  1. It's only a matter of time... on Court Finds Online Software License Not Binding · · Score: 1

Before this ruling is overturned by a higher court. Happens every time. :)
While that may be good for unsavory, shady licensing schemes, it could be bad for GPL'd software.

  2. Actually... on Napster Judge Groks Filename Variation · · Score: 1

    From http://www.loc.gov/copyright/circs/circ22.html#dur ation:

A work that is created and fixed in tangible form for the first time on or after January 1, 1978, is automatically protected from the moment of its creation and is ordinarily given a term enduring for the author?s life plus an additional 70 years after the author?s death. In the case of "a joint work prepared by two or more authors who did not work for hire," the term lasts for 70 years after the last surviving author?s death. For works made for hire and for anonymous and pseudonymous works (unless the author?s identity is revealed in the Copyright Office records), the duration of copyright will be 95 years from publication or 120 years from creation, whichever is less.

Works created before the 1976 law came into effect but neither published nor registered for copyright before January 1, 1978, have been automatically brought under the statute and are now given federal copyright protection. The duration of copyright in these works will generally be computed in the same way as for new works: the life- plus-70 or 95/120-year terms will apply. However, all works in this category are guaranteed at least 25 years of statutory protection.

Hope that clears things up for you.

  3. Prelude on Tad Williams To Release To Web · · Score: 1

I just got done reading the prelude, and I have to say it looks interesting. The "Blind King" reminded me a bit of Lovecraft's "High Priest not to be described, which wears a yellow silken mask on its face." :) The Memory, Sorrow, and Thorn trilogy kicked ass, so with any luck this will, too.

The defendant is usally punished by requiring them to send out dollar-off coupons to the plaintiffs, like what happened with GM.

Exactly. The same thing happened with Nintendo when they had an antitrust suit against them (what the hell is it about Redmond?) in the late 80s-early 90s. They had to pay out several million dollars, but each customer (myself included) who had sent in a warranty card got a coupon good for $5 off of any game with the "Nintendo Seal of Approval" or whatever it was called. Of course, this was way back when I was about 13 (1991 or so), so I thought it was so cool :P
