    True, but my statement speaks more to why authorities have ultimately left it alone, despite it's user's offenses. There are too many examples of systems that did much good for the world that were snuffed out due to a few abusers. USENET is one of the systems that has stayed afloat despite it's abusers.

    I fully concur with you on the wonders of usenet. Talking about it now brings me back to the excitement of catching up on posts, killfiles and intelligent discourse via the amber glow of a terminal.

    From a time before binaries and spam were rampant comes a far-reaching and informative paper entitled Obscenity and Indecency on the Usenet: The Legal And Political Future of Alt.Sex.Stories

    And here is a relevant quote:

    "Generally speaking, government regulation in this country seems to be most effective only when dealing with large, centralized entities (such as corporations). These entities need to pay taxes, file documents, utilize the courts, etc. These entities are also willing to put up with a number of impositions because of their overriding interest in attaining profits. However, when we are dealing with an entity that is not driven by profits and a decentralized activity that has no real controlling agent (i.e., the Usenet), the regulatory system seems to break down. The only channel of consequence to the Usenet is one of existence. Its demolition (perhaps the only real regulation available) would be a regrettable loss to society.[ 59 ]

    Moreover, even though banning the structure of the Usenet could technically be instituted in the U.S., its center of gravity would most likely shift abroad and be imported through Telnet or other methods. In that case, as with any undesirable overseas activity, a customs system could be established if there was a strong enough governmental interest. However, such a system would pose a huge burden to the international flow of information. Certainly, the argument could be made that the U.S., in implementing such an Internet customs system, might be crippling itself economically for the commerce of the future.

    Finally, one should note that the regulation of the Usenet by foreign nations can potentially affect Usenet services in this country. For example, a German prosector in Munich ordered CompuServe to discontinue service of over 200 "alt.sex" and related newsgroups on charges that they contained illegal pornographic material. [ 60 ] Since CompuServe lacked the technical means with which to tailor Usenet content simply for German subscribers, the company blocked access to these newsgroups for all of its subscribers worldwide. [ 61 ] Although CompuServe corrected its technical problem within a matter of weeks, the incident received tremendous criticism domestically. [ 62 ] One source even characterized the event as "the most dramatic and far-reaching attempt to restrict the free flow of information online." [ 63 ]"

    All that and I still firmly believe that the only reason USENET hasn't been shut down is because its too good a source of leads for catching Child Abusers/Child Pornographers -- if USENET went away then those criminals would just be driven further underground and would be harder to catch-- plus, thanks to USENET, the FBI/et al can maintain a regular series of arrests by simply perusing USENET every now and then, finding someone who hasn't masked themselves well enough and arrest them.

    Yeah. Imitation is the sincerest form of flattery huh? So Microsoft really likes Arlo Rose and Perry Clarke? Lest we forget that the Apple Widget Dashboard is a "total rip-off" of Konfabulator. Though there are dissenting views on this.

    I used to feel bad for the Konfabulator team until they were bought by Yahoo- they finally got the attention they deserved.

    All this and not one complaint about the fact that OS X gives up too quickly when copying filenames too long for Windows over to a Windows share? I was hoping someone would post about this so I could see someone reply with a solution because I have yet to find one :(

    The problem is that if you are copying a large number of files to a Windows share from a Mac and ONE of those files has too many characters for Windows then OS X gives up on the copying without giving you the opportunity to skip the file with the invalid name.

    Has anyone found a solution? I would definitely be happy to have the option to skip files with long names and be able to continue copying the group of files I need. Bonus points if afterwards you get a report of the files that didn't copy so you can possibly rename them and copy them afterwards.

    I don't understand how Wal-Mart has so much influence over all this stuff- I mean, I never buy anything from them on principle, so how can they be staying in business?! It boggles the mind!

    Wouldn't a Disney acquisition eliminate the possibility of working with NBC's shows on iTunes, or working with Viacom/MTV?

    No, it would not eliminate the possibility at all. The easiest way to explain this is by looking at the wealth of shows that are produced by one conglomerate yet air on other conglomerates (and don't even get me started on syndication). Here is a short list of classics:

    House (NBC-Universal produced but airs on FOX)
    Scrubs (Produced by Disney's studio Touchstone but airs on NBC)
    Buffy/Angel (FOX produced but aired on WB and UPN)
    West Wing (AOL/Time Warner produced but airs on NBC)

    etc.

    The list goes on. The point is that just because content is produced by one conglomerate doesn't mean that the possibility of having another conglomerate distribute that content has been eliminated.

    So regardless of what happens in this case you can expect that the possibility for other congolemerate's and independent's content to appear on iTunes is still very much in play. (Note that NBC was the last network to move into a conglomerate that included production, so they are/were more likely to air content produced by other conglomerates).

