    The difference is that for an employer to get the most "bang" in a non-compete, they have to lay the employee out for a good while.

    There's no such thing as a short term non-compete.

    I agree. TurboLinux can take whatever business tact they want, as long as they stick to their licensing.

    But I don't like the paragraph..

    There is precedent for Torvalds quickly deciding to incorporate changes to the kernel produced by commercial developers, Iams said. Engineers at Siemens and Linux distributor SuSE Inc. provided a 4G-byte memory extension that Torvalds incorporated.

    This seems to be a backhanded swipe at Linus. They make it seem as if Linus should do it because he did it for someone else. Well, SGI has had a bunch of patches rejected( http://oss.sgi.com/projects/ linuxsgi/download/patches/ ). So have ALOT of others. Tough luck... But A Precedent?

    Media Pressure on Linux is dirty, ignorant, and non-productive when you say someone should be doing this. Computerworld sucks and blows at the same time.

    Anybody worth their stuff knows that when you are "retargeting" a language(VB) into another language(C++), the features required to support that are enormous and have to be VERY general.

    VB is slow. C++ is pretty fast. C is the fastest, next to assembly. Though, not all C compilers were created equally.

    Personally, I have translated applications from C++ to C that achieved 1/10 the size and 400% increase in speed. Especially in large data sets.
    I'm not bashing C++, I'm just saying it has it's place. For instance, event driven GUI's. Fantastic! Large scale mathmatical models.. UGH! Database systems.. depends. But in any case, be prepared to feel the power of BLOAT.

    And remember, that PERL is written in C. Java (the jvm is, javac has mixed C and Java (used to be all C though))is written in C. Tcl/tk is written in C. I bet a good bit of VB was originally written in C. Linux is written in C. NT is written in C. Xwindows, Netscape, LDAP, Oracle, Informix... c,c,c,c,c.

    There's alot of C++ out there.. but nobody should pretend that it's the one-all end-all. Same goes for Java, Perl, VB, etc, and yes even C. And remember that the implementation of the compiler, libraries, and envoronment can make all the difference in the world.

    Of course in the Fountains of Paradise, the diamond filament was so thin that you couldn't see it. Walking through it would cut you in half!

    The hard part is putting enough weight up in space to be able to lift a large load.. and keeping stability would be tough too. It's like using a baloon.

    Imagine the winds and huricanes and natural phenomenon. Plus, there'd have to be alot of cable monitoring systems. Cable would need to be replaced.

    1. Get interrested in Tesla, Unified Field Theories, Einstein.. and most importantly High Energy Wave Physics.

    2. Go to your local university library and sit by yourself. Read journals and old books about Gravity, Waves, and Grand Unified Field Theories. Don't EVERY check out anything. Don't get a library card. Go to a different university than you went to.

    3. Repeat 2 alot. Don't talk about what you think about. You must be serious.

    4. When things start getting weird, have confidence that they WON'T kill you. They just want to discourage you. They're very good at their job.

    This is analogous to patenting words.. you can't do it.

    The genetic structure is SOURCE CODE for gods sake! Hell, it's better than source code. It's like a zipped binary.

    Essentially, scientist are "reverse engineering" DNA. If we were smart, we'd have DNA put into the public domain. The catch-22 is that companies SAY they wouldn't spend as much on DNA research if they couldn't get a patent. That's bullshit. They can still patent their medicines and therapies. They just shouldn't be able to patent sequence. It could eventually get very stiffling if we start handing out the Y gene, ya know.

    Imagine, Merck owns femininity.. who do they think they fsking are, Aphrodite? What is medical companies learned from software companies, and started licensing gene therapies? AHHHH

    I run the risk of pissing a bunch of you off.. but here's my take. I think that the SCSL is a load of crap. I am very careful about what license I use. I think that people should really read the SCSL. And weep..

    in fact, here's my summary (taken from above post) of the terms and limitations.

    1. Developers to have access to the code for further understanding how to work ontop of Sun's products/innovations.
    You must give us your gonads to view the code. Developers who violate this provision will be burned at the stake.

