    is "copyleft" trademarked? what if an organized group confused the public as to the meaning of "copyleft"?.. trademarks are about reputation, which may be less of a product and more of an ongoing process.. less of a noun and more of a verb.. trademarks currently are strongest when they modify nouns, ie this is a google(tm) version of search.. for example, the act of xeroxing (verb) dilutes the xerox(tm) copyright.. google lawyers fret about verbal use of "to google" this or that.. for example, google "barlow+economy+ideas".. so is trademark as sick as copyright and patent? do trademarks need to go verbal to deal with info processes? how do you wanna change trademark?

    http://twext.com/patent is trying this strategy.. i'm not sure it's a "software" patent, the claims are more about A.) a way to format text for language learners and B.) a method to array text so software can easily format the text..

    the patent makes me feel slightly safer to share the idea.. the open license gives me B.) hope to develop the software (IANAL nor programmer) and A.) a free way to promote "free" uses of the software and resulting texts.. free promotion of the tool wants to cause commercial usage from which i hope to earn back my investment and then invest in something good.. evil?

For example, in one case an artist used a copyrighted photograph without permission as the basis for wood sculptures, copying all of the elements of the photo. The artist earned several hundred thousand dollars selling the sculptures. When the photographer sued, the artist claimed his sculptures were a fair use because the photographer would never have considered making sculptures. The court disagreed, stating that it did not matter whether the photographer had considered making sculptures; what mattered was that a potential market for sculptures of the photograph existed. ( Rogers v. Koons, 960 F.2d 301 (2d Cir. 1992).)
    so copyright owners already own any transformative use they haven't even imagined, considered, or worked hard to deliver? any value we prove to add to their property, no matter the sweat on our brow, is now their property? doesn't sound too fair..

    off topic: anyone know of any country w/ liberal interpretation of fair use? basically i wanna test a product that uses tiny little excerpts of music, lyrics reassembled to teach (natural) language.. they're telling if i try it here in mexico i go to jail (worse than usa).. the excerpts are tiny (less that 10%); the use is transformative; the purpose is educational.. whateva.. i need to test this thing commercially but where on earth is there liberal fair use?

    are there countries where they'll cream you for even thinking about a new fair use?
    * mexico (copyright violation rates with violent crime now)

    are there countries with liberal interpretation of fair use? guesses:
    * sweden ?
    * nederlands ?
    * brazil ?
    * venezuela?
