    Article XX. [Obligations concerning technological measures]


    [Parties shall provide adequate legal protection and effective legal remedies against the circumvention of effective technological measures that are used by performers, producers of phonograms, or broadcasting organizations in connection with the exercise of their rights under this Agreement or the Berne Convention and that restrict acts, in respect of their performances or phonograms, which are not authorized by the performers or the producers of phonograms concerned or permitted by law. ]

    [ In order to provide adequate legal protection and effective legal remedies against the circumvention of effective technological measures that are used by authors, by performers, by producers of phonograms and their successors in interest in connection with the exercise of their rights and that restrict unauthorized acts in respect of their works, performances and phonograms, each Party shall provide that any person who

    a) knowingly, or having reasonable grounds to know, circumvents without authority any effective technological measure; or

    b) manufactures, imports, distributes, offers to the public, provides or otherwise traffics in devices, products or components or offers to the public or provides services, which:

    i) are promoted, advertised or marketed for the purpose of circumvention of any effective technological measure, or

    ii) have only a limited commercially significant purpose or use other than to circumvent any effective technological measure, or

    iii) are primarily designed, produced, adapted or performed for the purpose of enabling or facilitating the circumvention of any effective technological measure;

    shall be guilty of an offense, and shall be liable, upon the suit of any injured party, to relief by way of damages, injunction, accounts or otherwise.

    c) 'effective technological measure' means any technology, device or component that, in the normal course of its operation, controls access to a protected work, performance, phonogram, or other subject matter, or protects any copyright or any rights related to copyright.

    d) The prohibition referred to in Article 10.8(b) prohibits circumvention of technological measures and does not require an affirmative response to such measures. This Article does not require that the design of, or the design and selection of parts and components for, a consumer electronics, telecommunications or computing product provide for a response to any particular technological measure. This does not provide a defense to a claim of violation of Article 10.8(b).

    e) Each Party shall provide that a violation of the law implementing the provisions of this Article is independent of any infringement that might occur under the Party's law on copyright and related rights.]

    I'm sorry but I read part of the draft (yeah I know it's .doc) and these things appear halfway sensible, decide for yourself:

    a) ideas, regulatory procedures, methods, systems, mathematical designs or concepts per se;

    b) outlines, plans or rules for conducting mental processes, games or business,

    c) blank forms to be completed with any type of information, scientific or otherwise, and instructions thereon;

    d) texts of treaties or conventions, laws, decrees, regulations, judicial decisions, and other official records;

    e) information for everyday use such as calendars, diaries, official land registers, or diaries, and keys;

    f) individual names and title;

    g) industrial or commercial exploitation of the ideas in the work]


    Also note that in the chapter on copyright there is no mention of the DMCA, there is no mention of circumvention of encrypted data other than laws against making and selling devices for decrypting sattelite tv signals. Can someone point me to the offensive passages in the draft so I can see for myself what all the hype is about ?

    It's not really about which OS is better in a technical sense.

    At my company we are moving to Linux because the aims of the Linux OS coincide with our needs better than Windows.

    I'll explain: Linux has the aim of making a decent, stable, free OS, this is a primary aim. Microsoft OTOH has the aim of extracting as much money from their customers as they can, this is their primary aim. They try to achieve this through making a OS that will satisfy customers to an extent but they have millions of tricks that make their customers pay and they are not afraid of abusing their dominant position either.

    It is not the CEO's, it's the shareholders that are the culprits IMO.

    Have you ever owned stock ? Did you ever sell it because you thought the dividend on the stock was not so good ? Sell it and buy other stocks that pays better didvidend ? CEO's will do anything to increase the atractiveness of their stock and stockholders will think about with which stock they can make most money, they don't care about no DMCA etc. etc.

    I'm not sure about what I would have done if I had done some work (or the majority of the work on a project) and had not received credit for it in the way of it being named in a way that recognized my input. RMS guy does get credit for his work apart from not everyone using GNU right ? It's just the 3 letters that he is after ? What I don't really understand is all the fuss, after all the importance of a name would seem so small compared to the importance of free-software/freedom of speech/whatever philosophies/ideals.

    I think that if I were trying to make the world a better place, the world becoming a better place would be a great reward regardless of whether I had received credit for it or not.

    These are just my opinions based on the limited information I have. I don't know the people and I haven't studied the issues very well. I'm not going to either. It just saddens me that there seems to be some kind of quarrel over trivial things like names when it is so unimportant next to the concept of free software.

