China Calls For Release of Arrested Huawei CFO Detained In Canada (nbcnews.com)

China is demanding the release of a senior executive at Huawei after she was detained in Canada on extradition charges to the U.S. Wanzhou Meng, who is also the deputy chair of Huawei's board and the daughter of company founder Ren Zhengfei, is suspected of violating U.S. trade sanctions against Iran. NBC News reports: The arrest of Meng Wanzhou, chief financial officer and daughter of the company's founder Ren Zhengfei, spooked investors with U.S. stocks tumbling on fears of a flare-up in Chinese-U.S. tensions. She was arrested in Vancouver, British Columbia, on Dec. 1. China's Ministry of Foreign Affairs said officials have been contacted both in the U.S. and Canada to demand Meng's release. Geng Shuang, a spokesman for the ministry, said her detention needed to be explained, and both countries had to "effectively protect the legitimate rights and interests of the person concerned." A spokesperson for Huawei said in a statement that it "complies with all applicable laws and regulations where it operates, including applicable export control and sanction laws and regulations."

      I can't speak about Korea, but I do know that the only reason we pulled out of Vietnam is that the anti-war movement persuaded Congress that we couldn't win. Both Tet and the Easter offensive were absolute disasters for the Viet Cong and the NVA, respectively.

      That's an interesting point of view, albeit one that we have heard before. The Japanese thought that the United States was a nation of playboys and pleasure seekers who would never be able to muster the will to oppose their bushido spirit. The Germans also thought of Americans as soft and not able to match their master race, hardened by years of dictatorship and confident in their own supposedly superior abilities. You will recall from your history books that both Germany and Japan underestimated the United States and ultimately surrendered to her unconditionally to avoid total annihilation in World War II. If the Chinese attack, they can expect a unified and powerful enemy in the United States. The Japanese won a major victory in their opening surprise attack on Pearl Harbor at the beginning of World War II and yet they went on to lose the war in spectacular fashion to the unstoppable industrial might of the United States. We did it once and we can do it again and I suspect that just like last time there will be no shortage of young American men perfectly willing to kill as many Chinese as necessary to secure that victory. Of this there should be no doubt in the minds of our enemies, none whatsoever.

      Chinese military hardware is still inferior to American kit. We have better ships, fighters, bombers, submarines, fighting vehicles, long range missiles, short range missiles and more of all of them. The only thing that the Chinese have more of than us is manpower, but their soldiers are poorly equipped compared to American soldiers. The average Chinese soldier has no mechanized transport, no body armor, no thermal or night vision, less firepower and less combat experience than the average American soldier. Not only that, but the Chinese have no blue water navy capability and thus no way to prevent the United States from projecting naval and air power right onto their coastal waters. The Chinese believe that they can prevent this with a ballistic missile force, but that's incorrect. There is no substitute for blue water naval power. Every nation in all of human history that has tried to cheap out on naval defense has been unsuccessful in denying access to their coastal waters in the face of superior enemy naval forces. From that position of strength, the United States begin a strategic bombing campaign on the Chinese mainland to destroy Chinese industry, power plants, water treatment plants, food production, oil and gas facilities, military installations, etc. What might be the effect all of the water behind the three gorges damn being suddenly released because the dam was breached? The Chinese would lose a war against the United States today and in the foreseeable future. They know it and we know it which is why it's not going to happen.

Thus the ICC is located in the Hague, because they can use universal jurisdiction over war crimes to try African dictators (it's always Africans, because globalism with a patina of justice is the new colonialism). The Spanish tried a member of a former Argentinian government on charges of genocide, and the Argentinians lately were looking into indicting MbS over what he did to a Saudi citizen on Saudi soil (a consulate), which would be the internal affair of a sovereign nation. Universal jurisdiction is getting popular, despite its obvious violation of the principles of Westphalian sovereignty. If you can make the case that Iran commits human rights abuses in some form that resembles the hostis humani generis laws giving universal jurisdiction over pirates and torturers, then you could make the case that supporting Iran is a crime over which every nation has jurisdiction to prosecute.

      Huawei violated sanctions that China, Canada, and the US all agreed to and now a senior board member is being arrested for it. Basically, after years of people arguing that c-level execs and board members are getting away with all manner of crimes, the US buckled under the social pressure and put out an arrest warrant for Huawei's CFO and deputy chair.

