Same thing happens here in Australia. Even though we have a similar law to the DMCA (forget what it's called), no-one seems to have gone after google using it, so xenu.net still appears at #1.

Re:Google DIDN'T pull the pagesThe only problem is that the owner of Xenu.net isn't an American. He could submit a counter-claim, but that would mean that he would be putting himself under an American court. Since $cientology will spend millions to ruin a single critic, dragging him into a pointless expensive court case in another country would be perfect for them.
$cientology has blustered about suing Andreas Heldal-Lund for years, but has never dared do in Norway. So now they're going after the "weakest link" of American Google with that idiotic DMCA.

Nope, if you'll take a CLOSER look at the results from that quere, you will see that ALL of the results are from xenu.net. That's because the first part of the search, "site:xenu.net" tells google to ONLY return results that are within the "xenu.net" domain. It has absolutely nothing to do with your geographic location.

Hmm. I have read a search for "site:xenu.net scientology" links to the takedown letters. When I try this search, the first hit is www.xenu.net. I wonder if this is because I am redirected to www.google.ca? Anybody have any idea if a search coming from Canada acts differently than a search coming from the US?

I believe it is a clear cut issue and that the scientologists are fully within their rights to disallow google to allow people to link to this illegal page. However also keep in mind that scientology didn't enact this security measure, Xenu did, therefore scientology is also in violation of this law. Now if only Xenu can break free of his volcano, come to Earth, and sue the scientologists ... -

Attention DMCA lawyers: Try to remove a web site from Google's index and you'll probably just make it more popular.
In an apparent response to criticism of its handling of a threatening letter from a Church of Scientology lawyer, the popular search engine Google has begun to make so-called "takedown" letters public. DMCA-censored pages are now two clicks and a cut-and-paste away from the regular search results.
The full text of two new letters to Google, dated April 9 and 10, already appears on the free speech site chillingeffects.org. "I think it's great that they're calling attention to the way the takedown provision can be used to compromise their search results," said Wendy Seltzer, Fellow of Berkman Center for Internet & Society at Harvard Law School and co-founder of chillngeffects.org.
Google is still choosing to take advantage of the Safe Harbor provision of the Digital Millennium Copyright Act, which allows web sites to escape liability for copyright infringement if they take pages down in response to properly formed letters.
In a controversial move last month, Google pulled all pages from the anti-Scientology site xenu.net then restored the site's home page amid Internet outcry, just as Linux Journal readers were on their way to visit Google in person to ask for help finding censored pages about the alien warlord Xenu who is a key figure in Scientology's creation legend.
Only the name and telephone number of the attorney who wrote the letters have been removed from the copies on chillingeffects.org. Both of the new letters originate from the Los Angeles law firm of Moxon & Kobrin, where attorney Helena Kobrin has long been Scientology's standard-bearer against church critics on the newsgroup alt.religion.scientology and other online fora. Kobrin was not immediately available for comment
The letters are also linked to directly from Google search results. When results would have included a DMCA-censored page, the results page now includes a link to the takedown letter that resulted in the page being removed. A search this morning for site:xenu.net scientology produced the message:
"In response to a complaint we received under the Digital Millennium Copyright Act, we have removed 8 result(s) from this page. If you wish, you may read the DMCA complaint for these removed results."
Failing to act in response to a DMCA takedown letter is not against the law. "They can always choose not to take advantage of the safe harbor," Seltzer said. However, only by complying with the letter and taking pages out of their index can Google escape a possible copyright infringement lawsuit.
Finally, Google has expanded its DMCA page to include instructions for Counter Notification under the DMCA. A webmaster who believes that a non-infringing page is being unfairly censored can write the proper legal incantations and have the page put back into the index.
Google is then required to forward this Counter Notification to the original notifier, and then put the page back in the index "not less than 10 or more than 14" days after Google receives the Counter Notification. If your site is pulled out of Google and you're confused, chillingeffects.org has a web form that will generate a correctly formed Counter Notification.

It's now number 2 in the rankings which is 3 spots higher than a few weeks ago so perhaps this small form of protest is also working! -

Far better to depend on cookbook chemistry. (What, your shelter doesn't have ammonia and iodine? Didn't you read Farnham's Freehold?) If all else fails, use Tom Cruise missles.