    Why would I want social interaction?

    Because it can be a satisfying experience... that's why. I don't think normal people try to escape reality when they are drinking/taking drugs. If someone takes drugs/alcohol to escape reality or does anything to escape reality there's got to be something wrong. I understand that humans have the need to get away from it all every now and then and relax, that's not the same as escaping reality IMO.

    I am not necessarily convinced that video games cause violence in itself. However to me it seems that if kids spend a significant part of their time playing video games instead of learning to interact with other people and learning to handle their feelings/thoughts in social situations, they might become violent later out of frustration/depression/inability to cope with social interaction etc. etc. I'm not saying that this has to be this way or is this way, all I am saying is that I wouldn't find it hard to imagine if it were that way. If I have kids there's no way that I'm going to let them play video games for days on end.

    you are right in that usually the largest component of resistance of displacement hulls comes from wave resistance. However wave resistance occurs over the whole speed range of the hull, not just at hull speed. (It takes energy to generate the waves you see behind a ship) At hull speed the wave resistance reaches a maximum.

    As a side-note: the Dutch actually had invented the schnorkel I think already before the war. The Germans discovered and applied the invention later on. (I read Doenitz's memoirs so I consider it a good source)

    the ECVT (electronically continuous variable transmission) works with a system of 2 pulleys and a belt between the pulleys. The pulleys are sort of conical shaped and can move relative towards eachother (in axial direction) thus creating an infinite number of drive ratios. (Low gear is the thin end on one pulley and the thick end on the other pulley, high gear is exactly the other way around).

    it's a potentially great transmission because you can adjust the gear ratio to the optimum continuously, the only problem is that the belt cannot handle much power, that's why it's usually put in small cars like the Subaru. Audi is now making a car with a CVT using a chain instead of a belt (for more power transmission) but I don't know if they're any good or not.

    Do a search for CVT, ECVT or van Doorne AND transmission (the inventor)

    France is a democracy, so in theory the actions of the government are determined by the French people. If they decide that they want to give their government power to filter certain stuff from the net, what of it ? If that is what they want ? That's just democracy.

    yeah, exactly...

    One of the big difference I see between normal books and ebooks is that for eBooks you need software and hardware to read it, that means you are locking yourself into a certain system. If this system is non-standardized or proprietary you basically are at the mercy of the availability of hardware and software to continue reading your books. One of the nice things about real books is that I can pick up a 100 year old book and I'll still be able to read it. With eBooks I can see how soft/hardware manufacturers will make my ebook collection obsolete by 'upgrading'/'versioning' and stuff like that which forces me to buy the same books over and over.

    mechanics of materials by Gere and Timoshenko is used in my university for a first course in mechanics of materials. The book has it's flaws but for a basic introducting to mech. of materials it's alright, it doesn't really require prior knowledge of mechanics besides some basic physics and some math.

    I'm not denying that the IT boom might be over it's crest, however the companies that you mention are all hardware manufacturers. Afaik their problems are more related to saturation of the market and a very competitive market driving prices down to a point where hardly anyone is making a profit.

    The slowdown in the IT sector might also be caused by the burst of the .com bubble, at least it must have contributed to it. Oh yeah, and don't forget the Y2K bubble...

    I'd say on a whole there are enough things left to be automated/computerized to keep demand for IT workers reasonably high. I'm working in the IT sector as a part-time job myself, but's it's a very specialized, a mix of programming, numerical mathematics and various mechanics. I got another job offer a few months ago for working some IT job, the pay they offered was very, very high.

    Aren't most software companies still making profits ?

    I haven't gotten one single piece of spam in my hotmail account so far.... I chose a pretty unconventional id though, so maybe that's why. I set some girl up with a Hotmail account a while back and she chose an id that's quite conventional, she got spam within days.

    yeah, exactly, ms didn't become big because windows was such a great os but because they managed to get most people locked into their formats. Even if you are pirating ms software you are still helping them to stay in control of their formats by using it.

    Yeah I agree, people using the internet primarily want to exchange information. The average person uses the internet to find out more about his hobbies, to communicate with his friends etc. , only a small percentage of time is spent shopping at online stores. Nobody wants to hang around Amazon, EBay, etc. all day. I think the internet is a bad medium for things like tv, video, phone etc. anyway, centralized broadcasts are much more efficient.
