No.. They realized that if they forced the issue they would not have ANY artists willing to go into indentured servitued/slavery for the next 10 years for their work. Look at artists like George Michael and Prince they essentially were screwed by their contracts (thats why George Michael didn't make an albums for 10 years).

How the hell can they call it "work for hire" that would be like hiring someone and saying they write the music and the lyrics and hire people to play them. Somehow, I don't think thats anything close to what happens...

The problem is that the RIAA is going after Napster (software developers) instead of the individuals who are actually stealing (the people who download copyrighted music).

They are being targeted because THEY are visible and can be made an example. The music industry would be insane to go after the actual individuals downloading the material (although I bet they would if they could)..

By the RIAA's logic, they should be sueing 3M/Acer/etc. for manufacturing CDR media, HP/SONY/Phillips/etc. for producing CDR devices, Diamond MM/etc. for producing MP3 Players... Napster isn't illegal, people CAN use it for illegal purposes (same as a car, a baseball bat, a knife, etc.)..

The court should (and God willing will) rule against the RIAA for the simple fact, the tool isn't doing something illegal.. Its a file sharing tool that happens to focus on MP3's. The people downloading and sharing the MP3's are the ones breaking the law

And this doesn't even take into account the argument that since they aren't making a profit on the downloads, then they AREN'T breaking the copyright laws...

No.. The problem is that you aren't purchasing the music. You are purchasing a tape that happens to have music on it. If it breaks (because they designed it to), Tough ! You have to purchase a new one.

They are trying to make it so that if I purchase a CD, I can't dup the CD to CDR (or to a casette) so that I can leave the CD in my nice air conditioned house and use the CDR/casette in my car... (the same right you DO have with software - to duplicate it and save the original)..

Why the hell should I have to purchase a copy on CD so that when I'm in my office, I can listen to it on my computers CD player, a copy on casette to play in my walkman when I'm on the tredmill, or to rip an MP3 to play it on my RIO ?
