    The Appellate Courts have the right to do what they did. They aren't stepping out of line, only acting faster than what most people expected.

    Sorry, but Jackson's court isn't a court anymore. He is working on the side of the prosecution, its been obvious he's been biased all along. You cannot have justice when the court is biased.

    The party having no choice is the Appelate Court. I am very sure that they are just as disturbed by Jackson actions in regards to Justice's request.

    He //Jackson// even stated he was willing to do whatever they //Justice// wanted.

    That is not a Judge, thats a person with a chip on their shoudler.

    This verdict will get tossed, and it would be good if the Appelate court chastises Justice and Jackson for their behaviour. The worst being was their attempt to prevent Microsoft from having a stay on the penalties of the case while the appeal was heard. That is totally unheard of in law, a defendant is always allowed granted a "stay hearing" versus penalties while the main case is appealed. Justice knew that by kicking it to the Supreme Court that that court could not hear or would not be able to hear the case before October which meant the first phase of penalties from the case would be in effect.

    While I don't agree with Microsoft's behaviour, the Justice departments behaviour is far far worse. Apparently they believe that what they want is what they should get regardless of the law. They are playing Judge, jury, and executioner. How long before they try this versus individuals?

    Put it bluntly, if Microsoft did what Apple does, it would have been already been broken up by the Justice department.

    Oooh... we have a proprietary machine, that, wait, has to run a proprietary operating system.
    To top if off, every 6 to 9 months you have to upgrade your OS for 90 dollars.

    Hell, imagine the scream here and elsewhere if every 9 months to 1 year you had to pay microsoft for MINOR updates. (which is all the Mac OS ever gets... gee a better internet search engine and prettier graphics)

    Sorry Katz, you must own their stock. Apple is NOTHING special. They just simply use propoganda to keep the angst ridden hordes of users lined up at the support Jobs feeding bucket. (talk about numero uno exploiter - gets them to buy his half-assed next computer company for buku bucks... )

    Sorry, but their processors work just fine. The point being that integer crunching is not the focus of business machines, and never will be.

    Hence while IBM succeeds with in business all these other companies spout their "crunch" capability and wonder why business doesn't care.

    Sometimes its not how much you do, but what you do.

    Besides, if you want a reliable server you use an AS/400. (which has been 64bit for some time now - oh lest I forget - to go from 32bit to 64bit did not require rewrites on 99% of software???)

    Its already happened.

    A site dedicated to movies (movie buff?) was lost because another company came out with a product that was called Movie Buff. They demanded the web address and won in federal court.

    A web address does not have trademark or copyright protection, and yes, if someone comes out with a product using that name and you are not using it in for a business or other protected purpose you will lose the domain name.

    End of Story.

    Simple.. Cyber-Squatters are on the wrong side of case-law. If any big corporation whats their domain name that corporation only has to:

    1. Create a product with that name or catch phrase.
    2. Market it.
    3. Trademark the phrase
    4. Tell NSI to shut-down the offending name
    5. Go to court to and nail the cyber-squatter.

    I for one don't think people should be allowed to soak up domain names for profit. If they don't put a domain name to use they should lose it.

    "Pretty typical article" reads like a put down.

    However whats wrong with the article?

    If the Linux community truly wants to dethrone MS (which I doubt they do - its much easier to say they want to than actually do it) then they need to make the OS easier to install and easier to use.

    One of the most important resources in this day and age is time. The bulk of people won't waste their time playing with their OS, they just want to run their application.

    So unless it becomes easy to use/install there truly won't be an applications worth using... let alone people using the OS.

    NSI is wrong for moving an id without written approval of both parties. She is wrong because her site name can easily be construed as being part of AOL. It also does not break down from the site's long name as one would think it would.

    So sure her site may be okay, but her domain name should change. Now, should AOL give her some cash? No.

    Anyone stupid enough to register an domain name which is so similar to a big company deserves the grief. The only case that would deserve support is a big company changing a product or service just so they can justify taking the name.

