  1. Re:Now for iOS? on Motorola Releases an Official Bootloader Unlocker · · Score: 2

After endless research, I have to say the RAZR MAXX is not just a good phone... but probably the best phone on the market. A solid well built phone that works great, looks fine and most importantly: It is practical! This is a smartphone that is really worth its money. In combination with the openness of Android this phone is the absolute Iphone killer. Sadly most people don't bother to get the best phone... they either get the fanciest phone (Apple hell) or the phone with the highest specs (the great plastic device called the S3). Just like the most popular president isn't going to be the best president, the most popular phone(s) are always the best ones. Sadly the phone buying market is victim to the same problem that our political systems are, the majority of those involved are idiots.

  6. No such thing as evidence in a German injunction on Flawed Evidence In EU Apple vs. Samsung Case · · Score: 3, Informative

The title of this slashdot post, the refered article and many of the comments seem to be a little miss-informed.

Everyone is refering to evidence whereas no evidence is required or submitted when applying for an injunction (Einstweilige Verfügung) in Germany. To get a German injunction, the submitter simply has to make their claim believable to the judge. There is no need for any evidence... simply statements, references and photos that make the request for the injunction believable. To make matters worse, these injunctions are dealt with by Civil Courts meaning the judges have no idea about technology or design. The submitted believability statements (as they are called in German) are not tested for validity they are not properly scrutinized and they need no real foundation they simply have to be made believable.

The problem here is the German justice system more than anything else. Any justice system that can make such far reaching decisions based on belief is without a doubt not worth taking seriously.

Wouldn't it be nice to see companies actually competing instead of playing silly mafia games with lawyers and judges. A flawed system run by incompetent people simply trying to make some cash based on nonsens instead of doing something productive... Who needs them?

A German Injunction does not require any evidence... The case simply has to be made "believable"! In addition, the judge is a Civil judge who has no idea about technology or design. Therefore, making the case believable is not hard to do and the judge will often be satisfied with just a few screen shots or photos...

One thing I didn't mention in my first post...

From my experience, it is the Civil Court that grants an "Einstweilige Verfügung". This also seems to be the case here. This means judges that typically decide on things like divorce and other civil matters are making decisions about techno-legal matters. Needless to say, these judges are in no way qualified to make such decisions and are completely overwhelmed when confronted with technology. There is nothing just about the justice system, just a new framework for Mafia-like practices to be carried out under an official banner. What a joke....

  10. Einstweilige Verfügung on Flawed Evidence In EU Apple vs. Samsung Case · · Score: 1

The German "Einstweilige Verfügung" (injunction) is a bit of a joke. There is no need for any real proof to get a German injunction. Basically the judge just has to be convinced that the claim might be valid. It is almost impossible to get an "Einstweilige Verfügung" reversed.

The "Einstweilige Verfügung" is a disgrace and should be abolished. You just need one judge to be dumb enough to approve it (no real evidence required) and from that point on, there is nothing anyone can do about it until the case is settled in court. Needless to say anyone with good connections to judges can easily make a big mess of things...

I started a business some time ago and even managed to get some money invested into it based on my half-finished business plan. What I did write took me quite a few weeks to get on paper and it was a very challenging task.

The idea was good and the few customers I had are still using and are very happy with my products but I didn't get a legal insurance right from the start and unexpectadly got sued at a very early stage! This lead to the end of my business adventure.

So my main advise is: Make sure you insure yourself as soon as possible!

Also stay away from VCs they are a waste of time and energy and although the extra money might help, they will make any bad situation a whole lot worse. Don't forget, most businesses fail!

Breaking the Law is Breaking the law? End of Story?

I have never heard such nonsense! Find a judge or lawyer who has never broken the law!

The law is a complete and corrupt disaster.

It is a tool of the rich and powerful (don't believe me? See if you can afford a lawyer! The law isn't made for you, you can't really afford it!)

To add insult to injury, the legal system is so complex that even lawyers don't understand it all. One lawyer can't help you with all your possible problems. In theory to avoid getting in trouble you need to have a pack of about 20 lawyers running all over the place with you to make sure you don't do something that could get you in trouble.

    Laws are:

    • A tool for huge corporations and the almighty elite to control us. Even our thoughts (eg. software patents)!
    • A tool to empower these same corporations. They have more rights than we people do!
    • A system created to protect us from crime that has been converted into a system to commit crime. When a lawyer writes you a letter threatening to sue you if you don't pay a certain amount of money... How is that different to extortion? Ever lost a case where you know that you were innocent?

The law is a system controlled by idiots, hypocrites and liars! Don't believe me? Look at your country's Internet laws or patent laws. Only a bunch of idiots could have come up with that!

Like many other things in our world today, the legal system is a disgrace to the human race.

A lot more could be said but I can't even be bothered. The people of today don't seem to give a shit about anything... not even themselves!

Please just start thinking and stop regurgitating!

Spend some time thinking about being someone in power. Think about how you would read these articles. We read things and think... do I agree or disagree, what is my opinion? They read it and they think... how do I keep my power and keep these people happy and maybe, if I can, gain more control over them. How do I use this to my advantage!

It is impossible to be anywhere in the lower 95% of the chain without being strongly abused by those at the top 5% of the chain.