      Don't let the sinophiles fool you. This is a wonderful turning point in America. Trump did promise to stand up to bankers and executives and it seems like he's finally starting to deliver.

    So now why is Huawei facing charges when ZTE's punishment was reversed by Trump? And even when ZTE was facing punishment, I don't think any ZTE executives had ever been criminally charged and detained.

    BTW, I am no fan of either ZTE or Huawei, and I would advise people to steer clear of Chinese phone companies in general.

    US Constitution Article II, Section 2 states plainly that the President has pardon power for any offense with the sole exception being cases of impeachment.

    Since at least Andrew Jackson in 1865, Presidents have use pardon prior to indictment to spare the country the turmoil of a controversial indictment and trial (in the case of a Confederate officer, for Jackson). The Supreme Court has upheld this repeatedly.

    Imagine you seen a sign saying "no parking on Sundays 9AM-11AM". By law that implies that parking is allowed any other time. (exceptio probat regulam, in casibus non exceptis).

    The Constitution is even more clear. It specifically says "all cases except impeachment". If it meant "all cases except impeachment and when AC doesn't like it", it would say that. It explicitly states the sole case in which the President does not have pardon power.

    The defendant isn't being impeached, so clearly the President absolutely has an unquestionable Constitutional right to pardon her. Whether or not he SHOULD is an entirely different question. His legal power to do so is very clearly stated in the supreme law of the land, the Constitution.

      It's not quite so open and shut. The President inarguably has the power to pardon. However, the President is arguably limited in his power to actually intervene in the investigation and prosecution of a crime. He is, after all, sworn to "“faithfully” execute the laws of the United States" (or, as it says in Article II, Section 3, "take care that the Laws be faithfully executed."). If and when someone is found guilty of a crime, then the power of the Presidential pardon can come into effect. But the Constitutional basis for stopping an investigation prior to a guilty verdict is on shaky ground.

      That said, many Presidents have wielded that power and stopped their attorney generals - members of the executive branch - from pursuing certain investigations or dropping lawsuits, nominally under the guise of setting priorities. This power is usually left unchallenged unless it is done for overtly political reasons. But a strong judicial challenge could be made that this would exceed the power invested in the President by the Constitution. So far, fortunately, there has never been an instance when the President has been so challenged.

      In this particular case, when an actual arrest has been made, it becomes increasingly difficult for a President to intervene as the case now falls far more under the Judicial branch's purview than the Executive's.

      So yes, the parent post was not as wrong as you imply; it would be improper and quite possibly illegal for Trump to intervene, at least at this point. After the case runs through the courts, then the President could use his power of pardon but acting before would likely create a Constitutional crisis of some sort.

      In order for a corporation to export certain sensitive US technologies legally they must sign an agreement to comply with trade sanctions, embargoes, and so on.

      The CFO of Huawai, the woman arrested, signed a form to that effect. The technology was allowed to leave the country under criminal penalty should the technology then be sold or given to Iran. There is evidence the CFO was involved in selling the technology to Iran for a substantial profit. Canada, just like every other member of NAFTA, enforces these sorts of agreements made with any other NAFTA member.

      The CFO signed a form saying "I won't do X or I will go to a US prison." Did X. Avoided the US, but did not realize Canada has a mutual treaty to enforce the deal.

    You say "arguably" - that was argued in 1865, and SCOTUS ruled that the Constitution means what it says. Most famously in the last fifty years, Ford pardoned Nixon, so the country could move forward from that mess - without an indictment or arrest.

      Not necessarily. That's only the default if the pardon doesn't speak to the issue. But it can, if he so chooses:

    In 1866, the question came up of whether a President can pardon someone who hasn't been charged. The answer was yes. SCOTUS ruled then, and a couple times since then. If you were paying attention in history class, you might recall most Americans were unhappy when President Ford pardoned Nixon, who hadn't been charged with anything.

    Bring Wanzhou Meng to trail in the US for violating the sanctions against Iran. The defense can just claim that the Iranian sanctions are illegal. The US has no grounds or evidence to impose them other than as an attempt to interfere with Iran's economy.     China doesn't have extradition agreements with the rest of the world, like the USA does. Plus the USA doesn't allow other countries to enforce their laws on US citizens, as much as possible. This allows the USA to enforce US law on most people. I remember, a few months ago, the USA demanding direct jurisdiction in New Zealand: NZ refused.
