FCC Refuses Records For Investigation Into Fake Net Neutrality Comments (variety.com)
"FCC general counsel Tom Johnson has told the New York State attorney general that the FCC is not providing information for his investigation into fake net-neutrality comments, saying those comments did not affect the review, and challenging the state's ability to investigate the feds." Variety has more: The FCC's general counsel, in a letter to New York Attorney General Eric Schneiderman, also dismissed his concerns that the volume of fake comments or those made with stolen identities have "corrupted" the rule-making process... He added that Schneiderman's request for logs of IP addresses would be "unduly burdensome" to the commission, and would "raise significant personal privacy concerns."
Amy Spitalnick, Schneiderman's press secretary, said in a statement that the FCC "made clear that it will continue to obstruct a law enforcement investigation. It's easy for the FCC to claim that there's no problem with the process, when they're hiding the very information that would allow us to determine if there was a problem. To be clear, impersonation is a violation of New York law," she said... "The only privacy jeopardized by the FCC's continued obstruction of this investigation is that of the perpetrators who impersonated real Americans."
One of the FCC's Democratic commissioners claimed that this response "shows the FCC's sheer contempt for public input and unreasonable failure to support integrity in its process... Moreover, the FCC refuses to look into how nearly half a million comments came from Russian sources." -
Net Neutrality is Essentially Unassailable, Argues Billionaire Barry Diller (broadcastingcable.com)
An anonymous reader quotes Yahoo Finance: The billionaire media mogul behind such popular sites as Expedia, Match.com and HomeAdvisor has a one-word forecast for traditional media conglomerates concerned about being replaced by tech giants: serfdom. "They, like everyone else, are kind of going to be serfs on the land of the large tech companies," IAC chairman Barry Diller said... That's because Google and Facebook not only have such massive user bases but also dominate online advertising. "Google and Facebook are consolidating," Diller said. "They are the only mass advertising mediums we have..." He expects Facebook, Google and maybe Amazon to face government regulation, simply because of their immense size. "At a certain point in size, you must," he said. "It's inevitable."
He did, however, outline one positive for Big Tech getting so gargantuan. Big Telecom no longer has the economic leverage to roll back today's net-neutrality norms, in which internet providers don't try to charge sites extra for access to their subscribers. "I think it's hard to overturn practically," he said. "It is the accepted system."
Even if the U.S. government takes moves to fight net neutrality, Diller told CNBC that "I think it is over... It is [the] practice of the world... You're still going to be able to push a button and publish to the world, without anybody in between asking you for tribute. I think that is now just the way things are done. I don't think it can be violated no matter what laws are back." -
26% of Netflix Users May Cancel Cable TV This Year, Says Survey (huffingtonpost.com)
The future looks grim for cable TV providers like Comcast and Time Warner Cable. A new survey says that as many as 26 percent of Netflix users may cancel their cable TV service by next year. Huffington Post reports: Where are they going? If you say "Netflix," you're not exactly correct. The fact is that, according to a recent survey by CutCableToday, 67 percent of Netflix subscribers still have cable. That's pretty much right in line with last year's numbers, insinuating that Netflix isn't necessarily synonymous with cord cutting. However, perhaps a more interesting statistic from the study shows that 26 percent of Netflix users may not have cable by next year. More specifically, 11 percent of Netflix users say they're going to cancel their cable contracts. 15 percent say they are unsure if they'll keep cable or cut the cord. What about the other 74 percent? The survey goes on to say that the most common reason people aren't canceling is due to Big Cable's greatest weapon. The bundle. The survey states that 80% of Netflix subscribers have their internet bundled with TV or phone service. -
Senate Report Says Charter, Time Warner Cable Overcharges Its Customers (broadcastingcable.com)
According to an investigation by a U.S. Senate, Charter and its new subsidiary Time Warner Cable have been overcharging customers at least $7.2 million per year for equipment and service. Time Warner Cable over-billed customers nationwide an estimated $639,948 between January and April period this year. This projects the sum to a yearly total of $1,919,844. Charter admitted that it overbilled its customers by "at least $442,691 per month." A report on BroadcastingCable states:The study found that "Time Warner Cable estimates that, in 2015, it overbilled 40,193 Ohio customers a total of $430,393 and 4,232 Missouri customers a total of $44,152," while "Charter estimates that it has annually overcharged approximately 5,897 Missouri customers a total of $494,000 each year. Charter does not provide service in Ohio." The report also said that Charter and Time Warner Cable have taken steps to correct the situation as a result of the investigation. -
First Net Neutrality Lawsuit Will Target Time Warner Cable
