Re:Huh?
Same reason there's no direct flights to Cuba. If Gary is found to be owing a bazillionty dollars to the MPAA and doesn't pay then TSA cavity searches will be the least of his concerns next time he crosses the border.
Is this based on anything other than hyperbole?
You're confusing civil judgments with criminal matters. If the MPAA sues (and subsequently wins a judgment against) the ISOHunt principals, they will simply owe them a debt. If there are assets belonging to them in the US, MPAA can petition the courts to have these assets seized/liquidated.
People are not arrested in the US for owing a debt. See: untold number of spammers who owe Facebook, MySpace, et al. billions.

Re:Tricky lawyers...
Seriously, though, no court will enforce a contract that is changed unilaterally.
How I wish that were true. The Rogers Cable agreement contains a "we can change it whenever we want" clause and it was challenged and upheld.Kanitz v. Rogers Cable, Inc., OJ 665 (Ontario Super. Ct., 2002). A Canadian court upheld the validity of an amended clickwrap agreement. Rogers Cable amended its user agreement to include an arbitration clause. The originl agreement allowed for amendment provided Rogers gave notice to its customers by posting it on the website, via email, or by post. Furthermore, the agreement stated that continued use of the service following the notice constituted acceptance of the amended agreement. Rogers added the arbitration clause and posted the notice on its customer support webpage. The court held that Rogers had provided its customers with sufficient notice and that the plaintiff customers had accepted the agreement by their continued use of the service.
- Give away product with EULA that states you can change the EULA at any time
- Give away lots of this product.
- Alter agreement to turn over title of users house to yourself
...begin suing for title- PROFIT!

Not the weirdestThere was a case in Texas, where building codes were copyrighted. In Veeck v. Southern Building Code Congress Int'l Inc., No. 99-40632 (5th Cir. 2002) the 5th circuit found that once the law was enacted, that the law once enacted became public domain.
Or it took an appeals court to rule that a cow is not a motor vehicle. -
Re:Way overpriced
Actually all this hacking and losing of data has been happening for quite some time. We are just now hearing about it more because California passed a law requiring people to be notified of data loss.
In this case, the lost cargo is probably in a UPS warehouse somewhere. They probably ran over the cargo with a forklift, and it's currently unidentifiable.
See http://www.perkinscoie.com/content/ren/updates/eco mm/062703.htm for more info on the CA law. -

Unfortunate Precedent: Rambus & JEDECI would like to say that this has no chance of suceeding, but unfotunately there's already one example of a company (Rambus) having their people attending a standards committee (JEDEC) in public while working to patent the same technologies in private. And they almost got away with it.

Ob. Out the moron lawyer post...OK, this is the obligatory out-the-lawyer post: The gutter crawling ambulance chaser in this case is one Melissa Morgan Nelson, an associate (is that like office junior?) at Perkins Cole's Seattle office. Her telephone number is +1 (206) 359-3792, and her fax number is +1 (206) 359-9000. If you prefer email, we have that right here: MNelson@perkinscoie.com, and if you have an appointment to see her then you should turn up at 1201 Third Avenue, Suite 4800, Seattle, WA 98101-3099.
Of course, one look at her picture will unearth the real reason for her going after SuicideGirls. She's Unattractive, dowdy, downright ugly even! ie: She's jealous. Ugly girls always hate the pretty ones.

Re:Same John Ellis?
Don't look at me. Around Seattle when people hear the name John Ellis they think of this John Ellis, who was chairman of the board of Puget Sound Power and Light but is most recently known as the chairman and CEO of the Seattle Mariners baseball team.
And yes, I figured out fairly early on that this was a different John Ellis, although I had to admit to a bit of mental whiplash when I first saw the name. -
Not as good as a lawyer but....
When I'm doing legal research, my first stop is Perkins Coie LLP's Internet Case Law digest. In this case, you should probably look under defamation.