    Must be the PC server market, and it must a real constrained set of rules you must fit in...

    Seems most of these experts forget about all the mini computers out there that perform server duties, and do them well.

    Microsoft is trying to position their NT software into the Enterprise category, it won't work there very well. Its hamstringed by the fact its being written as a single user product... iow - a product designed to run on a seperate pc....

    Any server product whose design includes being run on a singular machine won't make it to the enterprise level.

    There is nothing original about their cartoons, it was just an attempt to be offensive, and to do so by using a very popular comic strip.

    Since they were simply redoing the conversations they don't deserve the right of being a parody. If they had added their own interpetations of the drawings (as in drew the pictures themselves) then it would be okay...

    There is no way that the V2 produces images that look as good as the TNT or my G200.

    When it comes to multitexturing the multipass rendering suffers on the v2 because the blending is done AT 16 bit (go read their docs). This means that when layering images (to achieve certain textures and transparencies) the V2 falls way short in visual quality.

    I was considering buying a 3500 (I use an SLI rig) but not anymore. Glide is no longer worth the investment as good game designers realize writing for one driver is not beneficial to the bottom line.

    So you attack the developers of third party wrappers because YOU KNOW, YOU KNOW your upcoming product is INFERIOR to the competition in regards to visual quality.

    32 bit won, and your still playing in a 16 bit world, beating on people who can help promote Glide but instead you sick your 2 bit lawyers on them.

    Get real. You're out of my system when TNT2 comes out.

    If something becomes popular, they steal it. Its the way of political parties. First, they call the people who come up with the ideas "radicals".

    Later, when it becomes a well known, or important item, the politicians appropriate it for their own needs, claiming prior references as fact that they helped it succeed.

    Gore isn't the President for the new Millenium. He cannot be that, because he is obviously forever trapped by being a politician of the past.

    His attempts to become the "technology" President are only showing to the really people in technology that he is nothing short of an idiot looking for the village he deprived.

    Slogans, catch-phrases, and fad words are what he is, there is no substance.

    I do not see why owners of 98 should pay for more than shipping/manufacturing of the CDs. Furthermore whats the point of Windows Update? Gather marketing information?

    Okay, okay. I used to think that Justice needed something better to do than try to break up a company like Microsoft.

    However, I would prefer its put out of business. Any company as stupid as this, meaning lets show what a monopoly can do while we're in a trial about acting like one, does not deserve to be in business.

    So now I have to PAY to get the fixes that were promised in the MS literature when I paid to get my 98 fixes to 95!

    Screw them.

    They're screwing us.

    I just wish there was some *usuable* competitive OS. (Be and Linux just don't work for everyday needs I have)

    I don't like the idea of the moderator not being able to moderate and post at the same time. Granted some twink could abuse it, but hey! There are going to be others here as well moderating the moderator!

    So, instead of preventing a post by a moderator in a conference if he has "moderated" someone simple flag his message as from a moderator who has done some "moderation" with in the conference.

    IOW - Let him post his ideas (we would lose too many good ones - or worse no moderation).

    Should he/she have done some "work" in the same thread them flag his message as (active moderation within this discussion).

    Perhaps highlight changes made by moderators and the moderator that is visible ONLY to other moderators. Basically if the message is still visible mark it in a special color and attach the moderators name to it (again - only visible to other moderators)

    This allows policing of the police.

    That was the best change here recently... the ability to self moderate - or is that censor the available news stories.

    Still, since you are going to allow more active moderation, and you have all the filters perhaps this means you can post more stories (and properly categorize them). This way there would be more content that has a chance to appeal to more people.

    Sorry, but they have been able to hide behind a wall of ignorance for too long.

    They knew when adding the code to their office suite that people could use it to do just what the Melissa author did.

    Since its a feature they obviously feel no blame in any of the problems features of their products cause.

    Granted it too some loon to write it, but he had the in-direct support of an bunch of people at MS. They are only concerned about their money, which means if a feature that can be abused will make money then so be it, its added anyway.
