    Seems to me the Supreme Court has no authority to establish anything.
    Its only job is to hear cases and judge them based on the law.
    Since almost all cases heard by the Supreme Court involve a claim of something being unconstitutional, and since the US Constitution is the highest law of the land (no, it's not treaties), the job of the Supreme Court is almost invariably:

    Hear a case
    Refer to the Constitution
    ???
    Judge

    All too often, ??? = "Fuck up", "Screw the people", "Fuck your freedoms", etc.

    And a low end hard drive does about 30-40 MB/sec in real world use (not "hey let's benchmark it by transferring a single 50 GB blu ray image"). Bursting to about 80 for an 8 MB cache, 120 for a 16 MB cache.

    The problem is, we have this odd expectation that any software, from a compiler, to a game, to an office suite to a browser should be instinctive by use of other software. That is, they think Word processor == Word. So when you take another word processor such as Open Office, they expect it to work -exactly- like Word. Any differences are seen as "faults".

    Take someone fully new to computers and have them learn Linux or Windows and chances are they will figure out Linux faster.

    Free truths: MS Word is actually amazingly rofuckingbust. Open Office? No. Their word processor is up to the task, but everything else in the suite, especially their spreadsheet app, is poop unfortunately.

    You seriously overestimate the ability of a standard plebe to adjust to any change.

    If you fucking switch out their pen from a twisty pen to a clicky pen, it's not a difference, it's not a preference, it's a problem, and the new way is wrong, and it's your job to get them the damned pen they like.

    Humans are great at adapting, but only when forced. Then they'll never stop bitching about how good it was in the past.

    SOMEONE has to be the one to come up with the ideas.
    So far, Linux has had a bunch of elitist nerds at the helm designing for themselves, and the result is an interface and general environment that the general populace is incapable of picking up and using without excessive hand holding.

    You can bitch about this being because, people are idiots, people only know Windoze, etc. all you want. And you'd be right.
    But that doesn't make the problem go away.

    Anyone* else steering the UI design is better at this point. And we're not even talking about steering the design of the UI. We're talking about getting formal feedback. Any member of the "community" can take any amount of that feedback under consideration and adjust their build's UI accordingly, or not.

    (*Anyone does not include anyone. Just as with "Anyone is better than Bush", if an Obama comes along, the claim is rendered invalid.)

    A judge's refusal to use the court's power to seize assets?

    The court does not need the man's cooperation.
    The court can TAKE HIS ASSETS.
    The court does not want his assets.
    The court wants him in jail so he has no hope of mounting a successful appeal.

    Bush #2 looked like a moron because he was a terrible public speaker. He either was a moron, or was smart and a dick.

    Obama looks good and people love him, but all his actions are pointing to him being inept. He's too concerned with his own appearances (camera whore), and too afraid of his party turning on him after they lose seats in the midterm election.

    None of the promised changes have taken place, despite the "YES WE CAN!" rally cries of the plebes who support him. Instead, we have continued on the path of erosion of rights and freedoms, massive debt, public takeover of private sectors, lack of transparency, pork and lobbying, kindergarten-level discourse, and in general, shitty, shitty government.

    Obama is a politician through and through, not a leader.

    You don't see the problem with Google going around to libraries, scanning millions of books, indexing them, then providing access?

    Google is not the copyright holder for these books, yet they are essentially printing infinite (digital, you know) copies. Then giving them away for free. Or for pay. Sometimes with money going back to the copyright holder.

    It's illegal for you to make copies of a book with a scanner. Why is it not illegal for Google to do the same on a scale of millions, while also providing access to them online?

    Sure - preserving shit is good. Especially shit that's out of print. But Google shouldn't have some magical right to ignore the law that everyone else doesn't have.

    Google basically went full steam ahead, got sued, and tried to pay them off while granting itself exclusive immunity for the future.

    Under the proposed agreement, Google could scan index publish, and sell/give away your latest novel without you seeing a fucking dime, and there's nothing you could do about it.

    Oh, and under that same proposed agreement, only magical Google would have those rights.

    We're going to need a robots.txt for fucking books now.

    So the FTC is claiming that if he is still a Trustor of the property, he can hand over the deed.

    Furthermore, the FTC is claiming that if he is not a Trustor, his wife is, and due to Nevada being a community property state, the court is able to take that property from her to settle debts.

    There are three big problems with that:

    1: His wife's assets may be up for grabs, sure. But not the assets of Shannon Neiswonger as Trustor. All the bitching about community property is moot - the house doesn't belong to his wife, it belongs to the Trustors of the SRN Trust.

    2: If the court wanted to, it could seize those assets. It would simply have to show that the dude was leaving as Trustor after the asset freeze.

    3: I still fail to see how "suspect activities" and a violation of an injunction result in a man sitting in jail for a non-criminal defense.

    The man is a piece of shit, but he shouldn't be in jail for inability (or unwillingness) to pay a debt. Freeze his assets (already done) and watch him. When he dips into foreign bank accounts or other unreported assets, nail him. If the court wants the money, then seize the assets.
