In reply to point 1, the owners have been known to take shots at passing ships. They're probably quite capable of shooting someone that tried to take it over.
I don't actually think of him as a brilliant businessman, but someone who is good at taking business advice.
The thing is why was he advised to stand down from running Microsoft at this juncture ?
