This depends on the copyright law in your country. Historically British and American copyright law usually protects a creation someone paid much money for creating, whereas historically in Europe copyright protects the artist who created a individual work of art.
This changed over time of course. Today in most European countries the general opinion is that something like, for example, a weather database is protected by copyright law, although it does not really represent a individual work of art.
Breathalyzer tests are valid evidence in US Courts? This is news to me, afaik here in Germany these tests are just used as an approximation (if you are under the limit on a breathalyzer test they let you drive, if it is close or you are over the limit they have to do a blood test). It's the same with these cheapo drug testers here.

In my opinion parent is right, you have (at least) 14 days to return the product. There is an exception from this rule for software (actually there are several exceptions, refer to paragraph 312d BGB ), but only if the software is sealed in some way (for example a sealed box with a cd in it and you broke the seal).
If the seller did not mention the "Widerrufsrecht" of 14 days you get at least 1 month (if they tell you about this afterwards), 6 months (if it is impossible to find out when they told you) to return it. If they never tell you about this "Widerrufsrecht" you can always return your stuff at any time for a full refund.
The seller is obligated to give you a full refund (except for shipping costs if the price is below a certain limit, i believe 40 Euros).
Note however that this is only valid if they sold you the product. If they just sold you the service (for example providing the download), and want you to pay for that the situation is quite different.

i wonder, what is the situation with cable providers like in other countries? here in germany almost everyone uses dsl, although internet via tv cable is available in most of the bigger cities. afaik, there are (or were?) some dsl providers who tried to kick users with excessive bandwith usage by offering them money to quit their contracts, but this is history i think. the few people i know who have cable (mosltly "Kabel BW") seem to be very happy with their providers, but this might just be because they still have the capacities, and they have to match the quality dsl providers offer to you (in most big cities 16/1 mbit/s or even 50/10 are possible, without any so called traffic shaping).
