On you music issue. I totally agree with you. Napster and Gnutella are good concepts, but the manner in which they are applied in is not. Free music is a good idea. But what must be understood is that it isn't 'your' music.

In this election I have noticed, particularly on this forum, that whenever I speak out in favor of Bush I get attacked. Sometimes personally. I get responses of the likes: "what are you thinking", "are you nuts", "you must be crazy." Why must you all criticize my decisions?

I get attacked on other things too. Like how I prefer windows to linux(desktop). Or how I prefer Novell to Linux(NOS). Or if I had the choice of setting a linux box for a print server or router, that I would rather buy hardware solutions instead. Or that I would rather choose proprietory software versus opensource. Ex. Oracle to MySQL.

    Just me and my opinions.

Napster does have legal uses. Period!

I know it does. But that's not what its primary use is.

Distributing legal mp3's is that reason.

I have nothing against distributing legal mp3's. But napster rarely does this. Napster provides a means to download near CD qulity songs irregardless of whether it is legal or not. Nearly all mp3's distributed through napster are blatent IP violations.

It does not matter that it can possibly be used to violate IP laws.

Your right, it doesn't really matter. But it comes down to the fact that Napsters primary use is the violation of IP.

If that was the case, then pack up your VCR's, tape recorders, and any other recording device you own.

Stupid analogy. A VCR allows you to create a personal use copy. Well within fair use. If you use a VCR to copy and then distibute those copies then your in trouble. But a VCR's primary use is not this. It is bacause of this fact that I side with my.mp3.com and not napster. It is within your fair use rights to maintain a working copy but not to distribute.

They both have legal and illegal uses and it is up to the user not to violate these laws.

Umm. Users are advantageous. Given the chance anyone will dip their hand into the candy dish. You can not expect a user to not take what is free.

I will be the first to admit that I am a blatent IP violator. I download mp3's for my listening pleasure. I do not plan on evaluating such downloads for future purchase. I do not plan on buying any cd's to any songs that I have downloaded. As long as I can download songs and burn them to a CD of my own I might never buy a CD again.

I side with the artists in trying to protect their IP.

I'm not totally sure what you mean? Are you refering to it not being 'physicaly' shrink wrapped or 'legally' shrink wrapped. Either way a plastic 'could' possibily be considered as a legal shrink wrapped means of licensing. But I've never heard of any past rulings on such a manner of licensing.

There is no lecture from a Radio Shack salesguy telling you of the license.

There doesn't need to be any lecture. Your acceptace of the goods is good enough.

You only see the license if you install the Windows software.

Ah, but the barcode scanner and software are intergral. Meaning one can not function properly without the other. In the manner it as designed for.

If you do not see the license, then you cannot agree to it. You don't agree to it, you ain't bound by it.

    FALSE!

By using the product in question you become bound by the license agreement. Regardless of whether you read or agreed to the agreement. Period.

Besides which, license or no, REVERSE ENGINEERING IS LEGAL, no matter what they say.

Says who? Are you absolutely this is the case, no matter what? What are the implications of denying a right in a license agreement? Does this legaly squash the other one. I'm not sure. I've never seen this tested court?

They could include in the license a clause that said "You must give us your first-born child within one year of birth"

They could! Nothing is stopping them. And if you accept the agreement!

but that wouldn't make it legally binding.

Sure is would. It legally binding. But it would be very easily overturned in a court of law.

Remember, just blowing past the license agreement is your choice. But, don't whine when someone finds something in there that you don't like. Hey, you had your chance to back out before accepting. READ THOSE LICENSES!

Admining *nix or NT are both a pain in the a$$ compared to managing a Novell system. Novell Netware is a purpose built product. Built solely as a network operating system. With the new 5.x releases it just got a whole lot better on the server side.
