I seem to recall a court case in which the first sale doctrine cannot be suspended by accepting the terms of an EULA. (Specifically Softman vs Adobe, California)
It's also kind of a good thing that Microsoft has decided to send this 'beta' release to such a wide audience. Those that use Windows SHOULD all be beta testers of the software with the understanding that each successive release should start clean.
I'm sure a lot of the "beta" testers are simply people that are very very hot to try out the new (and supposedly improved) release of Microsoft's new OS.... they often are just savvy enough to format and reinstall windows and nothing else, and don't really know how to 'test' software.
The 'soft machine' concept is really something that users should be introduced to when installing the beta Windows software. A window should pop explaining the concept, and advising that trying to upgrade a beta to a new beta or release candidate could cause massive problems, and the only way to truly experience the improvement of the build is to start from scratch.
Microsoft should continue this trend they started. I believe that with the wide variety of hardware and software out there, it has the capacity to allow Microsoft to build a vastly better product, and understand what it takes to build an OS for the less savvy computer individual.
I just want to say... I have a dual core 2.2 GHz system with 4GB of ram. It's a laptop.. an ASUS Gaming series (I just wanted the 1900 x 1200 screen)-- it has an NVidia 8800 mobile in it. Anyway... it's running Vista Ultimate and it's brand new and I removed all of the "extras" that typically get shipped on the machine. Then, I ran hijackthis and removed all of the offending startup items from it. Then I ran a registry cleanup. Still, after all of that... the machine STILL takes about 2 minutes from boot to stable desktop.
I'm disappointed that I had to pay who knows what amount to license Vista Ultimate... when what I really want is to go back to XP.
I'd run Linux... but not everything is well-supported yet.... some of the newer hardware in that machine doesn't cut it.
UPS has obviously not heard of the "Michigan Left"... whereas getting ANYWHERE will likely require one-- if not two left turns... basically coordinated U-Turns.
Can I get a "hell yeah" from my Michigan brothers and sisters?;)
Okay. Granted. Kevin Mitnick is guilty. Courts say so, Kevin says so. However, he had the right to a speedy trial....which he didn't get. Hardly got a trial at all. And it took 4 years. THAT is what makes him different from other criminals. Plus the fact that he can get free long distance from his jail cell with a plastic straw and a picture of a Hooters calendar girl. (sarcasm)..okay so he's a "hacker" and the government wanted to make an example out of him. Would have worked, too, if so many of his rights hadn't been violated. Spuds
