In theory the individual States were free to ban any type of speech or certain religions, courts were free to order speech limits, the President as Commander in Chief to limit speech for reasons of national security etc.
I believe the 14th amendment deals with the states. And yes, "national security" provides a nice way of circumventing our enumerated rights, but it is totally bogus, but they have bigger guns, so there's not a lot we can do about it. Might makes right, and all the human philosophy is pure show.
...but upon probable cause, supported by Oath or affirmation...
A slimy, slippery fish that one is. Notice that the First Amendment contains no such bullshit qualifications, yet we allow that one to be thrown in the toilet every day.
If you want to know how well term limits works, you should read up a little on Mexican politics. It's not called the Institutional Party for nothing.
Lessig's position is bullshit. He want to stomp all over the 1st Amendment. Money has no influence of its own. It's people's desire for it, and that is not being addressed.
...a jurisdiction untouchable by DMCA and other thuggish regulations...
does not exist, not on this planet. You can bet that, if it came down to brass tacks, nuclear weapons would be used to enforce copyright when more conventional methods fail.
There is no possible fix for the DMCA. It is working exactly as designed. The better solution is to elect people who will repeal the law. Aside from that, the fine should be a million per infraction. $10000 won't stop the big offenders. And aside from that, we need an internet that can better resist censorship and tracking. As long as it is possible to vote away our rights, we need technical solutions to make it impossible.
I don't ever want to see the ability to delete or edit comments once they are posted. Google is right on this, I certainly hope they carry on in this matter until the law is repealed or other indexers come online to get around it. Censorship is evil, always. It is invariably a tool of despots.

Don't expect them to say nice things about the NSA. Sounds like a regular turf war to me.
Our entire economic and political systems the world over are faith based. It is imperative that things remain as they are, or there will be chaos :-/
Yes we know. We've all discussed this a very short time ago. The intellect serves the primitive brain.
Yes, you are wrong. All sorts of nasty stuff grows between connectors like barnacles.

You mean like the US... and every other country on the planet? Does anyone notice what happens to people that try to expose corruption?
Use railroads instead. It's much easier to automate. Mixing human operators and autonomous machines on the highways doesn't sound too palatable.

Beats the hell out of prohibition. Maybe you should study how well that works also.

There are very few countries where the public gives a shit.
I can't name one. Can you? The "public" is more fascist than their damn governments.
that people find any kind of censorship acceptable. Savages, all of them.

Was that part behind the paywall?
Do I get to smoke a joint first?

It only means you don't really own your property. You are leasing it from the government. That's insane.
Public opinion needs to be turned against anything (such as the bill of rights) that could hinder the authorities.
So - all in all, the tremendous snooping effort is not showing much result and essentially being a flop.
For whom?

We need a system that blends in better with regular traffic.
Not until we get IPv6, which will tattooed on your arm.
Petitioning is masturbation. Vote the fuckers out!
