A 17-Year-Old Has Become Michigan's Leading Right To Repair Advocate (vice.com)
An anonymous reader quotes a report from Motherboard: Surya Raghavendran of Ann Arbor, Michigan isn't your average 17-year-old. Not only does the high school senior run a small business repairing iPhones when he's not in class, but he's raising awareness about people's right to fix their own devices without paying companies like Apple exorbitant fees. "People should be able to choose where they want to get their devices repaired," Raghavendran told me over the phone. "Right to repair will decrease the amount of e-waste and people will retain their devices much longer with suitable repair networks." Raghavendran is doing more than just talking about right to repair, he's become one of the leading advocates for a right to repair law in the state by pushing his lawmakers to introduce legislation that would protect a consumer's right to repair.
Raghavendran started researching the laws around repairing electronics, and he joined up with Environment Michigan -- an environmental activist group -- and started going to Lansing, the state capitol, to ask politicians what they were doing to protect people's right to repair their own devices. Raghavendran sent an email to state senator Rebekah Warren who called him in for a meeting and told him to start a petition. Since July, he's been asking for stories from the public about why the right to repair is important. The right to repair fight is happening all across the country at the local level and Raghavendran's petition has drawn support from people like like Nathan Proctor, the Director of the Campaign for the Right to Repair at US PIRG. Repair.org, a group pushing for right to repair laws all over the country, has draft legislation it wants to get in front of Michigan's state legislature. Proctor has been working with Raghavendran, Environment Michigan, and Michigan legislators to draft right to repair legislation. Proctor wants to pass a right to repair bill that is similar to the one passed in Massachusetts that forced automotive companies to share diagnostic information with third party repair shops. The law passed in 2012 "set a precedent and the industry rolled out the changes nationally," reports Motherboard. -
Why We Must Fight For the Right To Repair Our Electronics (ieee.org)
Kyle Wiens and Gay Gordon-Byrne explain via IEEE Spectrum how people in the United States can preserve their right to repair electronics, and why people must fight for the right in the first place. Here's an excerpt from their report: So how can people in the United States preserve their right to repair electronics? The answer is now apparent: through right-to-repair legislation enacted at the state level. Popular support on this issue has been clear since 2012, when 86 percent of the voters in Massachusetts endorsed a ballot initiative that would "[require] motor vehicle manufacturers to allow vehicle owners and independent repair facilities in Massachusetts to have access to the same vehicle diagnostic and repair information made available to the manufacturers' Massachusetts dealers and authorized repair facilities." Carmakers howled in protest, but after the law passed, they decided not to fight independent repair. Indeed, in January 2014 they entered into a national memorandum of understanding [PDF], voluntarily extending the terms of the Massachusetts law to the entire country. The commercial vehicle industry followed suit in October 2015. Now we need right-to-repair legislation for other kinds of equipment, too, particularly electronic equipment, which is the focus of "digital right to repair" initiatives in many states.
Similar to the Massachusetts legislation for automobiles, these digital-right-to-repair proposals would require manufacturers to provide access to service documentation, tools, firmware, and diagnostic programs. They also would require manufacturers to sell replacement parts to consumers and independent repair facilities at reasonable prices. The bills introduced this year in a dozen states have some variations. The ones in Kansas and Wyoming, for example, are limited to farm equipment. The one most likely to be adopted soon is in Massachusetts, which seeks to outlaw the monopoly on repair parts and information within the state. If it passes, electronics manufacturers will probably change their practices nationwide. Consumers would then have more choices when something breaks. The next time your smartphone screen cracks, your microwave oven gets busted, or your TV dies, you may be able to get it fixed quickly, affordably, and fairly. And you, not the manufacturer, would decide where your equipment is repaired: at home, with the manufacturer, or at a local repair shop that you trust. -
EU Prepares 'Right To Repair' Legislation To Fight Short Product Lifespans (bleepingcomputer.com)
An anonymous reader writes: The EU is preparing legislation that would legalize a customer's "right to repair," and would force vendors to design products for longer life and easier maintenance, in an effort to combat electronic waste and abusive practices like manufacturers legally preventing users from repairing their devices. The legislation is in its earlier stages of public discussion, but it already has the backing of several EU Members of Parliament, along with support from organizations like Greenpeace.
