    Legality Issues
    • Making 'kiddie porn' IS Illegal in the USA - so go after the offender

    Moral Issues
    • should we keep someone from viewing it - why? we allow people to imitate a man who tortured and killed people (Hitler) - It's Called Freedom people
      1. your free to use drugs just don't get caught - it's illegal
      2. your free to drink and get drunk - just don't drive afterwards - it's illegal
      3. your free to run through the streets naked - just don't get caught - it's illegal
      get the point yet?!?

    The point is instead of our govenment dealing with the issues, they enrage society into giving up their freedom. Ask people you know if they want communism and they will tel you - No. Then ask them if the goverment should provide healthcare,welfare,social security etc. and they will say - YES. Well people you can't have it both ways! No matter how repugnant you feel that someone elses beliefs and/or desires are - it is their right to choose those things because of thier freedom of choice.

    Some people in this thread have complained that comments that address fredom are offtopic - I say to them - WAKE THE F*%K UP!!! It's all about peoples freedom.

    While I want our 'next to useless' law enforcement to find and prosecute all of the offenders, don't keep anyone from their freedom to go looking for it.

    Excuse the topic but, what about the woman who shaves herself then goes to a nude beach - is she attempting to look like a young girl and make others think she IS a young girl?? The next step will make That illegal too.

    Maybe they will decide that Open Source Software is immoral and force sites related to it to be blocked? (Hey - M$ has enough lobbyist dollars for it). Wouldn't that be violation of your freedom.

    Maybe all people should have their age tattooed on their forehead so everyone will know a person's age - Now we took a Woman's freedom to lie a little about her age away from her - but hey it's okay - it's for a good cause right ?!?

    In your second example there is not recourse because you agree with thier user agreement that will tell you there is no guarantee on the amount of Bandwidth you get. However, you could document that you never reach the amount they claim to offer and then file a criminal complaint for Theft By Deception, False Advertising, Fraud, etc.

    IANAL - but...
    I just finished reading all of Buckeye's Terms of Service (pdf) , Acceptable Use (pdf) , Residential Agreement(pdf) , etc. Nowhere in the text does it say that you have a limit on the amount of bandwidth you can use nor does it limit the type of use other that 'illegal activities' (Warez,etc.). I'll be interested to see what type of charge they come up with. It can't be theft of any kind - unless they didn't even subscribe to the service.

    This is just another example of Cowboy police (local,State, & Federal) not even researching if any crime was committed before reacting. They are just trying to intimidate citizens and use gestapo tactics. I think we all should let both the company and the law know how we feel. Then these people should file a class-action lawsuit against them.

    First let me say that is has been awhile since I was writing Winblows code; however....

    M$ claims Winblows to be a pre-emptive kernel. This is true and not true. It is preemtible because any task can make a 'critical system call' and get control of the system. Gee, that's great right?!? NOPE! Take a winmodem for example, try moving your mouse while it dials the phone or finalizes the handshake process. The mouse pointer will freeze on the screen! It's because the device driver make a crtical call and until the userspace program releases that lock it has total control of the system. M$'s own programmers reference material tells programers about this and recommends that programs exit that mode as quickly as possible. That makes it NOT a premptible kernel.

    I wanted to duble check myself before I relied to your comment regarding 1.3 and 2.0. So I contacted a good friend of mine - one of the Apache Core Developers.

    While 1.3 versions are considered generally stable it *is* still a development tree. The current released production tree is still currently the 1.2 tree. The latest production tree is 2.0 tree but it is just beta recently therefore NOT stable.

    I guess the biggest thing for all of us to keep in mind is that stability is more subjective than development vs. production. Both my and his general rule of thumb with UN*X/Linux software is 'even' eq 'production' && 'odd' eq 'development'

    For example, why do you put USB support into the kernel? Cant this be moved to a driver or external module or something? The same applies for file systems etc.

    Uh... You can compile USB and many other parts as a module.