    2. Developers can improve Sun's code and make a profit. This is only restricted in selling bug fixes.
    For every profit you make off of sun, we want a steak. That's right.. from Ruth's Cris too, not some Dingle Steak Hut!

    3. Developers cannot create forks, in the essense of creating incompatable versions of the Java programming language, etc.
    In the interrest of stifling real innovation, sun has decided that we're better that you are. We are cool. How dare you add an unsanctioned method!! Developers who wish to fork will be fried up like pork rinds by our favorite developer, Bill "Frydaddy" Joy.

    4. Sun can make royalties, a profit, while also bringing developers to working with Sun, and at times on Sun's platform.
    In addition, sun reserves the right to revoke your license if you present yourself without deoderant, clean teeth, and without toe-jam. If you even THINK about making more than us from Java, we'll send out the SPANISH INQUISITION!!

    In addition, should sun decide that you developers arn't good - we'll change the api (every version since 1.0) even though we say we arn't going to. All developers are bad. Except the ones who have bought us steak.

    Our pack of corporate lawyer bull dogs will happily come over to explain your violation(and we're sure you have violated something.. come on!). We will bring over our own copy of pulp fiction, thank you.

    I've "heard" (ahem) that 3dfx is going to open up some more information in a BIG way. They say they are going to be a big contributor, and will release more specs. The big part is getting all the documentation completed and reformatted.

    It's pretty easy to come down on them. So maybe you are right. But, they're sitting pretty in the XFree 4.0 port. They're the first tier development of the DRI. Which I think is unfair, because they are so paranoid about their 3D specs.

    Personally, I am switching my development on XFree86 from the VooDoo to ATI. (nVidia doesn't work on alpha, and Matrox is too $$)

    But if a couple of lawyers had ethics, we'd probably have alot less of these dumb patents. The patent office told me that there is a "duspute stage".. I took this to mean, cross license or get ready for court.

    I have written my congressman about several of these "bad" patents. He actually contacted the patent office, and told them "what's going on here?" Well, they invited me to a "conference" with free tickets. But, it was in the middle of the week, and it was in DC. Just started a new job, so I couldn't do that.

    I think this gives me an idea about how to fight the USPTO from being so salacious with it's issuing power. What really needs to happen, is to force congress to review the USPTO's duties and work. Kind of what happened to the IRS. Alot of letter writing, in conjunction with the EFF, and the Programmers league would probably do alot in this area. The letter I got from the USPTO seems like they were sweating a bit on what I had written. So, maybe alot of these could go..

    I had advocating the USPTO going to a system simular to Medical patents, where there is an online database of prior art. And most patent reviewers are absolute fscking IDIOTS when it comes to software.

    I wrote them about the "incedent" with MS patenting the CSS2 specs. The fact that they had published the CSS2 spec for over a year and a half before they issued the patent made it invalid. Thank you, billg.

    First off, your generalizing. I don't believe many people actually and TRULY hate.. to the point where they'd track him down and destroy his existance.

    Now, I am not envious of him. Concerning *general* business, I am quite happy that the computer industry has blossomed. However, I think that Microsoft has been especially cruel.

    It's a fairly well known fact that ms paid off editors, columnist, and users to write starbright columns and letters during the OS/2 - Windows wars. Infact, I have read some columns (deep in the back of computerworld and pc-week) that hint extremly strongly at this. Some people have even publically regretted this.

    Secondly, his company is trying to do everything!! They want to write ALL software.. if they could. Actually, they want to write all the software that makes the most money. And they've done a damn good job. They'll leave the scraps on the floor.. literally.

    As from an open source position... well, he don't have no source. MS s/w is generally bad (exception being Office). MS intentionally tries to subvert every standards process.. (recent PATENTING of the W3C CSS is an example. This was an open committee.) and 2/3 of every standard they produce is hodge-podge. (Samba, Direct3D.. exception is dhcp).

    Ohh yeah..

    There you go, going and advocating your own personal agenda. Well, here's mine.

    Actually, I did some research and found some articles on gun ownership. In France, ~25% of households own guns. In Switzerland, some ~45% own guns. In Norway, some ~2% own guns.

