    It does occasionally happen.. I guess in my tired stuporr last night I didn't explain properly..
    While we called it firmware when we dealt with it, the provisioning file is more of a lock
    file requested at each boot of the modem - each time you power cycle the modem, that file
    isn't saved, and needs to be downloaded immediately after ranging is complete (when your
    send/receive lights finish coming up, signaling the power was properly set to
    send/receive, and the basic data link to the head-end was set up.) - I remember back in the
    day before the docsis ver.1 spec was created (when Motorola Surfboard was actually and SA
    brand..(2100/4100 series) when you could plug into the console port on the back of the modem,
    and change your speed whenever you like through telnet.. ahh those were the days.. (This
    was in one of the first cable hsd areas, northern VA, ~1995

    You're almost correct - As a former Time Warner Cable NOC engineer, I have some experience in this area..

    The headend systems that the cable modems are provisioned with check each modem periodically for their bin file name (provisioning file name) along with a crc on that file to ensure no one is tampering with the works.. There are easily ways around this with hacked firmware, etc, but the only people who would even attempt to circumvent the (still fairly simple) checks are the type of people reading this post :)

    Each time CPE is powered up, or added to the network, if the MAC is said to be correct for that account, then the modem is sent the firmware file for that account's provisioned speed. Many of the hacks out there in the wild don't accept that re-download, and the hack then fails, as the MAC addy is cut off until it does accept the download after ranging is complete..

    Not at all - I'm a middle of the road kind of person.. I tend to hold both sides accountable, and don't give free passes because of -any- political side.. I simply meant that anyone that currently uses the excuse "He is crap because he hasn't done anything" isn't remembering when it was someone else's turn last time, they weren't singing the same tune.. That's all.. Apparently someone didn't get the point, as they modded it flamebait because they either didn't understand the point, or didn't agree.. Another wonderful slashdot mod moment..

    Considering the first year of his predecessor, not doing even one thing could actually in theory be considered doing the right thing at this point..

    It seems just, oh, 8 years ago, that people were saying the president wasn't doing anything, etc, and everyone cried "he's just getting started!" - Now those
    same people who cried it out back then, are on the other side this time accusing Obama of not doing anything yet..

    This would be similar to the "No baseball caps" policy with some bars/clubs in the US - in some localities it's considered a symbol of gang activity, etc.. (Also some clubs in urban areas ban sweatshirts, etc, with certain gang-related colors..

    They are placing them elsewhere - They throttle the bandwidth at either the account level, or through throttling the hosting boxes.. "Unlimited" means no stated plan limit, not no limit.

    I'm speaking as the current owner of a regional hosting provider in the north east US.. We don't play with this kind of pathetic marketing bait and switch crap... You can't get any more misleading

    This is the same as the Cricket USB cell modems saying $40 a month for "unlimited" use - then the print at the end states that they will throttle you to a crawl if you go over 5 gb of
    throughput (up and down) or throttle you at any time if you cause any adverse effects on their network. In other words, they will throttle your "unlimited" data plan for any reason
    they want to, and promise to by the 5 gb mark..

    Not exactly true.. Buffalo and Rochester tend to have better tower access via leased sites that at&t uses, vs Verizon..
    Between Buffalo and Niagara Falls for instance, Verizon Wireless (local tower owners dba vzw) have been using most of
    their upgrade budgets to add more Canada facing equipment to help get international roamers..
    (from a current NOC operator that works for the dba in this area)

    Verizon can't even get their act together to get FiOS run to the major towns around Buffalo properly..
    (6-7 more years before fiber is put down to a town 4 miles away from the city is crazy, even by 2000 standards, with the
    tech from back then..) And no, there are no local laws/etc that they need to follow for it - it's just their schedule..


    Speaking as a former network engineer for att/cingular (before the second back-forth name switch back to at&t) I remember
    a few years back when they got pissed off at Alltel because they raised the leasing rates for tower access to att/cingular in the
    FL and AZ markets - two weeks later, att/cingular killed the lease agreement, and all access overnight was terminated to all
    att/cingular customers in the northern FL and all of AZ markets - I was one of the people "hitting the switch" to turn off access - The
    customer service call centers were then told to tell customers "We're sorry, but the carrier in your area that owns the towers has
    disabled access. Should you decide to cancel your service (their phones ALL went to "pay by credit card, or collect" roaming menus)
    you will be charged your early termination fee, as it clearly states in your contract that we do not guarantee service"

    Welcome to the reason why I quit a 90k position a week later. My actual center I worked at was the first floor of a call center in
    Harrisburg, PA (part of first floor was network ops, part of second, all of third was customer care) - The center manager even said
    in one of our ops meetings that there would be lots of pissed off customers, but that would just mean the company was going to
    make a ton of money with early term fees.. (his actual words) - When business is run with no morals, bad things happen...

    Speaking as a former (thank god) district geek manager, there is a hell of a lot more copied regularly from customer pc's than just porn..
    I've fired services techs (now called "geeks") for making copies of personal data including bank/money/quicken databases, address books, etc..

    Acting like adults = severe lack of press coverage, or only coverage for verdict notices, etc.

    Even if it's a very stupid move on their part, they are getting more coverage with the added idiocy, even if slightly more..

    I don't remember the last time civility brought about major change (heck, just take a look at most attacks with any form of politics, etc..)

    Maybe they don't want to act like the 'tards that handled the Napster demise.. Oh yay! Now Best Buy owns that brand!

    The OP is asking about being charged with anything just because the "door" wasn't on the "house" to keep them out...

    That's a little like saying "Can someone be charged with stealing a bike if it was just sitting up against the front of the store while the owner was inside the store.."
    Just because there wasn't a safeguard in place (supreme dumbasses? Why yes!) it isn't a valid legal argument (at least in the states) to plead ignorance to the
    effect that you still stole the bike, even if there was no lock securing it..

    It might be an interesting place to live if everything could be played with/used/stolen
    as long as it wasn't secured..

    As always, I may know nothing about anything, ever - and don't smoke crack.

    It amazes me how people tend to think that just because our US government tends to do stupid things once in a while (ok these days a lot..) and the
    masses think it is the general every-day American citizen that is at fault.This is the same for most governments - You elect the people who make promises
    to fix this, that, whatever - or to keep the current principles at the top of the collective list - Sometimes they do what they say, sometimes they run into much
    much more resistance than they thought they would before they actually got into that glass box, and sometimes they flat out lie to get elected.. As it happens
    to be, the US government has had quite a bit of world power, so it's easy to make dumb statements like what you just did. If it wasn't the US at the top of
    whatever, it would be another country, with people saying the same thing about them when their government gets high/mighty/power hungry, etc..

    I doubt if you are in another country, your wondrous land is universally liked by everyone. Stating that people hate US citizens everywhere is ignorant.

    It's that ignorance that tends to blame all citizens of a country because of something stupid their government does (btw, they do the same to their own people buddy..)

    re-read what the post said again - If Ham operators can't use their equipment in the SW band, the numbers of active operators will drop, and so will the amount of people with the equipment... When the power goes out due to some disaster, there will then be less people that are able to get out with Ham.. The comment had absolutely nothing to do with interference during a disaster - it was referring to less people being able to get out due to many of them giving up due to massive interference during non-disaster times..

    I'm by all means a fan of Google over Bing, but the above logic is ever so slightly off, considering the history of the search engine battles..
