. Had there been a comma after "shipment," the meaning would have been clear. -
Six Years After Fukushima, Robots Finally Find Its Reactors' Melted Uranium Fuel (gizmodo.com)
An anonymous reader quotes Gizmodo: Earlier this year, remotely piloted robots transmitted what officials believe was a direct view of melted radioactive fuel inside Fukushima Daiichi Nuclear Power Plant's destroyed reactors [YouTube] -- a major discovery, but one that took a long and painful six years to achieve... Japanese officials are now hoping that they can convince a skeptical public that the worst of the disaster is over, the New York Times reported, but it's not clear whether it's too late despite the deployment of 7,000 workers and massive resources to return the region to something approaching normal.
Per the Times, officials admit the recovery plan -- involving the complete destruction of the plant, rather than simply building a concrete sarcophagus around it as the Russians did in Chernobyl -- will take decades and tens of billions of dollars. Currently, Tepco plans to begin removing waste from one of the three contaminated reactors at the plant by 2021, "though they have yet to choose which one"... Currently, radiation levels are so high in the ruined facility that it fries robots sent in within a matter of hours, which will necessitate developing a new generation of droids with even higher radiation tolerances.
Friday a group of Japanese businesses and doctors sued General Electric of behalf of 150,000 Japanese citizens, saying their designs for the Fukushima reactors were reckless and negligent. -
Subsurface Ocean Waves Can Be More Than 500 Meters High
An anonymous reader writes: New field studies out of MIT found that "internal waves" — massive waves below the surface of the ocean — can reach enormous sizes. The most powerful internal waves known to science are in the South China Sea, and they can be over 500 meters high. These waves mix disparate layers of ocean water, and contribute to evening temperatures between various bodies of water (abstract). The waves grow larger as they propagate, and carry on all year. These waves have enough mass to affect the earth-moon system: "To cut a long story short, it's not unreasonable to say internal waves play a role in the moon moving away or receding from the Earth. They are big enough that they affect large-scale celestial motions." -
Happy Pi Day
mikejuk writes to let us know that today is Pi Day — 3/14 in American date notation. He writes, "This year, it feels as though we aren't celebrating alone. For the first time, it looks as if momentum has built up to the point where people have heard about Pi Day. There are even attempts to sell you Pi-related items as if it was a real holiday. But there is always some one to spoil the party so what ever you do to celebrate don't miss Vi Hart's Anti-Pi Rant video." Thus begins the yearly debate over Pi Day vs. Tau Day (June 28). Phil Plait has a post defending Pi Day's honor, and MIT isn't holding back their Pi Day celebrations. Large-scale celebration of Pi Day began in 1988, mostly through the efforts of physicists Larry Shaw and Ron Hipschmann at the San Francisco Exploratorium. The Exploratorium still runs Pi Day events 26 years later, including Pi-themed processions and pie for dessert. In 2009, Pi Day became semi-official through a vote by the House of Representatives. (They did a better job with Pi than did Indiana, who almost legislated it to be 3.2.)
The best way to celebrate Pi Day is to get together with some friends and talk math over a pie. You could even go for a pizza pie, since a pizza with radius 'z' and height 'a' has volume = pi * z * z * a. If you'd care for a game, head over to the Pi Day Challenge, which features a series of pi-related logic puzzles. Or just spend the day learning about pi.
Cool pi facts: Pi is currently known to about 10 billion decimal places. You can calculate pi using the Fibonacci sequence. A few years ago, Steven Rochen mapped the digits of pi to musical notes and turned it into a violin solo (video). Others have made music from pi as well. Mankind didn't know the first hundred digits of pi until the year 1701. How many digits of pi can you recite? The record for memorization currently stands at 67890 digits. The record for reciting pi while juggling three balls is just under 10,000. -
Using Nanotechnology To Build Thinner, Stronger Condoms
Hugh Pickens DOT Com writes "Discovery Magazine reports that the Bill and Melinda Gates Foundation has granted $100,000 to Boston University School of Medicine (BUSM) and Boston Medical Center (BMC) to develop a nanoparticle coating for condoms that will make them more comfortable and stronger while simultaneously keeping them thin to preserve – and increase – sensation in order to make them more appealing to use. According to the Gates Foundation, in the time that condoms have been in use, not much has changed: '[Condoms] have undergone very little technological improvement in the past 50 years. The primary improvement has been the use of latex as the primary material and quality-control measures, which allow for quality testing of each individual condom. Material science and our understanding of neurobiology has undergone revolutionary transformation in the last decade, yet that knowledge has not been applied to improve the product attributes of one of the most ubiquitous and potentially underutilized products on earth.' The nanotechnology that the Boston doctors intend to use for their improved condoms will be superhydrophillic nanoparticles that coat the condom and trap water to make them more resilient and easier to use. 'We believe that by altering the mechanical forces experienced by the condom, we may ultimately be able to make a thinner condom which reduces friction, thereby reducing discomfort associated with friction increases pleasure, thereby increasing condom use and decreases rates of unwanted pregnancy and infection transmission.'" -