    I swear on Howard The Duck that a significant portion of new pc purchases these days are because of malware infestations. Computers these days are fast, but not fast enough to browse the web while being ravaged by all the malware a typical user will pick up after a year or so of web browsing (or in some cases minutes of web browsing).

    And here's the kicker-- typical users don't even know what they are dealing with. Many new pc purchases will come from those that believe their malware-slowed computers have simply become "obsolete." Now Vista will give them yet another reason to buy a nice, new, shiny and fast computer to replace their old, aging and slow 3.2ghz Pentium D.

    Or, Howard willing, they'll buy a Mac.

    Very good stuff. That stuff about a touchpad with slip covers reminds me of the atari 5200 controllers... I would prefer to see a touchscreen that doesn't need overlays and something with haptics for example sounds sooo awesome. I think a gyroscope would be useful for not very sensitive, yet somehow useful EXTRA DIMENSION of control but not for main control for the reasons you listed there.

    Of course what I really want is the Nintendo ON. But we can only dream of course.

    As far as the Gamecube being a flop I have to wonder how well it would have sold in the pre-playstation era, before gaming was "cool" and mtv-ified. I don't think the people who were brought into the fold by Sony's marketing in the 90s would have ever bought a Nintendo or cared about Mario, so is it such a bad thing that those same people still aren't buying a Nintendo console?

    Hasn't Nintendo sold more Gamecubes then Microsoft has sold Xboxes worldwide?

    Sorry for the late response, hopefully you won't miss this post :P

    Another great post sir, very very insightful and informative stuff on all counts. You really know your stuff!

    Though the link I posted was just a Gameboy emulator, not a GBA emulator :P Maybe someday they'll figure out how to pull off GBA emulation on the iPod but they are still struggling to just get GB going on it :)

    So while I've got your attention, I'd love to hear your thoughts on the Nintendo Revolution "mystery" controller.. care to speculate on it?

    I agree with you that using the full screen is more important then stylus support! I said "stylus/etc" but by leaving the other features out I was just trying to not be redundant rather then rate their importance.

    You're right though about them probably not messing with it... being compatible with so many consoles all at once is awesome... heh.. when do we start seeing people putting play-yans in gamecube game boy players and making a Nintendo HTPC? :P

    As it is now people will likely be able to use existing podcatchers and vidcatching clients with the play-yan and just sync to the SD card, so wifi syncing of podcasts/etc isn't really neccesary, but would be cool.

    HOWEVER I would LOVE my iPod to wirelessly sync and if Nintendo were to do this with the Play-Yan I think we'd see Apple push that feature through pretty quickly given the large GBA install base and that with the Play-Yan Nintendo is effectively competing with Apple.

    Now just to confuse things further I think I'll link to the GameBoy emulator for iPod!

    Well it's because podcasts aren't necessarily in MP3 format. Many are in AAC format.

    Then again not all podcasts are heard on iPods, so what can you do? :)

    DAPCast fails I think because it doesn't incorporate video. DVPCast? Negative. Podcast works for videos too (and there are video podcasts!)

    Good post. I wonder if Nintendo has any plans to extend upgrade the Play-Yan to take advantage of DS functions like the stylus/etc in order to better compete with the M3?

    Not to mention the possibility of WIFI connectivity with the Play-Yan. Imagine streaming podcasts, videos/etc over wifi right onto the Play-Yan. HOT!

    According to my sources they are working on an RSS feed. Best thing to do is to post comments on the the producer's weblog with requests for a feed. That way he can try to light a fire under Nintendo to get one set up faster!

    I was surprised at the quotes they managed to get as well BUT if you look at who produced the show it explains alot- Carl Franklin's PWOP Productions produced the show and I'd say that Carl is one of the only folks, besides Adam Curry, making real money off of podcasting-- he's earning $120k a year in sponsorship for his .NET Rocks podcast and has been doing podcasts before the word podcast existed.

    If you get someone who knows what their doing behind a microphone it's definitely possible to get good quotes from people. :)

    From the wikipedia article you linked to:

    "Possibly the first use of the term podcasting was as a synonym for audioblogging or weblog-based amateur radio in an article by Ben Hammersley in The Guardian on February 12, 2004." Adam Curry didn't event the word, but he did help popularize it.

    What's interesting in light of all the talk these days over the term "podcast" is that many of the people who were doing it back in 2004 resisted people calling it "podcasting"! In fact there was an ongoing bet between the original hosts of the Engadget podcast as to whether or not the word "podcast" would stick or not. Well. The rest is history.