Currently, in the US only eleven states have similar laws, and they have been adopted after years of public discussions, and only for certain markets, and not for all types of products. It is unclear what leverage the EU will use to force manufacturers to produce longer lasting products, as this would mean lesser profits for big businesses, who often used tactics such as software DRMs, warranty contract lock-ins, and soldering components together, just to avoid users repairing products on their own. -
The Right To Repair Movement Is Forcing Apple To Change (vice.com)
The executive director of Repair.org says Apple has "decided to be nicer to consumers in order to stop them from demanding their right to repair," according to Motherboard. In the last few months, Apple has made political, design, and customer service decisions that suggest the right to repair movement is having a real impact on the company's operations...
Apple has repeatedly made small concessions to its customers on the issues that Repair.org and the larger repair community have decided to highlight. The question is whether these concessions are going to be enough to satiate customers who want their devices to be easily repairable and upgradable, and whether the right to repair movement can convince those people to continue demanding fair treatment.
The article notes that at least 12 U.S. states are still considering "fair repair" laws, which would force Apple to sell replacement parts to both independent repair shops and the general public. -
American Farmers Are Still Fighting Tractor Software Locks (npr.org)
Manufacturers lock consumers into restrictive "user agreements," and inside "there's things like you won't open the case, you won't repair," complains a U.S. advocacy group called The Repair Association. But now the issue is getting some more attention in the American press. An anonymous reader quotes NPR: Modern tractors, essentially, have two keys to make the engine work. One key starts the engine. But because today's tractors are high-tech machines that can steer themselves by GPS, you also need a software key -- to fix the programs that make a tractor run properly. And farmers don't get that key.
"You're paying for the metal but the electronic parts technically you don't own it. They do," says Kyle Schwarting, who plants and harvests fields in southeast Nebraska... "Maybe a gasket or something you can fix, but everything else is computer controlled and so if it breaks down I'm really in a bad spot," Schwarting says. He has to call the dealer. Only dealerships have the software to make those parts work, and it costs hundreds of dollars just to get a service call. Schwarting worries about being broken down in a field, waiting for a dealer to show up with a software key.
The article points out that equipment dealers are using those expensive repair calls to offset slumping tractor sales. But it also reports that eight U.S. states, including Nebraska, Illinois and New York, are still considering bills requiring manufacturers to sell repair software, adding that after Massachusetts passed a similar lar, "car makers started selling repair software." -
Three States Propose DMCA-Countering 'Right To Repair' Laws (ifixit.org)
Automakers are using the Digital Millennium Copyright Act to shut down tools used by car mechanics -- but three states are trying to stop them. An anonymous reader quotes IFixIt.Org: in 2014, Ford sued Autel for making a tool that diagnoses car trouble and tells you what part fixes it. Autel decrypted a list of Ford car parts, which wound up in their diagnostic tool. Ford claimed that the parts list was protected under copyright (even though data isn't creative work) -- and cracking the encryption violated the DMCA. The case is still making its way through the courts. But this much is clear: Ford didn't like Autel's competing tool, and they don't mind wielding the DMCA to shut the company down...
Thankfully, voters are stepping up to protect American jobs. Just last week, at the behest of constituents, three states -- Nebraska, Minnesota, and New York -- introduced Right to Repair legislation (more states will follow). These 'Fair Repair' laws would require manufacturers to provide service information and sell repair parts to owners and independent repair shops.
Activist groups like the EFF and Repair.org want to "ensure that repair people aren't marked as criminals under the DMCA," according to the site, arguing that we're heading towards a future with many more gadgets to fix. "But we'll have to fix copyright law first."