    Guess who has the highest murder rate(total muders/total people)? Norway. Seven times higher than France. I think that it has more to do with social and ethical values than a hunk of metal.. myself. Maybe, just maybe.

    For instance, Americans are notorious for fist fights. In fact, most parents see this as an inevitable occurance. I think, having lived in France and the USA, that in France a fist fight would be considered outrageous.

    And when the bad kid grows up to be a criminal, the USA sends him to violence boot camp, prison. Then again, I'd love to meet all those Turks in Deutsche Prison.

    Actually, what I have been working on is a neural network to "decompose" a sound into a "fundamental"(or basically match waves from a table into a given sample wave).. and then storing the wave type, length, and amplitude. Thus 128 bytes of wave could be stored in 6 bytes. The hard part is generating a table of wave types.

    Well, a man named Flesh99. Sorry I am going to ramble, but here is what I question myself about. I must admit, I am at odds with myself sometimes about Free Speach versus Moral Values.

    As a parent, I can see that rating is a precious thing. But - rating is essentially the same thing as censorship.

    - Things which get rated as adults only, (example-NC17) tend to get regulated to dark corners. Content providers will always be pushing the envelope to gain larger audiences.

    - Does your Rated-G match mine? If someone gets hit 2 or 3 times in a story, does the work get a PG-13, when 15 hits gets a rating of R?

    What about existing published works readily available at the library. What about the Illiad?? Do you think the dragging of Achillies is too cruel for a 12 year old? Do you think Power-Rangers should be watched by 5 year olds?? If we have content-rating, then it REQUIRES content rating guides like this. No exceptions... else a NAKED LADY may accidentally peek through.

    What then? Does your child have the moral values to know this is _wrong_ and go somewhere else?? When something questionable comes on TV in front of your children, do you change the chanel?? If you're at a movie, and there are naked people on the screen, do you get up and leave with your children.

    People want others to raise their children. Rating systems enforce material as "safe" and parents believe they can trust it. The "Village" Moral ethic.

    I say that content rating systems for published materials are useless and only provide a political avenue to pidgeonhole and "name" particular groups as dirty, salacious, or unfit for human consumption.

    I would rather spend the time, give the love and values to them, and enrich my own life by learning together with my children. I would also like a cheaper ISP!

    These are just my thought.

    Actualy, I think religion is just a repetitive act of worhiping. (Think regular.. they both come from the same latin root, regularus) So often, "religion" has become known as a brand of faith. Personally, I think that religion is an action. The technique is largly dictated by social whims.

    Well, we can't even agree as to who "invented" the computer.. so that should tell you something. I will agree that they did do some editing. But you should look up information about the Septuagent.

    Dead sea scrolls were found in the 20th century. (1950's??) The dead sea scrolls contain very little of the current text of the bible. We would consider them Gnostics by todays standards.

    And I suppose the fall of the Roman Empire had little to do with it? You know the last emperor of Roma was a chicken farmer? Really. Actually, the Arians (or germans today) were a big reason. Rome had expanded over 3 continents and the Germans would swoop down on their horses and sack rome. Roman accounts written by generals regarded the germans as "Fierce warriors" and the organized Legions had no chance against them.

    I wouldn't get to damn hard on the Catholics for this. Alot of greek philosophy and mythology was saved and lovingly copied by priests during the dark ages. And to think they had the OBJECTTIVITY to copy them so lovingly - even though the greeks were not monotheistic!!

    I my dealings with Catholics, I would find them to be the only religion that has a policy of accepting other religions as true - though somewhat lesser - beliefs. If anything, the social pressures and mistakes in policy of the past have forced them to be MUCH more objective and LESS fanatical than you might think. Having been a non-Catholic(and at times downright heretical!!) at a Catholic university suprised me.

    The 21264 is just better architecture all around. First of all, everything is 64 bit. Secondly, the FP is 10 times faster than the current P3. Thirdly, Compaq now has recently released compilers for Linux that provide an optimal 30% speed increase.

    Probably the best thing is that engineers like alphas, and they like linux.
