Microsoft has had their share of serious bugs but there are many professional software companies with very good trackrecords.

So if I spend five years of research to develop a truly unique type of software that does something big-corp should be able to high-jack it however they like to?

Lets say I develop a revolutionary picture format way better than jpeg. Say you can't implement it by accident (suggesting the patent isn't to broad) but it's a pricice patent for this specific thing. Microsoft (for example) should be allowed to just copy it and through it into windows without paying the author?

This makes the small man totally powerless against the big companies out there. Not that I'm saying the current abuses in software patents in the US is a good thing but abandonment sounds very bad to me!
