What happens when the Courts rule your wrong. It's not like they haven't done stupid things in the past regarding software. There was once a question whether copying a program to memory for execution was a copyright violation, so no it most definitely is not the End. Of. Discussion.
The courts do stupid things all the time because they don't understand the repercussions. Eventually we will get to the point where it is understood that API's are not copyright-able, but we are not there yet.
Just because you have a chip in your phone that allows for the reception of the FM band does not mean that the phone has the rest of the components required. Yes, they do make different models for different markets.

So it lacks several required connections (the most important one being the antenna). So it entails more then just activating the fm module, it is not something that can be done on your phone.
With a twin coil ferrite or loopstick antenna, which while it is significantly smaller then a random wire, or dipole it still is larger then you want to stick in your pocket.
