    I am really suprised that they did not get 20 or 30 letters, all asking for $2,000 per letter.

    No matter how much storage that we have, we will always exceed it. We just have to be smarter on what data that gets stored and how we store it (compression, format, etc).

    Us old timers remember when a 20MB drive was lots of space.

    Learn from them.

    While at MSI, I had the tech support, later became the product manager come to me with, "I know this is a stupid question..". I taught him enough to come to me with a question that had been thought through and in some cases a possible solution. Or, if there was a bug, he would tell what steps to reproduce, isolate, and classify the bug prior to comming to me. In a little time, he started learning alot.

    People don't learn by being told what to do. When people think and understand, they learn.

    Though won't empty the books of a bookstore, you just won't have to wait 10 days for that out-of-stock book. The main benefit of a bookstore, now, is to go in and browse. If you wanted to buy a specific book, you have on-line sellers.

    How long until Microsoft will file a lawsuit and have storm troopers kick down the door? It didn't take the MPAA long to do that. It didn't take Mattel long to do that.

    Will they change the algorithm before the next build? Probably not, their lawyers need the money.

    The linked article is about trademark violation. If the spammer was sending out Motorola pagers, Motorola would have no case. In addition, Motorola has no standing to sue for spam sent to others ( unless it goes through their system or is represented as comming from them). Its legal, and proper, to use a trademark to identify a product or a service. Just like suck sites, XXsucks.com is proper use of XX because they are the ones who suck.

    On the contrary--they hold tremendous weight! An appellate court's role is strictly limited: did the defendant receive a fair trial? Is the law Constitutional? Was the law fairly applied?
    No, the appellate court in a summary judgment will perform a de novo review of the summary judgment. The appelate court will analyze the application of law as being proper or not. Not just the trial being fair, for many times the case would not have made it to trial.

    If you use the school computer running Windows XP to design and build your final class project, lets say, Linux 9.0. Then as about to blast the CD the computer due to a bug known to Microsoft, wiped everything including your tape backup. Because of that, you had to retake the semester, loose $50k in lost salary because you had to delay your new job. Can you file a lawsuit? You didn't agree to waive your rights in the install-wrap agreement.

    Another scenario. You are at the libray, you decided to sell a stock at at $150/share. As you press the submit button, the system crashes. You reboot, now the shares are $95.

    Another. You are at the library. They have Cyberpatrol loaded. You bypass cyberpatrol and ftp the files to your computer at home. You then reverse engineer the product and make post the list on your website and publish a program to decrypt the next list. Where did you agree not to do that? The people at the library did, but you did not.

    Can you be expected to abide by terms of a contract that you never seen and never been made aware of? No, according to this decision.

    Or, almost nothing. This is a federal judge, not an appealate court. These decisions hold very little weight.

    But, this does weaken the glance wrap licence agreements. The click wrap, where you are required to click ok (such as on Windows) will be upheld given this standard. But there is another argument to that -- since Microsoft has refused to make refunds, will that click-wrap agreement be found to be void.

    The other thought is for 3rd party computer usage. You get a system from the company, your IS person agreed, not you. They may have agreed for the company, but what about your personal data (if you are allowed personal use of the computer)? If you use a system at a CyberCafe, public library, school? The agreement to indemnify, not reverse engineer, etc. would be to indemnify the school, etc -- Not the software publisher!

    The talk about nuclear energy is due to the rise in oil prices and skyrocketing prices of power in California. According to Bush, all we need are more electric wires.

    Not allow ads that keep up by trapping the on-close?

    How and who should make these determinations? We have to ask for which limits apply. And then browsers will ad filters for these.

    We had seen this by Mattel about Barbie Takes a Stand. They ignored it and nothing happened.

    But of course, the lawyers will pick on the little guy to send a message to all the other little guys. Like with Felton, the RIAA didn't expect Felton to fight back. When he did, their response was, oh, we didn't mean it.

    It is SOP of many companies. This is more true when there is a questionable or non-violation. They will blow more smoke, try to intimidate more than when there is a valid claim. They do this to scare others -- look at the MPAA and the RIAA.

    According to Microsoft, Open source is viral. Therefore I doubt that they will allow it .net to work with open source. You can get (or used to) source code for MFC, but you could not build it for any platform that Microsoft didn't already have it on. We have seen M$ block competing OSs, why would we think this would be any different?

    But, the piece itself is misnamed. It should be called, "better advertising". This is more about having people pay attention to what you are hawking, not how to get people to pay attention to what is important.

    Actually, there is a NY case on that issue regarding libel on a website. The court ruled that the time ran from it being placed on the website. This is something that I expect that the circuits will split on.
