You're right. Weather they sold out or not is not relevant. However, it's pretty clear that they are being complete patsies to the RIAA.
look at the wording they used: " this is about piracy --- a/k/a taking something that doesn't belong to you; and that is morally and legally wrong. The trading of such information -- whether it's music, videos, photos, or whatever -- is, in effect, trafficking in stolen goods."
they are parroting RIAA propaganda. almost word for word.
Conspiracy theory time: Both Metallica and Dr. Dre were chosen as effective tools for sending a message. They are mainstream enough to be taken seriously but they still have enough of the alternative edge to appeal to the target audience: the Napster users.
