This proves that the courts dont know anyting about technology. At somepoint during a program's life time some part of it is going to be loaded in to RAM to be used. The very fact that they say just having a copied of it in RAM is infringement means that I have infinged on Microsoft Copyright by using IE to post this.
There is a difference between abusing and using. Abusing it would total kill the movie, like have a FPS camera angle in DOOM, granted that movie blew hard.

I believe that it cool that games can use outside influences to change dynamically with the environment of the use but I believe that Metal Gear Acid 2 beat them to it by every time you get close enough to a wifi signal you get a new unit.
This game just bring that one step further by changing the enviroment of the game itself instead of rewarding the player.

I agree it has the same atmosphere as Max Payne. I just hope they don't abuse bullet time in the film.
