I too was in that problem . . . I did some FLASH development for the company and in the contract that was signed it was understood that the product I delievered to them was the Flash (.SWF) file. This however did NOT include the code (.FLA) I was gonna get sued and the ad agency threatened me but I simply pulled out the contract that was signed and in it . . it said the product would be the (.SWF) file. So then I sold them the (.FLA) files, but they thought that in developing Flash content that everything belonged to them . . yeah yeah . . no way . ..so get them contracts signed ppl ! =)
Come on !! . ..SET UP . . or just a quick way of stopping the damage . . . what better way to say "We are on the ball" by arresting just SOMEONE very quickly to eliminate others from thinking they can get away with it . . . and do you really believe that they could track down where it originated (Hmmm ..did they write this or test this virus/t.h. on a Microsoft Machine ??) I wonder if Microsoft has a way of knowing this and giving authorities that information ..something to think about ..but it's toooooooo easy to spoof mail, fake mail and/or set someone up . ..and if they DID find the right person . . . I think this was reported to BugTraq and they were like "Oh, that's nothing not a problem" so . . Oh well . . I guess if it doesn't come from cDc (Cult of the Dead Cow) then it's not worth looking at . . .

That's what is so cool about Open Source, everyone gets to see what da hell is going on in the code under the hood . . . When we were developing Cytlok and working with VxD (Virtual Device Drivers) and wrapping around the File System and the TCP/IP stack . . . NOTHING is documented, you can't get it from Microsoft either!
That's what is so scary, and let's talk about Easter eggs, when you have a Flight Simulator in Excel, and a Pinball game in Word, when triggered by a sequence of keystrokes (which in definition is called a Trigger Virus technically), no telling what else there is !
Who knows what else is in there, a key sequence to delete all.dlls ? Delete all Word docs ? Transmit all excel files to ftp.microsoft.com ?
Is it probable, NO ..is it possible YES ! This is definately NOT FUNNY, but at least NOW we are talking about CLIENT/WORKSTATION security that has been LONG over looked.

Most patents are US patents . . to create an INTERNATIONAL patent that cost BIG BUCKS . . . yeah true there are companies that have that ..but SOME countries (like Mexico) really don't care about patent stuff . . .
If am a musical artist and wanted to release my music on mp3's, most contracts say the music belongs to the record company, ahhh ..not so, only if you got royaly screwed, there should be some legal mumble jumbo that says something about "up held by the US court of blah blah" . .
So . . I say ..if you have a problem with a company that has a patent on a particular thing, move to mexico for a few months ..kick back on Cancun and do what you want to . . host your mp3's from the beach ..set up your company in Canada and stuff . . there ARE ways of getting around this . . .
and if you want to "sell" stuff over the Internet easy. . .
Give out the KEY for free and post the item you want downloaded for free . ..and if anything . . you can just SELL the key . . that can be a disk you send the user . . . come on . . if AOL can give out tons of CDs . . why can't you buy a CD-KEY . ..too much of a hassle ..sell the key . ..so you aren't selling the actual DATA (music, video) you are selling the KEY . . the patent doesn't say that . . .
and if encryption laws come into play ..easy . . just use a PROPRIETARY form of compression that emulates encryption.
I dunno . . I just think this cannot possibly hold . . it's too ridiculous . . .
Patents were created to help the inventor get credit for his idea and not let big business screw him out of the credit and honor . . now it's about money.
Even then though it's not much use, I mean today in schools kids are taught that Marconi was the inventor of Radio, when actually Tesla invented it way before him. Does it matter ? . . no, but the patent that was filed help Tesla get his just honor and credit before the eyes of others.
But this is about MONEY not honor so I really don't care anymore . . .
