    Second, having never committed a crime more than perhaps checking out a book there before buying it from Amazon.com, are they entitled under the law to scan and process my image without my permission ?

    I never speed, but the cops at the speed trap don't care, they point their radar guns at me as I drive pass. What's the difference?

    Mob rule, yeah thats the way to go. Change the laws by breaking the laws. The end justifies the means. What a load of crap. It would be different if we lived in a society where the artists could go off and not worry about the mundane things like buying food, paying rent, paying bills, paying for studio time, etc, etc, etc. But we don't. So either they have enough resources (money) to do fund their work themselves, or they rely on the money they made from their last work to fund their next.

    So, who do you think will feel it the first and feel it the most when you start to "Download it all and copy it all"? The artist. They make their money off the stuff you are downloading and copying (and not paying for). Yes, they are making only a tiny fraction of what the RIAA is taking in, but you are still stealing from the artist.

    Two points...

    One, get a better analogy -- if you can't use your hands well enough to use a computer, then you won't be able to flip burgers... :^)

    Two, if you can't do the job -- for whatever reason -- then you shouldn't have it. Yes, that is kind of harsh, but take another example. A brilliant surgeon loses the use of his hands -- would you still let him operate on you? Would anyone? Should his hospital be forced to keep him employed in the same position?

    In the United States, there is a presumption of innocence.

    Then why is there a cop on right next to my freeway entrance with a radar gun? I don't speed, yet every time I drive by him, he points it at me. Same with that damn speed bump on my street, no matter how far under the speed limit I drive, I still run over it!!! WTF?

    This would work if you had somehow legally protected NetBSD, and Dolby was using it in violation of those terms. Otherwise, how could the restrictions be enforced?

    And yes, it is a childish suggestion. Dolby is exercising their legal right to enforce their patent. Dolby didn't say that ac3 couldn't be used at all. They said it cannot be used without a proper license. How is this different that requiring the GPL to be included when redistributing a piece of GNU code?

    Is there any evidence that the artists actually want their stuff traded for free? Or are we imprinting (that's not the word I'm looking for) our "information wants to be free" mindset on them?

    We all know that the RIAA is against this, but what about the artists. There are artists that have come out against it (Metallica), and some indepentants that are for it, but I never got the sense that there was a prevailing opinion either way.

    Maybe its something I missed.

    A friend and I were about 13 and his parents rented a Winnebago to take a trip. They asked me to come along. One of the stops was in Las Vegas (only 2 weeks before the big MGM fire). We walked into the upper floor of the Circus Circus and that was where I saw Asteroids for the first time. I was never really good at it, but it remains on of my favs.

    I can't imagine the kind of outrage the American Congress would be expressing if an American programmer was being held in jail inside of Russia for a law which does not exist in America.

    I am not sure I agree here. If you travel to a foreign country you should be bound by their laws, not ours. Using the same resoning, if a native of the Netherlands comes here and picks up a prostitue then there should be no charges brought against him -- prostitution is legal in his homeland.

    All that being said, the DMCA is horribly flawed and should be removed from the books.

    What a load of crap. The vast majority of computer users out there fall into this catagory. Its not laziness, or stupidity or anything else, they don't know because they have other interests. To them, their computer is a tool, and not a lifestyle choice. The idea that everyone should have wizard level knowledge it ridiculous.
