  1. Might Makes Right on More Fun With "For Dummies" Trademarks · · Score: 3

    Please excuse the ambiguity of my previous post. I was wavering betwixt humor and a real post. But I would like to clarify a couple of things:

    1)I am not of the opinion that the "for dummies" trademark should have ever been granted in the first place. "...for dummies" is/was a relatively well used term prior to IDG's trademarking of it. As I said before, while not everyone was using the term, it was most certainly out there...so there's a prior art argument.

    2) The real threat of IDG is not in the trademark. That is inconsequential, assume they do have a right to carry this trademark, and they don't have a legal right to infringe upon a non-profit (etc.) organization's ability to use such a term. That's all fine and good - but we're talking about the real world. As happens most often, Company A says to person B, "Take blah down!" Person B says, "Fuck off, I have the right to have blah up!" Company A says "Take it down or we'll sue you." Person B has to think VERY hard about whether or not they want to risk a small fortune to fight off Company A even though they know they're in the clear. It's the old - "do it or we'll bankrupt you in the process" routine.

    It's not right...but it's the way things work.

    BTW - the post was a satire meant to villify IDG, and it's "hell or high water."

    I am writing you to inform you that you are in violation of my companies (BigCo, Inc) trademark of the phrase "more or less." - As most know, the term "more or less" has, for over 10 years, been associated with BigCo. If you, an average slashdot poster, do not remove your post containing the terms described above, we will be forced to threaten to sic our lawyers on you...and, thusly, you will realize that we have a helluvalot more money than you - and so it's cheaper for you to bow to our will, rather than lose every cent you have paying your lawyers to fight for what is actually right (@ right, and all terms associated with right are a registered trademark of BigCo.)

    Ummmm - we're talking about a piece of the fucking language. Just because people weren't using the term "for dummies" as a joke/buzzword prior to 1991 doesn't mean that IDG can just grab a trademark on it...honestly...this is just ri-goddamn-diculous.

    You folks have to look at the REAL effect this is going to have on the world. You'll have to realize that while everyone who reads /. knows what open source source is actually all about, the vast majority of the general computer using public does not.

    While this (microsoft's half-assed open sourcing scheme) isn't exactly the greatest thing to ever happen to the computer using public, the true value is that it opens Joe Schmoe's eyes to what open source is all about. More people will have a slightly larger interest in "this new fangled open source thingamijig."

    I reall don't care what MS does/impliments because i don't use windows...but i have the nagging feeling this may actually enlighten some people and increase that "other" operating system's user base. ;-)

    Thoughts...commments?

  6. PBS comes to mind on Washington Supreme Court Upholds Shrinkwrap Licensing · · Score: 5

    I remember watching a PBS law special on this type of argument. The main argument was the liability of a "provider of goods" to the consumer. The main case-in-point was a gentleman who chipped his teeth on a pearl he found in an oyster. Should the proprieter of the restaraunt be held liable for any damages?

    The argument, and the law, is this: The manufacturer/proprieter cannot be held accountable for any damages encurred from something one could reasonably expect in a good. So...can one reasonably expect bugs to be present in a given program? Unfortunately for the consumer...the answer is a resounding YES. The manufacturer's claim is furthered by the fact that the consumer, in this case, agreed to the terms of the software. While you may not, in a court of law, sign away your rights as a consumer, there is no constitutional, or otherwise, right to bug-free software.

    generally your news stories have already been submitted about 1x times before you submit yours. Most of the time, they'll post news articles that are well written, and (of course) timely. Don't get miffed if your news piece doesn't make it. Most don't.

    Anyway - as far as upgrading your kernel. The best way to learn is to read the kernel HOWTO. It's a pretty good document, if not slightly antequated. It should be included in the dox on your box. If not...you can find it linked to at linux.org - Just make sure to keep a bootable backup copy of your old kernel ready to go just in case something doesn't work right. - or you just plain fuck it up :)

  10. Smokers, Elian, and Mitnick on Mitnick Ordered Off Lecture Circuit · · Score: 2

    Ok...long/short rant. Here goes nothing:

    Smokers: The studies that so many people wave around screaming about when i'm on the 16th Street Mall having a cigarette are what I like to call "bullshit/propaganda" studies. While they are true to the extent that yes...second hand smoke can kill you. They can be false in the sense that they lead people to believe that if you're sitting next to a smoker and you accidentally inhale some of the second hand smoke - this is going to be a signifigant factore in whether or not you develop cancer down the line. Smoking may very well become a controlled substance down the line (i mean "heroin" controlled) and i can't say that i like it. Public opinion is one thing. But to tell me that I don't have the right to light up in my own home, or on the street for that matter, because some SUV driving dudley-do-right with 8 kids misread a study that showed people who live with smokers their whole lives have an increased risk of cancer...that makes me wanna fucking vomit!

