Sklyarov Bail Hearing Monday

mr_don't writes: "I just saw that the Electronic Frontier Foundation has just posted an Action Alert entitled "What YOU Can Do To Help Set Dmitry Sklyarov Free" ... Around 11am on August 6, 2001, at the San Jose Federal Building, Dmitry is set to have another bail hearing in front of Magistrate Judge Edward A. Infante. Protests are planned to coincide with the hearing. I hope as many people as possible can come to the demonstration... Help the EFF pack the courtroom during the hearing." A short article in the Mercury News mentions the hearing too, as well as the half-million dollar, five-year penalty that could be imposed.

    Cars are not designed with the express purpose of breaking the law.

    His software WAS designed PURELY to do something illegal.

    While I'm sure that the protest will generate all kinds of warm and fuzzy feelings in the radical /. camps, I fail to see how they will get any attention other than "Hey, look at all the nerds." The bulk of the population still does not understand the issues involved and will just write the whole thing off as "another protest, but these ones dress funny." Marches, chants and signs? Most of the press doesn't 'get it' and will only cover it if

    1. someone does something icredibly stupid (therefore newsworthy), or
    2. someone can actually get the point across that the DMCA is a horrible piece of legislation.
    But c'mon - a protest? I would have expected something a little more creative from the /. commnunity.

    As far as the general population is concerned, the case involves a "Russian hacker". That's all they need to know and they will tune in to the new and improved CNN for the sentencing details and patiently await the feature-length movie or game-show style punishment.

    He broke the law. If you want to change the law, lobby Congress. A bunch of rich geek college kids showing up at the courtroom and disturbing the peace is not how you get your way. Letting criminals free, regardless of what the EFF and Adobe want, is not how you make a lasting impression on the DMCA.

    BTW, Do you think that the EFF would stick up for your criminal ass if you were violated the DMCA? I didn't think so. Think you'd make the front page of ./ or even YRO? Think again.

    This person got arrested for making software thats purpose was to break copyrighted material. He also has developed spamware.

    The point, my friend, is that he wrote a program to enable other people to use something they hadn't paid for.

    He broke the law AND he profited from it by selling the software making it easier for people to steal.

    I know you "nerds" don't like to hear it, but it's the truth. The DMCA is a good law created to protect intellectual property. You folks need to quit whining about it because IT'S NOT YOUR PROPERTY! License agreements need to be respected or you will run afoul of the law. Want to "reverse engineer" or "hack?" Then be prepared for the law to come down on you and for you to be fined, forfeit your property, and be carted off to prison. Let me reiterate... it's not your property... DO NOT MESS WITH IT. Usage is governed by the license agreement which you must follow to the letter or not use it. Don't expect to see the DMCA vanishing anytime soon either. You won't be able to stop it and it is, despite your lunatic ramblings, completely Constitutional. The government has the right to regulate "free speech" and discussions of circumvention of technological measures is dangerous speech and needs curtailed. Besides, the DMCA is fair. It's much needed today to put an end to rampant piracy. Face it, DeCSS, CPHack, SDMI crack papers, eBook crackers, etc are made solely for piracy of very valuable intellectual property. If it's not your property then you cannot do whatever you wish with it. DVDs, software, etc are NOT your property regardless of how much you paid at the store. It's governed under a license agreement which must always be followed.

    Now, with regard to this Sklyarov character, he deserves to be locked up and fined to the maximum extent of the law. Criminals deserve prison time and fines. We need to get tough on crime and DMCA violators are criminals. He will be going to prison and your pathetic attempts to stop it will just be a laugh to the government. Grow up and quit defending criminals!
