The FOIA that we all know and love is a federal law that applies to federal agencies. West Virginia, like most states, has their own public records law that applies to their state agencies which you'll need to read to know whether they're in violation. Maybe they're claiming exemption #13:

(13) Computing, telecommunications and network security records, passwords, security codes or programs used to respond to or plan against acts of terrorism which may be the subject of a terrorist act;

That was the code section of WV law that the auditor's office is recommending the Purchasing Division look into.

I don't believe the assessor can reasonably claim financial damage... generally copying fees are limited to nominal processing costs, or a close approximation thereof, and only in a few cases around the country have I ever heard of a government treating copying fees as a profit center... and those were only for specialized documents such as police reports being furnished to an insurance company.

This is such a backwards way of thinking. I work for a software company that is involved in document management, and everywhere we look, cities, counties, and states are looking to pass the savings on to their citizens, not trying to nickel and dime their way into mediocrity. The tax assessor's office's budget can always be fixed if they truly are relying on those $20 fees. Even those organizations that do make some money off supplying documents are constantly trying to improve access and let people access documents online and so on.

Ahhh, I'm glad you mention that. This link has a State of Virginia Supreme Court decision that addresses at least the speech part. Apparantly, it is held that the proscription is against the behavior of wearing the mask, not the speech or assembly done while wearing the mask. I guess the thinking is along the lines of: inciting a riot may require assembly, but free assembly does not depend on the right to start riots, so riot-starting can be legislated against.

I don't believe that the US Supreme Court has ruled on these laws, since so many of them remain. This is odd, since many seem to date from the Klan era of reconstruction to depression. The ACLU has a press release about a Federal lawsuit involving a Detroit anti-mask law. And you know they're just dying to get to the Supreme Court.

Neither ABCNews nor the Slashdot write-up seem to link to the actual Privacy International site or their 2001 US Big Brother Awards page.

Also, the ABCNews article and Slashdot write-up dwell entirely on the privacy violators, while the original site also mentions that

2 awards were also given to champions of privacy. The Brandeis Award is named after US Supreme Court Justice Louis Brandeis, who described privacy as "the right to be left alone." The awards are given to those have done exemplary work to protect and champion privacy.

Evan Hendricks - 20 years of publishing the Privacy Times. Hendricks goes after companies that traffic in children's private data and tells Congress how important privacy is, since they don't seem to get it most of the time.
Julie Brill - Vermont Attorney General's Office. Brill spearheaded Vermont's litigation against the tobacco companies, and she goes after banks you sell your private data, record companies that fix prices, and drug companies that try to stamp out generics.

These are the good guys (and girls). They deserve some recognition, too.
