For one, much of the content is put up by the owners (go read some of the ones where the enforcement arms take down stuff properly uploaded by the marketing arms of the same company).

Any popular distribution mechanism has content put up by the owners, including TPB (see http://www.promobay.org/).
But that wasn't the type of content implied in the post, which was taking about full movies. I've never seen a non-CC licensed or out-of-copyright movie legally available on Youtube.

For another, nobody is at risk of penalty for watching a youtube video.

Which doesn't make it legal.

I get 'Error - Site blocked' and I'm in Sydney.

I can see http://thepromobay.co.uk/ and http://promobay.org/ in Victoria.

I take it you're going to http://thepromobay.co.uk/ not http://promobay.org/

The latter being the legitimate site that is illegitimately blocked, the former being what appears to be a proxy to thepiratebay. Given that fact it is entirely imaginable that they meant to block the .co.uk site not the other one. It's also entirely imaginable that they did it maliciously. Give em a few days and I'm sure we'll find out which it is. Take a guess which one will actually surprise me.

promobay.org is blocked, but if I google it the top result is thepromobay.co.uk which is unblocked. No idea if these are the same site or run by the same ppl.

Confusingly, there seem to be two sites out there called "The Promo Bay". This one works: http://thepromobay.co.uk/ [thepromobay.co.uk]

This one, for me, is blocked: http://promobay.org/ [promobay.org]

The latter is the one we're talking about, I think.
