    WHY dont more whine about it? Because so much of the business world relies on it that to make and change the rules is a huge problem....
    it will cost a ton of cash...not that DPI boxes at a million a piece dont...
    all one needs do then is totally recreate there own protocols and copyright and patent them and not allow anyone but you and your friends to legally use them , then the dpi box can slow and stop ONLY based on them NOT conforming which then is a direct show of harm.

    and hten you have to show up ill come by myself and guess what you needing a lawyer means you just spent nearly 3-4 grand
    and even if you win 5K
    on disability the most you can take form me is 50$ a month
    in other words you have to sue a lot of people ot make it worth it and do it class action wise ergo 80 or so to barely break even
    and they like targeting the poor and disadvantaged the 50$ rule was placed for this very reason....to not harm the person overtly....
    funny how that works...

    welfare people its only 25$ so really not worth it
    so you get friends pay a guy to get net access on welfare and if he ever gets nailed no one is really out much for ever and 200 months to pay it back is hilarious and the seocnd time you can just add 200 more months and so on ya cant take more ten the 25 or 50

    so all the laws in the land cant mess with that...you change this and it will mean heavy handed overpayment rules be changed
    and doing that your gonna see an uptake in crime as those not into downloading suddenly get boiinked for more cash then rent wont have a home and thus will steal to make ends meet

    so changing that law wont help no one either...
    remember the poorest people spend 100% of there incomes in the community
    rich people put it in a bank and it don't do anything for you or the nation.

    remember if i pay a levy which was in effect a lisence to do private copying and you change the law such that i have to buy a blank cdr and pay that levy and then get fined and have a record of up to 5000$
    section one of the charter of rights and freedoms states:
    YOU need to look at the Oakes test....
    The test is applied once the claimant has proven that one of the provisions of the Charter has been violated. The onus is on the Crown to pass the Oakes test.

    you have one law BLANK MEDIA LEVY and then violate my right to privacy and security by adding a new one that penalizes me after in good faith i have paid already.

    as the CRIA now music canada has asked for and received when it asked for increases ot said levy and not more....then one can argue that the fillowing needs to be proved in order that section one oakes test be passed.

    There must be a pressing and substantial objective
    The means must be proportional
    The means must be rationally connected to the objective
    There must be minimal impairment of rights
    There must be proportionality between the infringement and objective.

    you affectivly impair the following rights with this case.
    Without a warrant they have passed private data to a court , thus say if i have downloaded music and placed onto blank cdrs paying said levy

    one could argue such laws that contrary themselves are unfair and violate section seven fo the charter and the fundamental principals of justice.

    and if you read section 7 you will see various "angles"

    thats my interpretation of it.

    you've already got a media levy , you then add all this to things and add the stress and violations of privacy by a NON GOVERNMENT entity and you actually think all this is legal and some judge already let them enter the evidence?

    its a joke. The major factor here while there may be other laws that aren't major that conflict they are not going to affect large sections of the populace.

    Then there is the aspects of violations of the strict privacy laws of Canada nad our fraud laws that entail how they obtained without out legal means to obtain data on these 50 people....only two ways to know one is using bittorrent , be in the swarm , or port scanning....
    both ways your not law enforcement so committing the illegal act of sharing it out is in itself not legal and thus your breach of law in obtaining said data is also in and of itself should not have been admissible.

    IN fact it is possible a judge can via those terrorist laws allow for say a police officer or RCMP or other law

    yes it will when i say the most you can get is 50$ per month ( on disability and that is the law also )and that ill make sure i make you show up a few times in court so those lawyers fees are pricey
    you go right on and ill download everything i can and once you sue you cant come back for more as ive been hit for it
    you cant sue me for the same thing twice after all....
    so you show up and start the case ill call 20 witnesses over 3 days and that alone insures your spending nearly 5000
    you still cant get more then 5000
    so guess what enjoy......