    I've noticed that most of the comments both in the article and others complaining about the 2.4.x kernels and various stability problems are running RedHat, Mandrake, and even Debian Distros. Hell my best friend even like RedHat best. But that something that we and many Linux people will argue/discuss until their blue in the face. I have used just about all the distibutions from time to time. However I have prefered Slackware since I started with Linux in late 1994. (Boy have things changed since then). What's my point? Many if not most of the problems people are having can be traced to a few reasons:
    1. running a distribution with bad compatiblity between libs,tools,compilers and the kernel (i.e. Redhat 7.0)
    2. upgradings the kernel without regard to upgrading libs,tools,compilers, etc.
    3. upgrading for the purpose of upgrading's sake - no real reason.
    4. Not that much knowledge of what's really goining on in their machine.
    I have set-up enterprise level production servers on Linux for many years and haven't ever <knock on wood - my head > had stability problems. I know of 4 Servers runnig at my most recent employer that have been running 2.4.x Kernels since they were put into service and have never crashed or even hiccuped - over 2 years ago. They are running Oracle, MySQL, Apache with multiple modules, Perl Apps, Samba and NFS filesystems, and other stuff I can't think of right now. Why haven't they had problems -
    1. Good STABLE distribution
    2. conservative upgrades (2.4.1 to 2.4.5 to 2.4.12)
    3. running in test before placed in production
    Eveyone seems to think that with a kernel from the "stable" tree you shouldn't have any problems whatsoever. Keeps in mind that the kernel alone doesn't make the OS the user space tools are also part of it. Therfore running a kernel in the 2.4.x tree and bleeding edge alpha versions of user space software and server daemons != a stable system necessarily. How many people are running a version of Apache in the 1.3.x tree? Well if you are that's a development tree and not necessariliy stable. Yes there are stable versions, but you must test! Also remember to separate device drivers from the kernel. Just because many are distributed with the kernel doesn't make them part of it.

    The other problem I've noticed that started with the 2.4.x tree was the 'ac' or Alan Cox branch. Don't get me wrong I think Alan has contributed meny good thing to the kernel; however, I do think Alan has gotten to feeling a little to self-important to Linux's success. Also keep in mind that he works for Red Hat now and everything I've seen with Red Hat's politics is they want to "control" Linux. So, I say stay away from any '-ac' kernel. But that's just my opinion and I could be wrong.

    As far as the 'new' VM being put into the 2.4.x kernel - I don't completely agree or disagree with it being done when it was but there were various reason to do it then. I was holding up some important things and the kernels wasn't ready for a 2.5.x tree yet. It was a hard decision on Linus's part but not one I'm going to second guess.

    Don't get me wrong. you can get a stable machine with just about any distribution; howver, I have found, from experience, that Slackware has a track record for being the most stable 'out-of-the-box'.

    Also keep in mind that with Winblows you'd be rebooting every 14 to 30 days. Even with 2000 and XP.

    On the other hand I still have one box at home still running 1.3.72 with an uptime of over 3 years. It's running as my router and is my experiment on just how long with a Linux box run without crashing.

    I live in a suburban area right on a state highway about 10,000 feet from the CO and have digital cable from Comlast (I mean Comcast). So what do I have to bitch about - right? I can't get DSL except for IDSL (ISDN rebranding here), I can't get a Cable Modem connection, I can't get WDSL, I can't get 2way satellite. In short - I can't get s**t but dial-up. BTW - the dialup usually only connects at about 36K regardless of ISP. Why you ask -

    • DSL
      • Verizon (Bell Scamlantic at the time) decided to use fiber from the CO to various areas then covert the Fiber to copper - this was supposed to get our area the newest technological advances faster
        Keep in mind that DSL only works over copper - So I'm F**KED
    • Cable Modem
      • Comcast has promised Cable modems would be here in the next 3 months for the past 2.5 years!
      • They claim to be upgrading the cable system and did run new Cable to my area - 4 months ago!
      • This is supposed to explain all the outages we've been having
      • The latest time estimate is April but the estimate next door neighbor got was February - HMmmmmmmm....
    • Satellite
      • You have to get one of their 'certified installers' install it because it transmits to a satellite
      • There aren't any dealers with 100 miles that offer this service here - AAAAARrrrrrrrrggghhh!
    • WDSL
      • Wireless DSL seemed to be the salvation
      • The only provider doesn't offer service here because it requires line of sight and there are hills here
      • They also aren't providing coverage here because Comcast is getting ready to offer Cable modems - NOT!
    • My Dial-Up
      • Bell won't do anything because they only have to handle 19.2K on analog POTS lines here
      • Nuke The Bastards!


    I own my house and for various reasons can't move right now (Ex-Wives SUCK). So what is my solution?!?

    I want to know if anyone else is in this boat, Send me an email. I'm going to try to work on a solution with the Alternate local phone companies. I've been speaking with mine here (Cavalier). If you live in their area - I highly recommend switching - Thier website

    I especially want to hear from others in Chester County, PA (where I am) - that want better internet connections. Cavalier tells me if I can show them enough potiential customers they'll try my idea. Keep in mind that I will not release anyone's info to anyone without the explicit consent (even if they torture me).

    Try dubbing a VHS tape for backup purposes (They do wear out). It'll work today for most tapes.