An anonymous reader writes: The U.S. government's new net neutrality rules finally took effect last Friday, and a company is already using them to line up a lawsuit against Time Warner Cable. A firm called Commercial Network Services, which runs a bunch of webcams, says TWC is charging them unreasonable rates to stream video to their customers. "The [FCC's] regulations establish hard and fast rules against slowing or blocking Web traffic, as well as a ban on content companies paying for speedier service once their traffic enters a provider's network. But by design, they don't say nearly as much about how companies should negotiate the private agreements that ensure Web traffic flows smoothly into an Internet provider's network — and to your home." TWC has been arranging "settlement-free peering" with various companies, but refused such a deal with CNS. The complaint will ask the FCC to rule that ISPs must strike free peering deals with website operators. -
Former FCC Boss: Data Caps Not About Network Congestion
An anonymous reader writes "Broadcasting Cable reports on comments from Former FCC chairman Michael Powell (now president of the U.S. cable industry's trade association) confirming what many have long suspected: data caps on internet service aren't just about network congestion, but rather about 'pricing fairness.' 'Asked by MMTC president David Honig to weigh in on data caps, Powell said that while a lot of people had tried to label the cable industry's interest in the issue as about congestion management. "That's wrong," he said. "Our principal purpose is how to fairly monetize a high fixed cost." He said bandwidth management was part of it, though a more serious issue with wireless.' Powell went on to say that ISPs had huge up-front costs which had to be allocated out to consumers, and those consumers were familiar with usage-based fees from paying their power bill or buying food. He was part of a panel with three other former FCC chairs. Dick Wiley agreed with his cost argument, adding that the marketplace was responding better than new legislation could. Michael Copps thought the FCC could question data caps a bit more, but wasn't opposed in principle. Reed Hundt said he wants the FCC to focus on getting better, faster, cheaper internet to 100% of the population." -
Comcast Not Counting Their Video Service Against Bandwidth Cap
tekgoblin writes something not quite worth rejoicing over. From the article: "Comcast Internet subscribers can rejoice. Comcast has recently announced that they will not be counting content streamed via their Comcast Xfinity App on the Xbox 360 against their bandwidth caps. Comcast claims that since the data is only traversing their internal Comcast network that it will not count towards your 250 GB limit a month." Comcast is claiming this does not violate net neutrality laws (and it very well may not); a number of folks are not very happy about it. I've always been perplexed by the large media interests of most U.S. last-mile providers. -
Court of Appeals Rejects FCC's Cable Subscriber Cap
olsmeister writes "The US Court of Appeals Friday threw out the FCC's cap on the number of cable subscribers one operator can serve, saying the FCC was 'derelict' in not giving DBS its due as a legitimate competitor. 'We agree with Comcast that the 30% subscriber limit is arbitrary and capricious. We therefore grant the petition and vacate the Rule,' said the court, which concluded that there was ample evidence of an increasingly competitive communications marketplace and that cable did not have undue control on the programming pipeline. The FCC commissioner's statement (PDF) is available online." -
DTV Converters In Short Supply
Ponca City, We Love You writes with a New York Times story saying there could be a shortage of DTV converter boxes in addition to the problem with coupons. "At the current rate of coupon redemption, 115,000 per day, plus sales without coupons, that means the current stock of converters could be sold out by the end of this month. So what would have happened if the whole digital transition worked the way it was supposed to? Many of those 3.7 million people would be marching into their local Radio Shack and Best Buy stores trying to buy converter boxes next weekend right before the scheduled cutoff on Feb. 17. And if the electronics association's numbers are right, the boxes would have sold out." Good thing the extended cut-off date was approved. -

NBC To Live Stream Olympics Event
An anonymous reader writes "According to Broadcasting Cable, NBC is going to stream the gold medal Men's hockey game live on the NBC Olympics web site. This is in preparation for (hopefully) many more live feeds throughout the year. The video stream will have DRM and IP protection to attempt to limit access to residents of the US, like the other event video on the site. With the stream served by Akamai's CDN, it will be interesting to see if it can sustain the load. The game starts around 8:00am EST on Sunday, Feb 26 if you are interested in checking it out." -
Echostar 'PocketDish' to Playback Video from DVR

Coming in up to 40GB flavors, with varying screen sizes up to 7 inches, the real news is that it allows for the transfer of content directly from a Dish DVR onto the player. From the article: "The PocketDish can download content from Dish Network digital video recorders (DVRs), enabling users to watch TV shows on the go. An hour of content can be transferred to the PocketDish's hard drive in about five minutes." Looks like Echostar is trying to beat the long-rumored iPod Video before it even hits the market." -
Live or Memorex?
Jett points us to an article in free! and another in Broadcasting and Cable, describing how CBS News digitally inserted ads into their New Year's broadcasts - the same technology that adds ads into live sports broadcasts. The technology to undetectably alter a still photo has been around for a long time, but only recently has the capability existed to alter live broadcasts in real-time. The CBS News director suggests that a good, ethical use of this technology would be 'blocking out objectionable signs or covering up a competitor's logo'. How can society cope with a world where seeing can not equal believing?
