    Those are not actually different situations. The claimed baseline can be moved around arbitrarily, but the relative performance is identical and the price charged is unaffected..

    T-mobile decides on the criteria, therefore they implicitly get to decide who gets included by changing the rules.

    It's not expanding user choice if it is T-mobile that get to decide who are the favored video providers that get to avoid the throttling.

    Irrelevant to the discussion, because that is not one of the available options.

    The choices are a) throttle all video providers, or b) remove throttling for video providers on a list that T-mobile decides.

    T-mobile's intention is that only video providers on a list that they decide would be included. The fact that provider not on that list are not being throttles is actually a bug from their perspective.

    Not only are they violating net neutrality, they can't even correctly violate net neutrality.

  6. Only some providers are not throttled, so it changes the relative value of different providers to the customer outside of any inherent property of the provider.

    a) You have 1 set of power lines running into your house. You can't be a customer of some other power grid, and you can't do business with anyone who is not physically or virtually connected.

    b) Electrons are fungible. You can't distinguish the product of one provider form another. The output of different suppliers gets all mixed together, but there is no way to sort it back out at the other end.

    That in no way meets the conditions of a free market.

    Because the party to whom the liability is incurred does not have the choice to accept or reject the claim that self-insurance has successfully managed the risk, just like they didn't have the choice to have the liability owed to them in the first place.

    What evidence do you have for this claim? I do not currently own a gun, but my father always did and he taught me how to take care of my possessions.

    "you ought to remove the gun and lock it up in a safe at home, or in your car, you forget and it stays in the bag where it always is" contradicts "it's never out of your control". If the gun is not where you intended to put it, it is not under your control.

  17. Adblock Plus is already effective against this. I use it to block non-ad components of site that are annoying, such as superfluous videos, boxes with links to related article, etc.

    You what isn't effective at blocking ads that come from the same domain as the content? HOST files. 8-)

    The United States alone produces enough food to feed the entire world population. The US could feed 1.5x it's own population at US consumption levels without any drop in food exports.

    Food production is a non-problem.

    That isn't because of ACA; that is because your employer's benefit choices are decided by assholes. My employer cried that this would happen to our plans if Obamacare was passed... except it didn't. We actually have more choices and our premiums have been flat.

    What we don't have are the exact same plans as before... except that happened before Obamacare too. Everything changed a bit every year before and after.

    Even if we stipulate that you are as good as you think you are, you are not in control because you are surrounded by OTHER DRIVERS.

    Whenever I cross the street most of the drivers can't figure out where to stop. I have experienced drivers who were previously stopped but start accelerating while I am crossing directly in front of them. I have experienced drivers who has steered toward me and I try to dodge out of their way. You cannot depend on the average driver to be in control.
