Really, only he should be punished. But in reality, bribery is highly rewarded on both sides. The law seems to be only relevant as a weapon of blackmail to ensure full cooperation. But no matter how you look at it, the taker is the offender.
Powerful politicians have a lot to hide, from the public, and from their spouses/mistresses. Blackmail is probably the prime motivator in politics. It's just the nature of the business.
