    MS wasn't charged under the RICO (Racketeer Influenced and Corrupt Organizations) Act, but the Sherman Antitrust Act. The RICO Act is the law that's used to deprive people of their property rights.

    Splitting up the company - while a step in the right direction - won't achieve nearly as much as opening up the source to Windows. That would be the best remedy.

    It doesn't appear to bode well for Yahoo!. It's kind if hard to say 'I didn't know it was illegal' when the ad says "This is a cdr copy of the game."

    It does matter. When you have something that a law, however unjust, says you can't have, then it's no longer the "land of the free", it's the "land of the underground."

    As long as it's not free, there's no way to stop the lawyers or the lawsuits.

    It's not that "presumption of innocence" doesn't apply - it's the proof of guilt. In a criminal case, the prosecution (the state) must prove guilt "beyond a reasonable doubt." In a civil case, the plaintiff must prove guilt by "a preponderance of the evidence." O.J. was found not guilty in a criminal proceeding, but guilty in a civil case. The standards are VERY different.

    and it certainly won't be the last. hopefully, the aclu will find another test case to defend where the litigants won't fold under the pressure.

    but don't blame the two programmers. it's not easy being a trail blazer. the threat of fines of hundreds of thousands of dollars would make many of us settle. i know i couldn't afford that.

    How long did you have to keep them ?

    That depends on the company - sometimes 6 months sometimes a year.

    What was the increase (or decrease) in value ?

    For every Red Hat or VA, there's a company that tanks.

    Do you think it's a good idea ?

    If I'm sold on the product and the management team. Both have to be there.

    What are the "gotchas" ?

    Wow - there are a lot. It's always a crap shoot, and the current trend of "instant gazillionaires" certainly won't last forever. But I think that if the product is solid, and the management team is solid, there's a good chance to make some money.

    (Fun to note this one though. Perfectly ok because operating systems aren't laundry detergent or toothpaste.) and computers aren't vacuum cleaners - anyone remember the VAX vacuum cleaner?

    They are not going to want to have to fiddle around with a root account to set any of these things up. Linux won't suit their needs now. It probably never will.

    Much the same could have been said of DOS (not too many) years ago. Imagine a stable Linux implementation of Plug-n-Pray type technology, and you'll see the average "home user" flocking to Linux.
