What you want to do with feature branches is integrate from trunk early and often, but keep the feature out of the trunk itself until it is ready.
I don't even think it's constitutional to default.
They can sue someone because they have money to burn on a legal budget, and for no other reason.
This is simply a case of might makes right.
No you are not free to go and make your own if the established players can trump up legal attacks on you and force you out.

Probably because stuff on the *outside* has no reasonable expectation of privacy.
Enforce it strictly and allow drivers to sue car manufacturers for tickets caused by defective speedometers and I guarantee they would be properly calibrated rather quickly.
If laws were simple, the police wouldn't *have* to selectively enforce them.
I think the concept of not enforcing a crappy law is akin to jury nullification.
Oddly I don't think that parties are part of the constitution either.
What we have is an electoral college.
