Is it death, or amnesia?
What if you knew you will wake up tomorrow with no recollection of today's experiences? Would you treat is as a death, or as a loss of one day?
I believe that in such situations the concept of 'death' needs to be revised.
Permadeath in roguelikes is MUCH different; and the fear of dying and losing several hours of gameplay makes the game much more exciting, as every decision becomes significant.
There is no zen-like feeling after you die, though. Only a lot of swearing and rage.

Piping graphics is OK, if we're not talking about games. The latency may be too high.
If I download the music (legally) through we7, then chop off the beginning ad, then I have a song no different than one downloaded through BitTorrent?
