Cringley on Microsoft and Linux

  3. Experts say case tilting in Bryant's favor by Anonymous Coward · · Score: -1, Offtopic

EAGLE, Colo. - Kobe Bryant's legal team blasted holes in the rape case against the NBA star, putting pressure on prosecutors to come back with strong evidence at trial, legal experts said Thursday.

Startling details about the sex life of Bryant's accuser and her actions on the day of the alleged rape, revealed in court this week, tilted the case in Bryant's favor, analysts said.

"The prosecution is going to have to pull off a huge comeback," said Craig Silverman, a former Denver prosecutor. "For them to win, this young woman is going to have to be the greatest witness imaginable. They would also need a semi-confession from Kobe."

But a confident Eagle County District Attorney Mark Hurlbert suggested that more evidence was coming. "No prosecutor puts on their whole case at preliminary hearing," he said.

Among the biggest weaknesses in the prosecution's case was the testimony of its key witness, Sheriff's Detective Doug Winters, experts said.

Winters said the 19-year-old front-desk clerk was excited to meet the L.A. Lakers guard and expected him to "put a move on her" when she used a "back way" to sneak up to his room on June 30.

Winters testified Oct. 9 that the woman repeatedly told Bryant to stop when he began groping her. But he acknowledged under defense questioning Wednesday that the woman did not immediately tell cops that she had told Bryant "no."

"There is something wrong when the prosecution's key witness becomes the defense's star witness," Pozner said.

Eagle County Judge Frederick Gannett will rule Monday whether there is probable cause to send Bryant to trial.

Experts say it is all but certain that Bryant, 25, will be ordered to stand trial. But less clear is which evidence the judge will allow prosecutors to use against him.

While the accuser's interview with Winters is fair game, analysts were split whether defense lawyers will be able to tell jurors that the panties the accuser wore on the day of the alleged attack contained semen and pubic hair from a man other than Bryant.

Colorado's tough rape-shield law bars lawyers from delving into an alleged victim's sexual past. But some defense lawyers said Bryant's lawyers may be allowed to use the underwear to cast doubt on the woman's vaginal injuries.