    Ok - on to Elian...i think i'm on a roll. The original poster (or one generation down) mentioned Mitnick, Elian, and Waco all in the same sentance...i'm sorry, but that was misinformed to say the least. Mitnick is a criminal, in the sense of "one who has been convicted of a crime." Just because I believe in freedom of speech and that the government is a bunch of morons when it comes to matters of technology - don't think i'm going to defend mitnick's jail time. He broke the law, and for that, he should have gone to jail. While i can't say i agree with the length of his incarceration or his post-time sensuring. I can most certainly argue that "yes! this guy broke alot of laws....most of them just laws." As far as this being in comparison to Elian and Waco? Jesus people - Reno was in a bad position as far as Elain was concerned. Damned if she did. Damned if she didn't. Elian is an illegal immigrant. Kidnapped from joint custody by his mother, he found himself in Miami where people bought him lots of shit because he was the boy of the hour and treat a father who wants his son like a villain. I suppose everyone's forgetting the facts of the case here. 1: That Elian WAS an illegal immigrant. 2: He had been in the custody of the Miami family for more than 5 months (wtf??) 3: That Lorenzo (i think), the great uncle, had been in direct violation of the law for 8-9 days prior to the INS seizure of the boy. Reno was right to take him, in the night, as quickly as possible. I'm sorry folks, but only in a perfect world would the father have been able to just stroll up to the door with some INS officials and ask for the kid back without getting SOMEONE hurt. I didn't agree with what happened in Waco (especially with some of the new evidence) - but with Elian, Reno was right.

    BTW - just so we're clear on what i think: Reno = good job. Mitnick = they violated his 1st amendment rights but he had to serve the time. Guns = Somewhat legal (not AK-47's). Alcohol = legal (this is a morality issue). Cigarettes = Legal, let's teach our kids that it's not cool...not just tell them it's evil. Waco = EVERYONE fucked that one up! SUV's = Hrm...polution makes you dumb (slashdot), and SUV's produce INSANE amounts of polution. If you drive an SUV...you're harming me....will all the militant non-smokers who drive SUV's please step forward!!!

    that list has been around for quite some time...but it's not owned by DoubleClick. It's owned by the FBI.

    Side note: Privacy is still around. I find it surprising that many of the /. posters who pride themselves on technical knowledge and internet savvy have a very narrow field of total vision. So, about %10 of the WORLD'S population is "on line" - do you honestly think the other %90 give a shit about privacy on the internet? The list you provided is honestly not there yet. At best, advertisers have a collection of Income, Children, # Of computers owned, etc. etc. but they don't have any info that wasn't voluntarily given. They're advertisers...not PI's. (Don't ask how i know ;-)

    Dear lord! i shudder to think of what we might discover about ourselves, our neighbors, and our fellow humans if privacy disappears totally! We might find startling things like:

    1) Guys masturbate....frequently!

    2) Guys look at pr0n on the net....frequently!

    3) The vast majority of non quadropalegic (sp?) people LOVE to have sex....as well as some of the quadropalegic ones to.

    4) They'll find out who REALLY was downloading all those damned Dr. Dre mp3's. We really need to get to the bottom of that! If not for ourselves....for our children!!!!

    5) Natalie Portman herself is actually behind all of the "hot grits" propaganda on /.

    Am i wrong? Is there not a french academy for language? I know of several specific instances where words that were commonly used in french were not honored by the Academy because there was "no room" for them - if you'd like to see an example, go to any McDonalds in France. I'm not knocking french - quite the contrary. I suppose what i'm trying to get at here is that you're post obviously subjects you to scrutiny as, what some like to call, a fucking stupid bitch!

  14. Anyone seen wargames? on Solving Chess? · · Score: 2

    This is sort of a "what's the big fucking deal" type post to me. Chess is a game. If it's solvable then no one would ever want to play computers at chess...and who wants two see "Deep Blue" and "Deep Green" go at it in a perfectmatchup.

    Computers are still not as good as humans. Here's a tidbit of information. Deep Blue did beat Kasparov a year or so back. It was all over the papers in the whole "machine beats man" sort of thing. What most failed to mention was that the original Deep Blue had beat everyone it had played with the exception of Kasparov. When IBM went back to the drawing board. They altered some of the algorithms to specifically beat Kasparov. So we can pretty much assume that if Blue played another international grand master...it might very well lose.

    By now you're asking...what's the damned point?? The point, my friends is this, one flaw is that chess is a very human game. The reason Kasparov beat Deep Blue in the first place. Because a computer can play a perfect game of chess against another computer. We're talking about calculating the best move in a given situation based on probabilities calculated 30-40 moves ahead (more realistically 10-20). But that totally removes the human element of chess....which is arguably the best element. While you can guess what your opponent is going to do on his next move...based on what you determine to be the best move...you can never say for certain! Every single move/counter move alters the game completely. GOOOOOOO HUMANS!!!!