The Fall of 38 Studios
An anonymous reader writes "Boston magazine provides the first reasonably satisfying account of the final year of Curt Schilling's video game company 38 Studios, which was heavily subsidized by a huge loan guaranteed by the state of Rhode Island. During his career as a baseball pitcher, Schilling helped lead three different teams to four World Series, resulting in three championships. He has so far been much less successful as a video game CEO; although he has some of the stereotypical qualities of a successful entrepreneur (passion, energy level, optimism, selling ability), his company seemed utterly lacking in controls, while facing a very tough industry and economy. Schilling apparently regrets the decision to bet the company on an MMO game, but otherwise seems to accept little blame for the demise. His company burned more than $133 million over six years, mostly for headcount, according to an analysis of public documents by Providence TV station WPRI." -

A lot of people were interested in the Google contest whose winner was announced last week; Dan Egnor creator of that entry, writes "FYI, I've released the code for the winning Google contest entry under the GPL."

Anonymous Goodfella writes: "In an update to the Dangers of Being a Microbiologist, the AP [news.com.au] is reporting an attack on a Tennessee state medical examiner who gave evidence to an inquiry into the death of infectious diseases researcher Don Wiley. Coroner O.C. Smith was left tied with barbed wire to an apparent explosive."
Jakob Nielsen says Flash No Longer Evil Allen Varney writes "Given that Flash MX now supports the back button, Unicode, and accessibility, and has introduced p$user interface components, usability guru Jakob Nielsen today updated his famous 'Flash: 99% Bad' rant from October 2000. His Nielsen Norman Group has formed a strategic alliance with Macromedia to start educating one million Flash designers in the fundamentals of good design. You did know that Flash .SWF is now an open format, right?"
Step 47: remove blindfold, scream. For those anxiously awaiting (or judiciously pondering) the Linux upgrade kit for the PS2, some words to consider from reader silvaran, who writes: "I just received my Playstation 2 Linux kit in the mail. I was disappointed to find that none of the monitors (3) that I had function properly with it. So I took to following the instructions on a blind install. It's not the most elegant of solutions, but it works. You need a blank memory card to install, but everything else is included in the kit. I'm on my way to a full Linux installation, complete with 100mbit networking, 40-gig HD and a USB keyboard and mouse; also included are full documentation on taking advantage of the PS2 hardware under Linux."
That blind install looks not for the faint of heart -- still, it would be nice if every distro included a simple walk through like that for when a monitor just isn't handy :)
Reader microwerx adds some a few more words of advice and caution: "[T]he PS2 Linux Kit will not read CDRs, so you'll have to use the supplied 10/100 Ethernet Adapter to get stuff in and out of the machine. One very good thing about the PS2 Linux Kit was the documentation regarding the Emotion Engine chip, etc. There's at least 2000+ pages of information regarding how it all works in glorious PDF format. There is also a OpenGL-like library (ps2gl) that supports the hardware. I also understand that SDL also works. Another is the amount of equipment you receive. You get a USB mouse and keyboard, a 10/100MBPS Ethernet Adaptor, A VGA convertor, and a 40Gb Hard drive. And all of this stuff appears to have some future use (you may have to remove Linux to use them nonetheless). So, once again, unless you just want the novelty of having a PS2 Workstation, developing console games, or setting up a small home server, I don't believe that you'll gain too much additional functionality. An overall rating of 3 1/2 stars out of 5 is certainly in order (because after all, it is for game development)."
