Try looking into the laws that authorize FEMA. It has always been commissioned by law and the name actually comes directly from the executive order that combined the laws. The point there is that the laws specifically allowed for the combining of other agencies under one roof which is all the FEMA was.
They (FEMA) actually operate in a framework composed of laws that give them the authority to do the things you and those websites are mentioning. The problem is that they can't unilaterally act without there being a declaration of a state of emergency or some other provision in law allowing it unless the government isn't functional at the time. And the requirement of a functional government is actually listed by law too. This is true for disaster relief (a recent act of congress) and a state of emergency which was enabled in 1947 or so.
In other words, the laws give FEMA the powers. The Executive orders and National security directives dictate the way they will operate in response to certain situations. And Yes, Congress, or at least those with the appropriate security clearances can and do see the NSDs concerning the operations. Congress actually composes it's own NSDs with respect to their competent operations during an emergency that effect or disrupt their abilities to function.
Congress has by law, declared that the President and Vice President, Members of the Congress, Justices of the Supreme Court, and Federal judges appointed by the President are exempt from national security clearances with the exception of the administration, the courts (through the supreme court) and congress itself creates rules in which it restricts access to Sensitive Compartmented Information to those with security clearances the same as government agencies. Now, there may be a delay before congress gets access to it, but section 1631 of TITLE 50 > CHAPTER 34 > subchapter III says that the president can't do anything with respect to special prvisions or laws unless it informs congress of it's intent first either in the declaration of emergency or any executive orders issued. When you look at section 1641 of subchapert IV in the same section of law, you see very clearly that the president is required to disclose the information.
(b) Presidential orders, rules and regulations; transmittal to Congress
All such significant orders of the President, including Executive orders, and such rules and regulations shall be transmitted to the Congress promptly under means to assure confidentiality where appropriate.Keep in mind that this is specifically talking about national emergencies which include all executive orders NSDs included in which is the only times FEMA is authorized to act.
If you only look at the executive orders, I can see where you would get the idea you have. But you have to understand that just because some uninformed partisan hack claims something in order to scare or manipulate your opinions of an administration (yes, they said the same shit about Clinton, and Bush 1, and Reagan, and Carter, and Nixon, and Kennedy, and Eisenhower and probably ford too but I'm not sure he was in power long enough to do much considering the circumstances.) doesn't mean it is true. Granted, it is quite hard to read and understand all the laws associated with the provisions allowing FEMA to operate. The fact is that the president operates withing the law or the constitution or has the belief he is even when he isn't. That is where all the government gets it's power and it is the basic construct that allows FEMA or DHS to exist. The executive orders, contrary to popular belief, don't make law, they effect law in how departments operate and interpret them or use the laws presented to them. It is well-known that in Soviet Russia, and in China, mental illness diagnosis and forced care were used to silence political dissidents. The US now appears to be adopting this method for silencing its dissidents as well.

I'm curious about your sig, are you republican because you're right wing, or because of their radical left wing policies?
I ask because I've noticed that the two phrases have been polarized by politicians, but the two parties seem to be running on opposite platforms from that they claim to follow. The democrats desire to end the unprecidented war in Iraq is in essence a very right wing stance(ask the soviets -- just supporting the military doesn't make you right wing!), whereas the Republicans desire to do get things like the Patriot Act, maintaining Guatemano Bay's illegal prisoners, and bringing about religion based laws, while not "liberal" in the sense of happy fuzzy bunnies hopping around in some fantasy world, are extremely left wing in that traditionally, the US has been governed by policies very different than these.
Current deficit numbers also show Liberal spending habits -- A conservative budget wouldn't bring huge tax cuts while the debt was growing at a record rate.
Oddly enough, when the Republicans did try to balance the budget, they did so in what could be considered a very Liberal way -- they slashed funding to the troops in the middle of a war. Granted, they still obtained a 27% increase overall, but only Transportation and the Treasury had their funding cut to pre-2003 levels, where the majority had about an 8% increase, while some non-military areas, such as labour, had 50-60% increases.source.
So I have to ask; why do you support the republicans? Is it because of their stated right wing conservative agenda, or their real record of radically left wing decisions around what can only be described as a Liberal budget? -

The discussion here is not pissed off enough! Is it because of that bit by the lawyer in the article? Who cares if they have made this search legal.. it should be illegal. Shure, the feds have been doing related things to all sorts of non-electronics type people for a while now, but we should still be pissed off!
If this was an article about a company messing with someone there would have been 50 posts talking about was to help get them to stop. I have not seen ONE such post about this article. We should be fucking slashdoting the agency that did this with complaints!

What else can we do? What is the most effective way to slashdot these people. It seems we first need to know who they are, but I have not seen any information posted about exactly which parts of the Dept. of Justic / FBI were involved in this. We should start a web site to collect the names of the agents and officials involved in this.. to make shure that their crimes are not forgoten.. and that they are remembered as the tyrants which they are. I would love to hear from people about the preacticality / legality of such a site.
Thomas Jefferson said "The tree of liberty must be refreshed from time to time with the blood of tyrants" and I think it is time to spill the blood of these specific tyrants the slashdot style.

When will enough be enough?
Our government first broke the constitution when it started printing money, and again when they delegated part of their duties to a seperate organization.
They have suppressed cold fusion.
They pay 21$ for a bedpan worth 25 cents. All in the spirit of making a few companies happy. They waste money on frivillous bunkers. All the while, they stiff their school systems, their future, out of needed money.
They set up supersecret sigint stations. We heard of them, but how many of you heard a damn thing about them in the real world press?
They imprison us without trial, they obliterate our rights on a daily bases, they spend money to make sure that they stay in power, they make sure the rich get richer. All in the name of our safety.
My question is, when will it be enough?. We are the largest collection of brains ever assembled on this earth. Yet, we do nothing. We watch our rights be trampled. When is the point at wich you are willing to say, "No, you can not do that to me."?
Yes this rediculous thing will pass, but it is scary enough that 53? people got together and 47 decided that this would be a good idea. Why do we continue to let the idiots run the government? I laughed as I've seen governers say that they are waiting for the "virus thing" to come out that will fix the y2k bug. I laughed when I learned that New Jersey, a heavily idustrialized state, has the third lowest school budgit in the country, yet their governer has the highest salary of any governer. The only states that beat out New Jersey are Alaska with their one highschool, and some state out in the midwest.
