    Personal duplication amongst friends might not be too bad but mass distribution via P2P apps is clearly wrong and just as harmful to the industries that are supported by the protections provided by intellectual property law.

    Merriam defines media as "a medium of cultivation, conveyance, or expression". I think a digital file certainly fits this definition. Therefore an Online Media Distribution System could certainly be one that distributes digital files, in this case music. The name is significant in that P2P is nothing more than distribution. As distribution is one of the five basic rights granted the owner of intellectual property, and arguably the most important to maintain and control, it behooves them to ensure that people can't become distributors of intellectual property for which they do not have the rights or permissions necessary to do so. You are more then welcome to write your own music and distribute it however you choose though.

    That's OK, I'll watch it for you from my seats in section 38 :) I love having season tickets. With my ticket package, I might not get my regular seats in 40 a 7 rows behind the Red Sox bullpen but when they do get into the post season I at least get the option to purchase full ALDS/ALCS/WS ticket packages before the general public (oh, and I get options to purchase concert tickets early as well - saw the Stones, Buffet and The Police). 2004 was great but I'd like to see the win it at Fenway park this year, even if it means the Sox have to lose a couple in the middle to do it.

    The state does not make it illegal to resell the tickets, they mait is iillegal to resell the tickets for a profit.

    I'm a Red Sox season ticket holder and I'm sure eh Patriots have a similar clause which says you can only resell your ticket for face value. That's not only the policy of the franchise, it's State Law. MA has anti-scalping laws on the books which means you can still resell your ticket, you just can't profit from it, therefore First-Sale is not an issue.

    You apparently haven't played Halo 3 yet then. I'm just getting into the first Flood levels and there were numerous fights that I found myself searching for high ground to better survey where the Flood was coming from and how to best take them on. I also found many of the battles between the Master Chief and things like tanks, hunters or brutes with grenade launchers or hammers required some strategy beyond duck, run, kill.

    Oh, please. it costs comapnies NOTHING to permit different races to enter a store. It does cost more money to allow those with limited abilities, such as mobility, to erect a ramp, allwo for parking, etc. The same goes for online surfing. It costs companies nothing to permit different races into their online sotres but it does cost more to implement a web site that is both engaging and accessible. I'm not syaing don't do it at all, but if Target is honestly making an effort to improve, why sue? Why not work with them and their site developers to improve the site and ensure Target's costs aren't going to increase unreasonably given the return on the investment?

    These companies, or their representatives, are welcome to offer Dell, et al, deals for loading their OS in place of Windows. Whether you like Windows or not, it does offer value to consumers who want to purchase a computer. So far, Linux, et al, have not been able to prove they have the same value. Forcing computer manufacturers to cripple their product for a minority group of people at best is ridiculous. Prove your OS has more value then Windows and the rest will fall into place. Here's a hint though, anecdotal evidence won't cut it.

    But it does so poorly. I often think I'm left-clicking only to have a right-click contextual menu pop-up and annoy the hell out me. I hate the thought of having to purchase a mouse for my system at work (they won't) when Apple should just get over their obsession of eliminating buttons together and offer a true two button mouse.

    Copyrights on Steamboat Willie could expire tomorrow but you'd still need to obtain permission to use a trademarked character. The best you'll ever be able to do is distribute out of copyright Disney films. Also, even if the copyright on Steamboat Willie expired tomorrow and Mickey Mouse was not a trademark, the only depiction you would be allowed to use would be the Steamboat Willie version of Mickey Mouse, not the Red trouser, yellow-button wearing Mickey Mouse we all know and love.

    I waited an extra month or two to purchase my new Dell XPS M2010 just to get Vista since it was on the horizon and as far as I could tell all my hardware/software worked for the most part or new drivers were already in beta for one of my Epson printers. I would have not waited six months for Vista, nor do I have any plans to go out and purchase it for any of my other machines, but I can't say I'm unhappy that I waited a month to get it on my new-ish system. The Vista Media Center is EXCELLENT and in my opinion is unmatched by any other software or dedicated box. Microsoft could dominate the PVR market if they released a Zune TV device that basically booted straight into WMC without the Windows UI anywhere to be seen. Let me sync recorded shows to a Zune 2.0 device and Apple's hold on the handheld media device market would begin to wane. Some of the adjustments to Explorer and the Start menu are nice and improve the usefulness of both a little bit. My biggest problems with Vista aren't Microsoft's doing, they are the third party developers who dragged their feet even knowing full well that Vista was coming out and they knew what they had to do to make their software compatible. There really is little Microsoft can do to get developers to use user accounts properly (which have been a apart of NT from the start, Vista is the first time Microsoft has enforced their use). I really don't see the need for anyone other than corporate customers to downgrade to XP.

    No, what he is basically saying is people should be allowed to do what they wish with the way things they have told to other people. If you're going to discuss copyright then learn that it's not the idea that is copyrighted, it's the expression of the idea that is protected. I am so sick and tired of hearing people consistently get this fact wrong and parrot the \. party line "ideas are being locked up forever". NO, they are not, the expression of an idea is being granted temporary ownership to the individual who created it for them to do with as they please, including selling the rights to large corporations for large sums of money.

    Yeah, because these Slashdot users leave these opinions on these forums, they don't take them along to their workplaces or pass them along to friends and family when asked (or often when not asked as it sounds by many of the comments I've read in the past). It doesn't matter if it's a corporation or individuals en masse, FUD is FUD is FUD, period.

    Please tell me you were being sarcastic there. I have read enough unsubatantiated "facts" and vague assertions about Windows on Slashdot alone to make your head spin. For instace, how about all the recent bullshit about DRM and HD playback on Vista, all perpeturaed by some paper written by a guy who states that he has never even used Vista and the readers should check the facts for him? I could go on but one need only to read Slashdot on a semi-frequent basis to see all the BS written about Windows and Microsoft.

    How ironic that you bring Anti-MS FUD into this discussion. However, the rotary interface for the touchscreen phone is fucking cool and the ability to print pictures right out of camera would be awesome as well (hello inkless printers - http://www.zink.com/assets/how_it_works/). The e-mail thing is just plain fucking stupid as Outlook does an excellent job at filtering spam, hell even Windows Mail does a good job at filtering spam (perhaps you should try it instead of blindly bashing anything MS). The battery issue was just as dumb. The iPhone doesn't get great battery life and Apple, once again, makes the battery in their portable media devices unservicable by the user. If you need to get a new battery you're going to be without a cell phone until Apple fixes and returns yours.

    The argument i9s "making available" is the same things as distribution. The RIAA, or its members, do have the sole right of distribution afforded them by copyright law. One of the biggest problems I have with this whole "copyright reform" idea is that people want the right of distribution and derivatives to reside with them, not the content creators. make no bones about it, it is not "sharing", it is unauthorized, and illegal, distribution of intellectual property (I also have the pedantic fuckwits who always jump in and whine "it's not theft"; fine, it's illegal distribution). Anyway, either way you slice it, the labels do have the right of "making available", a.k.a. distribution.

    You don't sound jaded, I believe you're spot on. The Democrats are refusing to do anything about the current administration, beyond some token gestures designed to gain good will for their platforms in the upcoming election, because they know they have a shot at obtaining that same level of power put in place by the President Bush. If teh Democrats lose the election in '08, watch every one of they cry bloody murder and work to destroy the powers they failed to obtain.

    It is when there is a potential for lost sales revenue due to people waiting for the sale date or when a competitor gains an advantage by k nowing when you plan on putting things on sale and has a sale a day or two earlier.