    Also take a look around there are still many 'testing' devices for macrovision enabled media.

    While I was sitting here reading the comments, I realized that we have all seen this before.

    The software industry went through this many years ago. They started with simple copy protection using 'bad sectors'. It was countered with various copying software. Then they added microscopic laser burned holes in the disks. That was counterered again by copying software like CopyIIPC (boy am I dating myself). Some tried various codes such as serial numbers and books with codes on certain pages. The algorithms were simple and the books got copied. Then most if not all but M$ gave up. I became too costly to keep trying.

    Next was the movie companies with trying to copy protect video tapes. Very quickly there were companies making devices to circumvent that as well. Even magazines like Radio Electronics were publishing articles on how to build them. Then most gave up as well. Again too costly to keep trying.

    The various movie stations like HBO, etc. tried too by scrambling their satallite transmissions. that too has been easily defeated and they are beginning to give up as well.

    Cable companies tried it too when they were charging for each set connected. They were defeated as well. Then the government decided it should work like phone service and they could no longer charge for each set but only a house connection. (I'm glad someone sued them)

    So I say let them keep trying to copy protect their CDs. It'll cost them more and more money and it will get feated time and time again. The focus should be on stooping them from getting this royalty on blank media. In 1992 there weren't too many people using CDs for anything but music. Today there are - computer software, Backups, videogames, etc.. They sould NOT be able to make money from something that has nothing to do with their business. That is the message we need to get to Rick Bouche.

    The Real problem with a LLC corp is that not all states recognize it as a corporate entity currently. Therefore you could find yourself in court without any corp benefits at all.

    That's one of the advantages - no 35% tax for the corp then personal Tax

    From my many years in this business on both sides of the contract, here's the deal.

    1. Corporation
      • Be sure you create a 'S' corp better tax advantages - details see tax laws or accountant
      • You have a layer between you and the client in case of lawsuit - However *very* thin
      • You will have to pay corp taxes as well as individual taxes
    2. Sole Prop. Business
      • You get all the deductions availible on Schedule 'C' for taxes - VERY beneficial
      • You *should* still get paid at 100%
      • You could get sued directly
    3. Employee - W-2
      • Normal taxes etc. - (will be more than Sole Prop.)
      • You may get woker's comp etc.
      • You may get benefits
      • Safer but you make least of all choices

    The long and short of it is which makes you more comfortable. I you always perform honorably then you should have no problem with Sole Prop. method and you make the most this way.

    ... is the undertrained (not their fault) man/woman in the blue shirt at Best Buy.

    I know this *is* offtopic but I could resist when I say Best Buy mentioned. I was in one recently looking for a printer for my father. The guy tried to tell me that instead of buying a parallel port printer I should add a USB port to my father's computer and get a USB version. Why? Because parallel printers won't be made or supported after December 2001.

    Keep in mind also that my father is on Winblows 95 and uses old DOS apps (He refuses to change)

    I work in a management role in IT and am constantly listening to the Linux is bad, MS is god mantra. Even in the advent of XP.

    I was interested to see that it appears that MS marketing even sees that XP is a hard to impossible sell. The memo suggests selling Win 2000 in place of Linux and makes no mention of XP.

    While I find it interesting that I wrote an article a few weeks ago about KVMs that "rejected" - I will let you all know that I got a KVM package from www.iogear.com that was great
    • It works GREAT
    • It included 4 sets of cables
    • It was under $150 (including mail-in rebate)
    BTW - I saw a post earlier about the scroll not working on someone's mouse - mine works fine.

    OT: I'm beginning to agree with those that say the /. guys are getting overinflated egos. Come'on guys stop blocking users articles!

    I don't think the issue is having outrage because of a desire to "infringe" or not. The *REAL* issue is the fact of a business attempting to hinder our constutional rights!
    IANAL but I don't think that EULA would be enforcable. (Any Lawyers - help here) I may not agree with a particular porn site but the guy has a right to create it and the other guy has a right to browse the site. (So long as the models are of legal age).

    People, mainly here in the USA, are tooooo accepting of someone infringing on people's right as long as they aren't affected.
    I'm not trying to do a Dennis Miller but, they infringe on Smoker's rights - it's okay because I don't smoke.
    Infringe on a gun owner's rights - it's okay because I don't want a gun and nobody should have a gun (Until only the criminals and police have them).
    They tell you an unborn child isn't a person but kill a pregnant woman and you get charged with 2 murders.

    When do WE say ENOUGH!

    The point is: Think of the effect on others not just yourself before forming an opinion of right and wrong
