  2. Opposite Problem on Novell To Release Ximian Connector Under GPL · · Score: 4, Interesting

    But I Currently have the opposite problem and have yet to find a solution.

    I am looking to replace an exchange5.5 with something a little more controllable. Cost is an issue and I have around 50 clients. webmail a must. Currently, we are evaluating and will probably go with SUSE Openexchange.

    But, here's the problem:

    We also want to replace the outlook clients and I would love to switch to evolution. But, I cannot switch the clients off win2000 because of some propriatary programs that need to run.

    The goal here is to be MS free within the next year. And, with the exception of some programs we are currently porting, If I can get the users off outlook I can switch them from 2000 to Linux or BSD and very few would notice the difference.

    It took us 3 months to ween the users from MSOffice to Oo with very little complaints/training.

    Any thoughts?

    I gave this some thought a while back and think I may have an idea what we can do.

    It is very simple-- If the plantiff wins, the defendant must comply (obviously nothing new here) BUT, if the plantiff loses, the defendant is AUTOMATICALLY awarded damages equal to that spent by the platiff to bring the case in the first place.

    i.e. - If XYZ company sues me and loses, I am automatically awarded the same amount they paid their own attorneys to bring the case.

    If I sue XYZ company and lose, I not only pay my attorney his fees, but I also pay XYZ the same amount I paid my attorney.

    I think this would help to clean up the industry.

    Cheers

    I, too, have thought about this and I think I came up with something that may work:

    The Attorneys fees should be set by lowest paid attorneys in the case which the loser automatically pays. Example;

    Attorney for small guy charges $1200 and the attorney for the big guy charges $15,000.
    Should the little guy win, in addition to his judgement, his attorneys fees should automaticly be paid buy the losing party.
    Should the big guy win, the little guy should only have to pay his $1200 and an additional $1200 towards the big guys attorneys.

    I think this would level the playing field between sides.