    You're right on the money. Unfortunately i didn't read quite enough into the document to see the OS/IE issue - my fault. But on to the post...
    That's exactly what MSIE originally appeared to be/be marketed as...was like a file browser for the internet. I'm not sure the DOJ sees it that way. and i'm not certain that they really understood the context in which MS integrated MSIE into their OS. I see no problems with this....but then again. Windows isn't my primary OS. I mean, to be quite frank, i'm not sure that Netscape ever really had too much of a bone to pick with MSIE - i think they were just frightened at the thought that MSIE would be a better browser because of it's inherent integration into the OS. -- i'm just frightened that certain companies in the industry used jaded tech experts to help the DOJ bring down MS. -- alot of their business tactics are questionable to say the least, but a MS is only a monopoly if you believe that the general public is too stupid to use any other OS. Back in the days of Standard Oil or AT&T - there really WAS no other alternative. With an OS...that's really not the case. Personally i think the DOJ fucked up on this one.

    Sorry - second post in this topic but i thought this was REALLY fucking stupid.

    I just read the DOJvsMS link and thought to myself WTF. So if this splitup goes through then look what's going to happen. The 'OS' company gets any intellectual property royalty free from the 'App' company. I can see the conversation brewing between Bill Gates (Owner of MS 'OS' Company) and Bill Gates (Owner of MS 'App' Company)

    Bill: jeepers bill. we're in two separate companies now...what will we do about MSIE now? How can we integrate it into the OS?

    Bill: well Bill...how about we give you MSIE 6 about a year before you roll out Windows 2x and you'll be able to integrate it into the OS anyway.

    Bill: That seems like an excellent idea. How much do you want for that 'intellectual property'??

    Bill: Well bill - because of the DOJ...it's free of charge. And might i add...you are such a handsome man.

    Bill: Thank you Bill. Wow - i never realized that the DOJ has no fucking CLUE what's going on in the tech field and that their ruling really doesn't do shit!

  19. Common language will not be english on A Common (Internet-Based) Language? · · Score: 2

    Unlike French, there is no common group of social "overlords" who determine what will go and what will stay. Words come and go in the english language like fads. Slang terms slowly replace more traditional terms, and more traditional terms sometimes make comebacks...and the evolutionary process of the english language continues (Webster knew his kids would always have a job).

    If you look at the English language now...it is in fact a far cry from the days of Shakespeare and such. A new dialect certainly.

    The point is that language is a process of evolutionary communication. As the internet grows, and the world becomes closer and closer...English will most likely become a standard amongst the vast majority of the world population...but most certainly it will not become a standard in the next 50-100 years. We're talking about a signifigant lingual/cultural change. Terms like "carte blanche" and "caveat emptor" which have become a part of the english language help us identify more than just what we're talking about. They're also an indication of where the language has been (btw - the reason english is so "bastardized" and irregular, so to speak, is because it's an agregate of many languages...but that's another lecture for another time.)

    English most likely will become the standard for the world...at which point it would logically become the standard for the internet, not the other way around...although the internet may facilitate its growth. But by the time this occurs...once again our decendents won't be able to read our current literature without being told to by their 10th grade teacher...and it probably won't really be English they're speaking anymore...it'll just be called that by default!

    Actually, there is already legislation protecting a persons DNA from being used agains them as a form of discrimination. Businesses may not genetically test people for screening. I believe this also applies to the insurance community but i may be wrong.

    As far as being African-American. Unless you're planning on carrying a cross through your neighborhood in celebration of our happy little christian holiday on Sunday, you'll probably admit that life pretty much began in and about africa/fertile crescent. thusly - YES! we are all indeed African-American (or black as i like to say) in heritage. Damn - i'll bet that really pisses people in the KKK off....oh well, i guess now they'll just have to lynch themselves!

    I'm not sure all of these previews are necessarily a super deal. I had an incredible amount of font problems with the preview release of RH6.2 and so i've actually opted to hold off on the full release...maybe just upgrading my kernel manually (when i'm not too lazy).

    I've noticed that "beta" copies of OSes often have quite a few problems - perhaps because vendors are still deciding what to/not to include in the "actual" distribution when it comes out a month or so later. It is, however, good for the open source community as far as being able to make the full version much better than it would be normally. People get a chance to see it and make changes or tell the vendor what else they'd like to see in the upcoming release. So i suppose all in all it evens out. Good for the experienced user...not so good for the newbie.

    As you may have heard this...it is somewhat wierdly posted here on slashdot. I recall hearing the story of the "rocket car" years ago on the darwin awards. I believe it's one of the oldest. They posthumously (sp?) gave it to a retired army colonel who strapped two JATO's to the top of his chevy Impala and slammed it into the side of a mountain. When the meds arrived all they found was a bunch of metal embedded in the side of a mountain with some teeth and a tiny amount of flesh. A sort of idiot cocktail.

    Anyway - if you haven't read this one (yes..of course it's fake) you REALLY need to get your ass to the darwin awards and check out what these fucking idiots do to win them. An excellent read.