CSS != Copy protection
This article says that DeCSS somehow gets around the copy protection embedded into DVD's. As I'm sure most of you know, this isn't technically true. The purpose of CSS is not copy protection but content control. CSS allows movie studios to decide when, where, and by whom the DVD is viewed. Lets say you're in Europe and you'd like to watch a DVD that has just been released in the states. Under the ordinary laws of commerce if you've got the money to buy that DVD then you get to watch it. Not so with CSS. Now movie studios have the ability to pick and choose which titles get released in which region at which price. Lets say there is a title that the powers that be in your country have banned because they don't like it. CSS gives the MPAA the perfect means by which to implement and support this oppression by foreign governments. None of this is right or just. The idea behind copyright is to give producers of works certain rights and protections to encourage the creation of art and knowledge. Unfortunately with things like the DMCA and CSS, non-producers such as the MPAA are perverting the concept of copyright. Where traditionally copyright has been used to define when, where, and by whom a particular work is COPIED, it is now being used to control where, when and by whom a particular work is viewed, read, seen, or otherwise utilized.
Imagine if there was CSS for books and in order to read a particular book you had to live in the right country, be of the correct race or social group, and pay a surcharge to the book cartel every time you wanted to read it. As it stands now books are independent entities. Once a publisher prints a book and sells it, that publisher has no control over what is done with that book other than a legal right to control whether it or portions of it are copied or used in other works. You can read this book, then give it to your friend to read. The publisher can't come have you and your friend arrested because he hadn't paid for the "right" to read that book. You can smuggle books that are unpopular with an oppressive regime into that country and the words will still be legible.
The problem with CSS is not that it is a copy protection scheme, but that it is a scheme to control who uses the DVD, which has nothing to do with copy protection or copyright.
If I remember right a group of video pirates were busted here not too long ago for copying DVD's. What I heard about that case is that they were copying the entire DVD bit-for-bit whether it employed CSS or not. The copied DVD's were still encoded using CSS. So what possible use is it as a copy control scheme? None of course, but its very useful for controlling which people get to watch the DVD.
Another group that is trying to pervert copyright into content control is the "church" of scientology. They employ copyright and trade secret law in order to try and prevent anyone from knowing the truth about their "religion." The truth is that scientology is nothing more than a highly successful scam that robs people of their money, enslaves many in the "Sea Org," and destroys families by forcing those in the cult to "disconnect" from relatives who are critical. Their abuse of the legal system is legendary. Their policy of filing suits for harassment value alone is such that I'm amazed their lawyers havent' been disbarred by now. The organization's sole purpose is to sucker people out of their money that is then passed "uplines" to the likes of David Miscavige. Their use of front groups and interlocking corporations to facilitate the laundering of this money would make John Gotti weep. The Xenu leaflet was written by Roland Rashleigh-Berry, a regular poster to the newsgroup alt.religion.scientology. He has assured people that the information in the leaflet is correct. He is an ex-Scientologist and although he never did the course to which the leaflet refers (he left in discust when he discovered the material) he is a scholar of the subject and has easy access to the confidential materials of the Church of Scientology and the materials that form the basis of the leaflet. Roland has listened to the tape "Assists" many times and this tape is the source of most of the material of the Xenu leaflet. The transcript of that tape is also here at Operation Clambake, and he has assured us all of its accuracy. Roland is well aware that the Xenu leaflet is a powerful weapon against the Church of Scientology and that attempts will be made at some future date to gain control of the Copyright of the leaflet in order to stifle its distribution. To that end he donated the Copyright irreversibly to the International public domain. He now no longer owns it nor can he ever claim exclusive ownership of it. The leaflet now belongs to everybody and can be copied freely without permission. His wish is that it be used to expose the Church of Scientology wherever they may be, hence his push to have the leaflet translated into as many languages as possible. I've been to Catholic mass probably 2000 times (nearly all in Illinois; perhaps practices are different elsewhere). One could contribute anonymously, but all regular parisioners had personalized contribution envelopes, with the expected contribution explicitly based on income. I found this strange, and remember asking my parents what business the priest had knowing their contribution or income. I didn't get a satisfactory answer to this or any other religious question. Per-adherent the contemporary Catholic church is less evil than Scientology, though I'd probably feel differently had I been raped by a priestly pedophile.

If Google can be held liable under the DMCA for it's content, then so can AOL.

How to Fight Scientology
The Scientology cult has made systematic attempts at removing any links to negative websites -- both by creating a large collection of interlinked websites of their own (thereby raising their own propaganda sites in the rankings), and when that wasn't sufficient -- legal threats.
Slashdot participants are in a unique position here to turn the tables on the cult by adding a link to http://www.xenu.net to all the websites we run. If enough of us link to www.xenu.net, we can make it the #1 resource for information about Scientology! (remember that Google's cache uses the number of referring websites to determine the ranking of listings in search results).

apart from being dead, he was never that smart. sure he managed to brain-wash lots of people, but, really the guy had very little clue. He wasa complete shithouse writer (try reading battlefield earth, it sucks).
He was looked down on by his contemporaries (like Alistair Crowley, who he wished he could be on par with). His first attempts at starting a cult ended in distater, when his followers realised he was completely full of BS.
The only reason that scientology works, is becasue they brainwash people. This was probably the only smart thing that he did. The whole system is set up to make you completely dependant on the cult and completely alienated from the reast of the world. This is one of the reasons they are so agressive. Hubbard actualy sais never defend, always attack. This ensures that the members are always opposed to anyone with conflicting thoughts. As soon as scientolgy is criticised, they are programed to leap into a strong attack againts the critic. This prevents them ever actually listening to and considering arguments against the cult.
Its one enormous scam and every single aspect of it is designed to alienate the followers. This does not make Hubbard smart. It makes him a god damned evil meglomaniac bastard. Read anything other than scientologist propaganda, and you will see that this is trully an evil cult. I recomend you read some of the info at xenu.net. Its eye opening to say the least.

Petition for DOJ InvestigationYay! Glad that Google re-listed Operation Clambake. If there is any site that deserves to stay listed despite the DMCA, this is it. However, I still feel that the DOJ really should look into Scientology's actions, many of which are downright illegal. I actually made a post regarding this in the other forum, but here it is again because this issue's too important... SIGN THE PETITION!

However I couldn't help but wonder... who leaked the news to the media? If it was Google who informed the media about this while complying with the law, then I must admit it's a nice way to stir up the controversy and to inform people who/what Scientologists are really like.
